Rafael Rodriguez Contracting Officer CONTINUATION PAGE AMENDMENT No. 1 SOLICITATION No. 36C24821R0021 Unarmed Security Guard Services at VACHS facilities (Puerto Rico & USVI) This amendment is hereby issued to amend Performance Work Statement (PWS) and Price/Cost Schedule and provide response to questions and request for information submitted by vendors. PERFORMANCE WORK STATEMENT (PWS) AMENDMENT Performance Work Statement is hereby Amended to add the following information to Section 1. Introduction: 1.7 VACHS Universal Mask Program is applicable to this contract. VACHS Universal Mask Program requires every health care worker (HCW) to wear a healthcare face mask while in VACHS. Health care worker is defined as any person required to work at a VACHS facility including contractors, must always wear a healthcare face mask while in VACHS. And Correct the following information on Section 2.7 Postings and Site Locations and Section 17. Contractor-Furnished Property: Section 2.7: Site #7- VA Medical Center, San Juan, PR (Multi-Level & Pedestrian Traffic) is hereby corrected to read Site #7A VA Medical Center, San Juan, PR (Multi-Level & Pedestrian Traffic). All other information remains unchanged. Section 17 item (f) Contractor shall provide sanitary facilities as needed. At present time four (4) portable toilets are required at the following locations: Carolina warehouse, AMA 1 and AMA 2 parking lots and Gate 1 is hereby amend to read: At present time five (5) portable toilets are required, and include a the fifth location which is Arecibo Clinic. See attached PWS for details. PRICE/COST SCHEDULE AMENDMEMT Price/Cost schedule is hereby amended as follows: LINs 0007AA, 0007AB, 1007AA, 1007AB, 2007AA, 2007AB, 3007AA, 3007AB, 4007AA and 4007AB have been added to correspond to PWS Site# 7A and Site #7B (PWS Section 2.7, RFP page 34). See attached Price/Cost Schedule. RESPONSE TO QUESTIONS AND REQUEST FOR INFORMATION 1. Section 2.8 states that there are ongoing construction projects and that posts may be added. Aside from the Arecibo Clinic, are there any other sites that are under construction and are anticipated to be complete within the life of the contract and its option years? At present time the information available is about the Arecibo clinic only, if additional sites arise during the life of the contract information will be provided and any changes processes as described in PWS. 2. Section 2.9 states that the Contractor shall provide backup guard service. How many backup guards does the incumbent provider currently have on staff? Has that number been sufficient to cover all of the Caribbean HCS s needs? This is a performance-based requirement. The Government expects Offeror to thoroughly review the PWS and submitted their best proposal based on their experience, and commercial practices following RFP. 3. Section 5.1 anticipates emergency calls and that the contractor respond within one (1) hour of notification. How many such occurrences have happened in the last one (1) and five (5) years? The emergency calls are seldom and usually in response to any unusual yet compelling circumstances i.e. natural disasters, massive power outages etc. During the last year, there were no emergency calls, for the last five years there were at least two (2) after hurricanes requiring multiple guards, these events are difficult to predict and the historic information does not necessary provide for all possible emergencies, Offeror shall submit their best proposal based on their experience and commercial practices of the industry. Offeror needs to ensure they have available personnel and resources to respond. 4. Section 6.9 states the requirement of a Lead Guard/Supervisor. Just to clarify, is this guard allowed to be one of the guards already assigned to the site (not to be an additional person added on to the contract) with the required qualifications as outlined in the following sections? This is a Performance-based requirement where the Offeror shall provide their best possible solution according to requirement description as provided in RFP and commercial industry practices. 5. Section 7.5 and 7.6 anticipate the need to provided limited inspection of vehicles and package inspections. What is meant by limited inspection of vehicles? Will equipment be provided for these inspections and, if so, will additional training be required and/or provided? At certain Posts packages, and cargo area need to be visually inspected. Also, shuttle bus access requires Guard to board the vehicle and verify passengers ID. No additional or specialized equipment is required or needed. All Guards training needs are to be provided by the Contractor. 6. Section 17(f) requires that the Contractor provide portable sanitary facilities as needed. Are there facilities kept in storage at the work-sites at which these are a necessity and, if so, will the contractor be able to rent them from the VA? If not, does the VA have a preferred provider? Will these facilities be only for contractor personnel, or are they to allow for public use as well? Portable sanitary facilities are to be kept at the work-sites in which they are necessary. The VA does own portable sanitary facilities therefore, they cannot be rented from the VA. The VA has no preferred provider, it is up to the Contractor to select their provider. These facilities are for contractor personnel only. Please note PWS amendment includes a change in this portion to read five (5) portables required instead of four (4) and provide the fifth location which is Arecibo Clinic. See Amended PWS attached. 7. When does the government anticipate awarding the contract? The government anticipates awarding a contract anytime during the month of July 2021. 8. Who is the incumbent provider? The incumbent contractor is One Corps Inc. 9. What is the price of the incumbent s services per year? Current contractor information may be requested and disclosed under Freedom of Information Act (FOIA) in accordance with 38 Code of Federal Regulations (CFR) 1.553(b). The VA accepts FOIA requests submitted by email. Email must be sent to SAJFOIA@va.gov. For additional information about FOIA regulations and procedures, please visit www.foia.va.gov 10. Does Gate 3 work on Federal Holidays? See Price/Cost Schedule for required hours. 