Description
This is a combined synopsis and solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Request for Quotation (RFQ) number is N66604- 21-Q-0546.�� The Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT) intends to award a firm fixed price purchase order on a brand name basis, no substitutions allowed, for the following National Instruments (NI) items: CLIN 0001: National Instruments PXI-4132 Precision SMU; Qty: 2 CLIN 0002: National Instruments PXI-6281, M Series DAQ (16 Analog Inputs, 24 Digital I/O, 2 Analog Outputs); Qty: 2 CLIN 0003: National Instruments PXI-4110 Triple Output DC Power Supply with APS-4100 Auxiliary Power; Qty: 2 To be considered technically acceptable, the items shall be delivered within six (6) weeks of date of award.� Delivery is F.O.B. Destination to: NUWCDIVNPT.� This procurement is set-aside 100% for small businesses.� The North American Industry Classification System (NAICS) Code for this acquisition is 334118. The Small Business Size Standard is 1,000 employees.� This requirement will be awarded to the offeror with the lowest price technically acceptable (LPTA) quote. In order to be determined technically acceptable, the offeror must provide the following: (1) NI brand name items as specified in the attached Brand Name Specification, no substitutions, in the quantities listed above; (2) Offerors must be NI authorized resellers; (3) Offerors shall provide proof that the items are shipped within the US; (4) For items configured in-house, Offerors shall provide proof that all items configured in house are new products, gray market items will not be accepted. If the Contractor does not deliver new hardware or provide proof that the in-house configured items are all new products, the Government need not accept delivery. If after award the hardware delivered is determined not to be new or delivered outside the US, the Government has the right to terminate for cause with the Contractor liable to the Government for any and all rights and remedies provided by the law including excess re-procurement costs. The Government may consider past performance information in accordance with DFARS Provision 252.213-7000 where negative information within the Supplier Performance Risk System (SPRS) may render a quote being deemed technically unacceptable. Incorporated provisions and clauses are those in effect through the current Federal Acquisition Circular. The following FAR provisions apply to this solicitation: 52.209-11, Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law; 52.204-24, Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment; 52.212-1, Instructions to Offerors-Commercial Items; and 52.212-3, Offeror Representations and Certifications - Commercial Items. The following FAR clauses apply to this solicitation: 52.204-19, Incorporation by Reference of Representations and Certifications; 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment; 52.212-4, Contract Terms and Conditions Commercial Items; and 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items. The following DFARS provisions apply to this solicitation: 252.204- 7008, Compliance with Safeguarding Covered Defense Information Controls (Dec 2015); 252.215-7013, Supplies and Services Provided by Nontraditional Defense Contractors; and 252.225-7031, Secondary Arab Boycott of Israel. The following DFARS clauses apply to this solicitation: 252.203-7000, Requirements Relating to Compensation of Former DoD Officials; 252.204- 7009, Limitations on the Use or Disclosure of Third-Party Contractor Reported Cyber Incident Information, 252.204-7015, Notice of Authorized Disclosure of Information for Litigation Support, 252.232-7010 Levies on Contract Payments; 252.247-7023 Transportation of Supplies by Sea; and 252.246-7008, Sources of Electronic Parts. In accordance with DFARS Clause 252.211-7003, the contractor shall provide a unique item identifier (UID) for all delivered items for which the Government�s unit acquisition cost is $5,000.00 or more. Payment will be made via Wide Area Work Flow (WAWF).� An exception to Electronic and Information Technology (EIT) Section 508 requirements apply per FAR 39.204(d). This solicitation requires active registration with the System for Award Management (SAM) prior to award, pursuant to applicable regulations and guidelines. Registration information can be found at www.sam.gov. The offeror shall include price (inclusive of shipping price), shipping terms, and the following additional information with its submission: Offeror Point of Contact (including phone number and email address), Offeror CAGE Code, and Offeror DUNs number. Quotes must be submitted to Naval Undersea Warfare Center Division. Newport Contracts Department via e-mail to Debra Dube at debra.dube@navy.mil on or before 2:00PM Eastern Standard Time (EST) on 26 July 2021. Quotes received after this date are late and may not be considered for award.
