- VHAPM Part 806.3 Other Than Full and Open Competition (OFOC) SOP Attachment 2: Request for Sole Source Justification Format >SAT OFOC SOP Revision 08 Original Date: 03/22/11 Revision 08 Date: 04/18/2018 Page 1 of 3 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID: 590-21-3-2066-0316 Contracting Activity: Department of Veterans Affairs, VISN 6, Hampton VA Medical Center (Engineering Service), Network Contracting Office (NCO) 6. Nature and/or Description of the Action Being Processed: The material or services lis in Par 3 below is sole source, therefore, consideration of the number of contractors requires by FAR Subpart FAR 6.302-1; Is precluded for the reasons indicated below. Description of Supplies/Services Required to Meet the Agency s Needs: This request is intended to expand Hampton VAMC s physiological monitoring presence for COVID inpatient wards, increase ease of data transfer on the same patient between different clinical units and reduce telemetry staff fatigue. This request includes new bedside physiological monitors, central stations, servers, software licenses, telemetry viewing monitors, as well as professional services to install and configure the new devices. Total estimated cost is $313,377.15. Statutory Authority Permitting Other than Full and Open Competition: ( x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (x ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This request is an expansion of the existing physiological monitoring system: Intellivue Network. Philips Healthcare is the only known source for this, as Philips is the manufacturer of the equipment and the provider for the Intellivue-specific professional services, according to the first three pages of Google searches for Intellivue Installation . Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This order represent the best value to the government as it precluded the government of significant additional cost to re-configured its current system, undue administrative burden and potential disruption of services. Currently Hampton VA Medical Center is configured to utilize Philips Intellivue Network and represent the best value to the government. Any interruption in service is unacceptable as this system provides physiological monitoring of veterans at the VAMC Hampton VA. Thus, awarding this requirement to Philips Healthcare is the best value to the government. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The contracting officer determines that pricing will be fair and reasonable, based on GSA pricing and historical information Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: As stated in number 5, market research was conducted through Google search engine. Under the authority of FAR 6.302-2 Unusual and compelling urgency, (2), (b), (1), (2), When the agency s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.
