******PLEASE SEND A CAPABILITIES STATEMENT AND RELEVANT PAST PERFORMANCE�TO JACOB.HENSON@USDOJ.GOV�BY COB AUGUST 20, 2021�IF YOUR COMPANY IS INTERESTED IN SUBMITTING A BID FOR THE BELOW�REQUIREMENT************** U.S. Department of Justice Criminal Division Statement of Work Graphic Design LITCON Services & Trial Support, Testimony July 6, 2021 1.0 INTRO & BACKGROUND The Criminal Division (CRM) operates in connection with the enforcement of the criminal laws of the country by giving direction, where necessary, to the prosecution of cases involving crimes against the United States and to all other matters involving criminal practice and procedure. It is divided into 17 sections that provide advice and instruction to United States attorneys in various districts respecting the conduct of criminal cases: Appellate Section (APP), Capital Case Section (CCS), Child Exploitation and Obscenity Section (CEOS), Computer Crime and Intellectual Property Section (CCIPS), Fraud Section (FRD), Human Rights and Special Prosecutions Section (HRSP), International Criminal Investigative Training Assistance Program (ICITAP), Money Laundering and Asset Recovery Section (MLARS), Narcotic and Dangerous Drug Section (NDDS), Office of Administration (ADM), Office of Enforcement Operations (OEO), Office of International Affairs (OIA), Office of Overseas Prosecutorial Development, Assistance and Training (OPDAT), Office of Policy and Legislation (OPL), Organized Crime and Gang Section (OCGS), and the Public Integrity Section (PIN). Each of the above Sections have varying Graphic Design needs, most of which can be adequately served by Justice Management Division�s (JMD) Print Shop. FRD represents the heaviest user of graphic design services that cannot be met by the Print Shop because of the complex nature of medical and financial fraud in its litigation. As the Department�s office with the largest number of white-collar prosecutors, the Fraud Section combats financial crime, foreign bribery offenses, and complex health care fraud schemes in federal courts around the country, routinely charging and resolving cases of both national and international significance and prominence.� 2.0 SCOPE OF WORK The purpose of this BPA is to procure graphic design services within CRM to assist prosecutors at trial by 1) creating demonstrative materials that convey and simplify complex and extensive information to a jury or to the general public or press, and (2) providing consultation services. 3.0 TASKS The contractor shall be responsible for providing personnel and deliverables in accordance with, but not limited to, the following task areas:� The government reserves the right to add additional tasks within scope of the BPA at a later date based on need and funding availability.� 3.1� Graphic Design Services for Litigation Proceedings The contractor shall: Create summary exhibits, demonstratives, PowerPoint presentations, and materials for opening statement and closing and rebuttal argument and otherwise provide consulting and other assistance with the presentation of evidence. Create professional looking reports with the final product developed in a format that is editable and can be used as a template for future reports. Procure licensing for any images or graphics that would enhance the final product. Provide PowerPoint presentations, reports, 3D modeling and animation, medical and technical illustrations, interactive tutorial creation, and display board production. Print color graphics on display board or in report format as needed. Submit deliverables to POC at designated time as required by prosecution team. 3.2 Graphic Design General Consulting The contractor shall: Assist in concept development and provide art direction for trial. Provide strategic recommendations on the development of demonstrative evidence and summary exhibits for trials, presentations, and reports Assist in the development of demonstrative evidence in line with common practices used in the courtroom Have an active jury research practice that conducts focus groups and mock trials across that nation and assists DOJ with the jury selection process, shadow juries, and post-trial juror debriefing.� Provide juror perception research, online focus groups, venue/verdict analysis, and witness preparation and training 4.0 DELIVERABLES The contractor shall provide the deliverables outlined in Section 3. Tasks throughout the life of the BPA 5.0 MINIMUM QUALIFICATIONS Significant (10+ years) experience developing demonstrative evidence for trials so that firm can understand the complexities of any given case and make strategic recommendations for the development of demonstrative evidence in line with common practices used in the courtroom. Ability to travel, if necessary; and����� Absence of conflicts due to work for parties involved in investigations. 