Special Notice Special Notice Special Notice *= Required Field Special Notice Notice of Intent to Sole Source The Department of Veterans Affairs, NCO 6 intends to award a sole source, FFP, Purchase Order to NICOYA LIFESCIENCES, INC. for the procurement/purchase of the OPEN SPR SYSTEM to be used at Salem VA Medical Center, 1970 Roanoke Blvd, Salem VA 24153. The North American Industry Classification System (NAICS) for this requirement is 334516 with a small business size standard of 1000 employees. Authorized product distributors of Open SPR System may provide a capability statement as instructed below. This proposed contract action is for the purchase of Open SPR System a Surface Plasmon Resonance instrument that measures binding kinetics of biomolecular interactions. The Open SPR platform consisting of the Open SPR instruments, proprietary sensor chips and assay reagents. The Open SPR instrument and sensor chips are covered by existing Nicoya Lifesciences Patents (#9322823B2 & #10794904B2). The government intends to solicit from only one source under the authority of FAR 13.106-1(b), Soliciting from a Single Source. This notice of intent is not a request for competitive quotes; however, interested parties may identify their skill and ability by sending capability statements in reference to this requirement no later than July 27, 2021 by 10:00 a.m. EST to ruth. morris@ va.gov. Interested firms must indicate whether they are a large, small, small-disadvantaged, 8(a) or woman owned business. If your firm is a Service-Disabled Veteran Owned or Veteran Owned Small Business, you must be CERTIFIED in VetBiz (see internet site: http://vip.vetbiz.gov). Also indicate whether the vendor is U.S. or foreign owned (in compliance with the Buy American Act). Respondents who submit proprietary data shall clearly mark the data with appropriate markings. The Open SPR is a platform consisting of the Open SPR instrument, proprietary sensor chips and dedicated assay reagents. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Salem VA Medical Center Research and Development (R&D) Department have a requirement to procure the Open SPR System. This system focuses on the role of heme: Heme Oxygenase (HO)-1 system in kidney injury. The molecular interactions between HO-1 and its natural substrate, heme, with target structural proteins of the kidney translating into novel approaches to preserve renal function following injury. Therefore, an instrument capable of measuring the binding kinetics of the biomolecular interactions, is essential. SPR is the gold-standard technique to characterize biomolecular interactions. Commonly used for drug discovery, the assay provides quantitative binding affinity and kinetics data which can uncover key mechanisms of the interaction measured. The Open SPR s kinetic, competition, and IC50 SPR assays will allow for the evaluation of HO-1 interactions both directly and indirectly, and will be supported by Nicoya s SPR experts, will provide in-depth support to all customers from instrument training to data analysis and experimental design.  Unique features of this device are: Flow rate that is adjustable from 5-200 uL/minute Customization of sample volume injections between 5-100uL Ability to control the experimental temperature from 4-40C Kinetic association rates between 1x103 1x107 and kinetic dissociation rates between 0.1 1x105 Ability to measure equilibrium dissociation constants between a range of mM pM Has three automated buffer input ports The ability to upgrade into a fully automatic fluid handling system having a total of 192 sample capacity This procurement is in direct support of the Research and Development efforts headed by Dr. Elias Lianos. Based on facility need and existing conditions, like or similar items will not suffice. Description of market research conducted and results or statement why it was not conducted: Market research was conducted by querying the VIP on 07/09/2021 utilizing NAICS 334516 and Key Words Open SPR System revealed 32 vendors: 31 SDVOSBs and 1 VOSBs. FPDS searched using keyword SPR System under department of Veteran Affairs revealed 17 purchase order, and addition search using keyword Nicoya under department of Veteran Affairs revealed 7 suitable purchase orders that were used for information purposes only. NAC searched using keyword Open SPR System revealed 80 possible contracts no exact match. SAC searched using keyword Open SPR System revealed 44 possible contracts no results under department of veteran affairs. GSA eLibrary; searched using keyword Open SPR System revealed no possible vendor contracts. GSA Advantage: searched using keyword Open SPR System revealed one result from the manufacturer APEX CAMPBELL for the SNAP SPR OPEN SWL 1407 no exact match. SBA Dynamic Small Business Search (SBDS) search using NAICS 334516 and Keywords Open SPR System revealed no potential vendors. SBA.gov was used to verify 334516 size standards as 1000 employees. NCO 02 previously purchased the SURFACE PLASMON RESONANCE under award 36C24221P0830 on 05/05/2021 to Nicoya Lifesciences, Inc (LB); 1 offer received .(Identify POC name/title organization/e-mail/phone and the resultant source list): The OPEN SPR (SURFACE PLASMON RESONANCE) SYSTEM in need for this procurement Original Equipment Manufacturer (OEM) is Nicoya Lifesciences, Inc. (Large Business DUN: 203385554) is the Sole Source provider of the Open SPR System with no authorized resellers/distributors. The Contracting Officer does not have a reasonable expectation of receiving 2 or more quotes from SB if we were to set this requirement aside as 100% SB. The CO is electing to Sole Source and award to the (OEM) Nicoya Lifesciences, Inc IAW FAR Part 13.106-1 (b). Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