11. Section B.2 Price/Cost Schedule mentions Post #7 Multi-Level & Pedestrian Traffic, but Section 2.7 Posting and Site Locations mentions two(2) Site #7, one (1) Site #7 Multi-Level & Pedestrian Traffic and another post, Site #7B Multi-Level B, advise. PWS Section 2.7 amended from Site #7 to read Site #7A Multi-Level & Pedestrian Traffic, Site #7B remains unchanged. See Amended PWS attached. Price/Cost Schedule amended to include LINs 0007AA, 0007AB, 1007AA, 1007AB, 2007AA, 2007AB, 3007AA, 3007AB, 4007AA and 4007AB to correspond to PWS Site# 7A and Site #7B (PWS Section 2.7, RFP page 34). See Amended Price/Cost Schedule attached. 12. Loading dock schedule. M-F 4A-6PM or 24/7? If, 24/7, will it include federal holidays? See RFP Price/Cost Schedule for required hours. 13. For proposal package submission, will it be required by Volume (i.e. Technical Volume, Pricing Volume, Past Performance Volume, etc? Is there a page limit for Technical Volume? Yes, proposal shall be divided by volumes (technical, price, past performance). Although, there is no page limit for the technical volume, consider that submittal is via email and if document size is too large it may cause transmitting errors. If the need to split the Volume for electronic submittal, proper naming convention is recommended i.e. Technical Volume Part I, Technical Volume Part II, etc. 14. Under Section 2.11, it is mentioned that guards will use two-way walkie talkie furnished by the contractor. Would an alternative to the walkie-talkies (i.e. cellphones designed for calling only, portable radios, etc.) be acceptable? That portion of requirement refers to a two-way communication equipment, preferably a portable radio. The intent is for Contractor to have its own internal mean of communication in addition to the one provided by the facility. 15. Under the training section, OSHA training is required. Which of the OSHA programs is required by this agency (type and amount of hours)? A total of eight (8) hours of OSHA training required, on Workplace Safety, Hazardous Material & Heat Stress. 16. Page 33 Para 1.5.2 Licensing of Contractor At the time of submitting the offer; the contractor shall possess a Security Agency License. Can this requirement be change to read to be in possession of license before the performance start date? Department in Puerto Rico that deals with licensing is closed until May 3, 2021. VI Commissioner of Police who processes applications is just now processing June 2020 applications. Unfortunately, this requirement cannot be changed. The Government has a current critical need of this services. Therefore, it needs to ensure Awardee is compliant with the law at time of evaluation and with enough time to initiate transition and begin providing services on proposed contract start date without delays. 17. Can a seniority list be provided of the incumbent employees to determine amount of vacation entitlement? This information is not available before contract award, offer should be based on your best estimate. Offerors can offer employment to current personnel in good faith but it s up to the employee to accept or denied the offer. Offeror shall develop a plan to be fully staff on the proposed contract start date. 18. Who is the incumbent company? The incumbent contractor is One Corps Inc. 19. Is the site supervisor exclusive for the VA Medical Center? This is a performance-based requirement where the Offeror shall provide their best possible solution. See RFP PWS 6.9 thru 6.11, for supervisor/lead guard qualifications requirement. 20. Does the VA Police supply radios for each contract post? Yes, each post has an assigned VA Police radio. 21. What item number on the price/cost schedule refers to 7(B) in section 2.7 page 34? Price/Cost schedule has been amended to properly identify item 7A as LIN 0007AA and 7B as LIN 0007AB. 22. We are an SDVOSB (in VIP VETBIZ) company with a Security Agency license in a different state. We are trying to determine if we are eligible to bid using a Prime/Sub relationship or a JV. Subcontracting Limitation Applies to this requirement. Subcontracting and Joint Ventures are permitted to the extend allowed by law as per 38 CFR Section 74.1, 13 CFR Part 125 and all applicable regulations, you may seek further guidance from Small Business Administration (SBA) 23. If we are the prime holding the SDVOSB status and we have a subcontractor in PR and USVI, are we be able to utilize the subcontractors security agency licenses for PR and USVI for our 51% of the employees? Subcontracting Limitation Applies to this requirement. If sub-contracting, Subcontractor state issued agency license may be used. However, each employee assigned to the contract needs to comply with individual license/credentials requirements. See PWS Section 6 Guard Qualifications. 24. If we are the prime and they are the subcontractors who are not SDVOSB, would they be able to use our SDVOSB status? Subcontracting Limitation Applies to this requirement. See 13 CFR Section 125.6, 1001 of Title 18, 52.219-14 and 852.219-74. Also, you may seek additional assistance and guidance from SBA. 25. If we perform a Joint Venture will my SDVOSB status cover the JV partners if their companies are not SDVOSB? And would their Security Agency licenses for PR and USVI cover my employees who would be required to perform 51% of the work? For Joint Venture detailed criteria and information see 38 CFR Section 74.1, 13 CFR part 125 among other applicable regulations or seek further guidance from SBA office. 26. We are a non-certified minority owned small business based out of another state, and we would like to know if we are qualified to submit a bid by the designated deadline, is this true? This solicitation is set-aside based on an order of priority as established in 38 U.S.C. 8127. TIERED EVALUATIONS INCLUDING SMALL BUSINESS CONCERNS: This solicitation is being issued as a tiered evaluation for SDVOSB concerns, or in the alternative, a tiered evaluation for VOSB concerns, or in the alternative, a set-aside for other small business concerns.