5.1 Desired Qualifications Members to the American Society of Trial Consultants 6.0 GOVERNMENT FURNISHED PROPERTY (GFP) DOJ laptops will be provided. It is not anticipated that other GFP will be provided. Documents (including data) gathered during the course of the investigation, as well as analyses of such data and documentation created by other government contractors shall be returned to the government at the end of expert work. 7.0 PERSONNEL SECURITY Reference �Attachment 2 - Contractor Personnel Security Clauses.doc� 8.0. TRAVEL Travel to Washington, DC for one or two meetings, as needed, to consult on report design, and to locations across the country for testimony and court preparation as needed.� 9.0. REPLACEMENT OF CONTRACTOR PERSONNEL AND CONTRACTOR SUBSTITUTIONS Government Directed Replacement The Government reserves the right to require the contractor to remove and replace contractor employees or subcontractor personnel with a criminal history inconsistent with government standards; who may be considered a security risk; who are deemed incompetent, unsuitable, or objectionable; or whose continued use under this contract is deemed contrary to the best interests of the Government. The decision to require that contractor personnel be replaced is at the sole discretion of the Contacting Officer (CO).� The CO will give notice of such replacement in writing, after which the contractor has three (3) business days to respond, unless otherwise stated by the CO. All replacements shall meet or exceed all minimum qualifications required for the position. The contractor shall not allow any replacements to begin performance until approval has been provided by the COR in order to ensure proper security and other logistics protocols are followed.�������� Contractor Substitution of Non-Key Personnel� Contractor employee substitutions of Non-Key Personnel are at the discretion of the contractor with proper notice in writing to the COR. All substitutions shall meet or exceed all minimum qualifications required for the position. The contractor shall not allow any substitutions to begin performance until approval has been provided by the COR in order to ensure proper security and other logistics protocols are followed.������� Contractor Substitution of Key Personnel� After contract award, any request to substitute Key Personnel must be submitted in writing to the CO with the candidate�s resume or curriculum vitae. All Key Personnel substitutions shall meet or exceed all minimum qualifications required for the Key Personnel position. The CO must approve all Key Personnel substitutions in writing to the contractor and the contractor shall not allow performance until further approval has been provided by the COR in order to ensure proper security and other logistics protocols are followed.������� 10.0 PROPRIETARY RIGHTS All proprietary rights with respect to the information, data and materials produced by the contractor in connection with this contract shall vest in the Government. Such information and materials include: reports, databases, plans, designs, procedures, recommendations and any other such physical or intellectual property. The contractor shall not publish or otherwise publicly provide any of the above without written approval by the contracting officer. This provision shall be placed into any subcontracts supporting this effort when a subcontract is entered into by the prime contractor and a subcontractor. 11.0 NON-PAYMENT FOR UNAUTHORIZED WORK Any new or additional work performed by the contractor outside of the work defined herein, whether at the contractor�s own volition or at the request/direction of any individual other than the contracting officer or his/her designated representative as identified in this document, shall be at the sole financial risk of the contractor. Only a duly-appointed contracting officer is authorized to bind the Government to any addition to or change in the tasks, deliverables, duties, responsibilities, specifications, terms and/or conditions of this contract; and, only a duly appointed COR may provide technical direction with respect to those same tasks, deliverables, duties, responsibilities, specifications, terms and/or conditions. 12.0 PERFORMANCE PERIOD LOCATION AND DAYS/HOURS� Period of performance: Date of contract award for one year, with four exercisable option periods. The place of performance: Contract performance will primarily occur at the vendor�s facility. Working hours will be determined by the needs of the prosecution team. Any onsite meetings will be held at 1400 New York Ave NW, Washington, DC. 14.0� SECTION 508 MANDATORY COMPLIANCE The Contractor shall comply with the requirements set forth in Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794 d) when using, providing, developing, procuring or maintaining electronic and information technology products or systems as defined in FAR 2.101, in performance of this requirement.
