Description This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation document will not be issued. This solicitation is issued as an RFQ. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-05 (eff. 03/10/2021). This solicitation is for BRAND NAME ONLY equipment and is unrestricted. The associated North American Industrial Classification System (NAICS) code for this procurement is 334510 Electromedical and Electrotherapeutic Apparatus Manufacturing, with a small business size standard of 1,250 Employees. The FSC/PSC is 6515 Medical and Surgical Instruments, Equipment, and Supplies. The New Mexico VA Medical Center is seeking to purchase BRAND NAME ONLY Zoll Medical Corporation Software Subscriptions. Part Number: 8400-110004 1 EA Statement of Work Zoll Server Software Phoenix Veterans Affairs Health Care System (PVAHCS) Purpose: The Phoenix VA Health Care System (PVAHCS) requires Zoll Defibrillator Dashboard and CaseReview software. Background: The Zoll Defibrillator Dashboard and CaseReview software allow the site to view maintenance statuses and event logs. This is helpful in tracking the defibrillators and AEDs at the main facility and at the CBOCs. Scopes of Work: The Contractor shall provide a (1) year subscription for the Zoll Defib Dashboard for (46) R Series defibrillators. The Contractor shall provide a (1) year subscription for the Zoll CaseReview for (46) R Series defibrillators. The Contractor shall provide a (1) year subscription for the Zoll Defib Dashboard for (49) AED3 automated external defibrillators. The Contractor shall provide a (1) year subscription for the Zoll CaseReview for (49) AED3 automated external defibrillators. The Contractor shall install and configure all software on a VA-provided virtual server. The Contractor shall configure all R Series defibrillators and AED3 automated external defibrillators to upload data to the server. The Contractor shall train end users on the Zoll Defib Dashboard software The Contractor shall train end users on the Zoll CaseReview software The Contractor shall guarantee workmanship and all equipment furnished by the contractor for a period of not less than 1 year from date of delivery. The Contractor shall provide remote technical support, Monday-Friday, 8am-6pm EST, excluding federal holidays, during the warranty period The Contractor shall be responsible for updates and upgrades during the warranty period Security: In reference to VHA Handbook 6500.6 Appendix A, Block 6, the service included in this contract does involve connection of IT devices to a VA network. Therefore, C&A, SAP, & the following from App C apply. In reference to VHA Handbook 6500.6 Appendix A, Block 7, service does involve storing, generating, transmitting, or exchanging VA sensitive information. The contractor, their personnel, and their subcontractors shall be subject to the Federal laws, regulations, standards, and VA Directives and Handbooks regarding information protection, patient privacy, and information system security as delineated in this contract. During contract performance, contractor may require physical access to VA facility, equipment, information systems, or sensitive data; to provide services, install, train, maintain or repair equipment. During contract performance, contractor may require remote access to VA facility, equipment, information systems, or sensitive data; to provide services, install, train, maintain or repair equipment. VA Course No. VA10203 is privacy training required for VA contractors requiring access to VA facilities for more than 2 consecutive days or any access to VA information systems. Training will be completed prior to being granted access to facilities, equipment, or to the data therein. Training is available on VA TMS website at: https://www.tms.va.gov. Contractor will provide evidence of training to the COR, if requested. A national Business Associate Agreement between the Contractor and the VA shall be in place upon award of the contract to govern VA information sharing with contractor. A national ISA/MOU between the Contractor and the VA shall be required to document terms and conditions if there is sharing of data and information resources through network, wireless, remote connections, in a secure manner. All hard drives or other data storage devices will be removed, and if done on-site will be purged of data, prior to contractor access. The Contractor is required to obtain the Contracting Officer s approval prior to engaging in any contractual relationship in support of this contract requiring the disclosure of information, documentary material, and/or records generated under or relating to this contract. The contractor is required to abide by Government and Agency guidance for protecting sensitive and proprietary information. Upon arrival at the facility, all contractor personnel shall check-in with a valid Driver License or Company ID to the Biomedical Engineering department. Prior to conducting services, the contractor shall be issued a visitor s badge which shall be worn above the waist during the contractor s visit. The contractor shall return to the same location to sign out and turn-in issued visitors badge along with the documented service report for the service performed. Signing in/out shall be during normal business hours: Monday Friday 7:00 am to 4:00 pm local time, excluding Holidays, reference federal holiday link in paragraph 12. No photography of VA premises is allowed without written permission of the Contracting Officer. Records Management Language for Contracts. The following standard items relate to records generated in executing the contract: Citations to pertinent laws, codes, and regulations such as 44 U.S.C. chapters 21, 29, 31, and 33; Freedom of Information Act 5 U.S.C. 552; Privacy Act 5. U.S.C. 552a; 36 CFR Part 1222 and Part 1228. The Contractor shall treat all deliverables under the contract as property of the U.S. Government for which the Government Agency shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. The Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records. The Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act. The Contractor shall not create or maintain any records containing any government Agency records that are not specifically tied to or authorized by the contract. The Government Agency owns the rights to all data/records produced as part of this contract. The Government Agency owns the rights to all electronic information and all supporting documentation created as part of this contract. The Contractor must deliver sufficient technical documentation with all data deliverables to permit the Agency to use the data. The Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format, mode of transmission, or state of completion. No disposition of documents shall be allowed without the prior written consent of the Contracting Officer. The Agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage, or alienation of Federal records is subject to the files and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the Agency or destroyed without regard to the provisions of the agency records schedules. The Contractor is required to obtain the Contracting Officer s approval prior to engaging in any contractual relationship in support of this contract requiring the disclosure of information, documentary material, and/or records generated under or relating to this contract. The contractor is required to abide by Government and Agency guidance for protecting sensitive and proprietary information. 5. Any quotes received without an authorized distribution letter will be considered non-responsive. All quotes shall be sent to the timothy.garrity@va.gov. Award will be based upon price only comparison of quotes in accordance with the Simplified Acquisition Procedures of FAR 13. The award will be made to the response most advantageous to the Government. Responses should contain your best terms and conditions. To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows: ""The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition.""
