- The U.S. Consumer Product Safety Commission (CPSC) announces its intention to negotiate and issue a sole source award to SEA Limited, 7001 Buffalo Parkway, Columbus, Ohio 43229 for Recreational Off-Highway Vehicle (ROV) floorboard debris penetration testing. �Since the nature of the preliminary testing sought for this requirement can potentially injure human drivers, where rigid objects can puncture the ROV floorboard and impale the occupants, it is essential that the preliminary discovery testing be done autonomously, as this method would enable test personnel safety, accuracy, repeatability, and reduce human testing error/variability. CPSC awarded 61320620F0037 for testing of ROV floorboard penetration testing in fiscal year 2020 to SEA.� The current requirement is an expansion of the testing done under 61320620P0037, and data developed under the new award must be able to be combined for analytical purposes with the data provided under the previous contract.� Awarding to any other contractor would require extensive validation of their facilities and test rig to confirm that their data would be able to integrate with the existing testing data prior to being able to accept any data delivered.� Duplication of the equipment and expertise for autonomous operation of ROVs by another contractor would incur substantial cost to the government that will not be recovered through competition. CPSC is authorized to enter into contracts for equipment and services required to investigate the safety of consumer products and for improving the safety of such products (5 U.S. C. � 2054).� CPSC intends to negotiate this requirement under the authority of FAR 6.302-1 and 41 U.S.C. 253(c)1. The sole source procurement will be awarded as a simplified acquisition in accordance with FAR Subpart 12 & FAR Subpart 13 procedures.� Interested persons may identify their interest and submit a capability statement demonstrating their ability to meet this requirement.� This notice of intent is not a request for competitive quotations; however, all quotations/responses received within seven (7) business days of the issuance of this notice will be considered by the government.� A determination by the government not to compete this proposed procurement based upon responses to this notice is solely within the discretion of the Government.� Any quotation/response must be in writing and can be sent via email to the Contract Specialist at csterba@cpsc.gov by 11am Eastern Time July 28, 2021. No phone calls will be accepted.�
