- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. The solicitation number is INL-RFI-Police-sUAS-Training-n-Standard-Develop and is issued as a Request for Quote (RFQ), unless otherwise indicated herein. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-06. The associated North American Industrial Classification System (NAICS) code for this procurement is 541330 with a small business size standard of $15.00M. This requirement is unrestricted and only qualified sellers may submit bids. FOB Destination shall be Rohrmoser, Pavas, null null The U.S. Embassy San Jose, Costa Rica requires the following items, Brand Name or Equal, to the following: LI 001: � Product Service Code: 1550 - UNMANNED AIRCRAFT � NAICS Code: 541330 - Engineering Services � NAICS Code: 334511 - Search, Detection, Navigation, Guidance, Aeronautical, and Nautical System and Instrument Manufacturing, 1, RFI SERVICE; LI 002: NOTICE: In accordance with Federal Acquisition Regulation Part 10.002(b)(2)(i) and FAR 12.202(a), the Bureau of International Narcotics and Law Enforcement Affairs (INL) office in US Embassy San Jose, Costa Rica, is conducting market research and requesting information to assess whether commercial items or non-developmental items are available to meet the Government�s needs or could be modified to meet the Government�s needs. Accordingly, this Market Research and Request for Information (MR&RFI) is issued solely for information and planning purposes; it does not constitute a Request for Proposal/Quotation (RFP/RFQ) or a promise to issue an RFP/RFQ. This MR&RFI also does not commit INL to contract for any supply or service. At this time, INL is not seeking proposals., 1, RFI SERVICE; LI 003: Responders are advised that the INL will not pay any cost incurred in response to this MR&RFI. All costs associated with responding to this MR&RFI will be solely at the interested party�s expense. Not responding to this MR&RFI does not preclude participation in any future RFP/RFQ, if any is issued at a later date. The information provided in this MR&RFI is subject to change and is not binding on with INL., 1, RFI SERVICE; LI 004: 1. Background. The United States Department of State (DoS), Bureau for International Narcotics and Law Enforcement Affairs (INL), provides equipment and training to build partner nation security force capacity to counter drug trafficking and other illicit activities. INL�s 5-Year sUAS Strategic Plan seeks to increase the capabilities of Costa Rica�s Ministry of Public Security (MSP) small Unmanned Aircraft System (sUAS) fleet through sUAS procurement, operator training and certification, standards development, and fleet/operator management tools. The MSP expects to receive delivery of an initial tranche of eight Skydio X2D quadcopters in fourth quarter 2021, with a possible growth up to 40 or more multi-copter systems., 1, RFI SERVICE; LI 005: 2. Purpose and Objectives. a. INL seeks to develop a comprehensive training, certification, standardization, and management system for the MSP sUAS program. INL plans to follow a modular approach to building the sUAS training, standardization, and management system through a series of independent contracts. b. Costa Rica does not have any military forces, the Ministry of Public Security is a national-level law enforcement organization with National Police, Border Police, Investigative Branch, Air Service, and Coast Guard. The sUAS training and standardization system should NOT be based on a military model; but rather, incorporate best practices from sUAS operations in industry and community policing (see �Community Policing and Unmanned Aircraft Systems� in SOW Appendix A). c. Costa Rica�s Civil Aviation Authority regulations (see SOW Appendix A) do not require MSP sUAS to comply with civil licensing procedures. Likewise, MSP sUAS are permitted to conduct operations outside of Part 107-equivalent without a Certificate of Authority (COA). However, INL accepts the civil license and COA as best practices; therefore, the sUAS training and standardization system should follow this model. d. All deliverables should maximize the use of commercial off the shelf (COTS) material to minimize development costs. e. All deliverables shall be in the Spanish language., 1, RFI SERVICE; LI 006: 3. Requirements and References: This RFI contains six (6) separate and distinct Statements of Work (SOW). Each SOW is briefly summarized below, please refer to this RFI�s attachments for complete information., 1, RFI SERVICE; LI 007: a. SOW#1 � Pilot Training and Certification System. Develop a hierarchical structure of sUAS pilot/operator certifications to support current and future (5-year) MSP sUAS operations. These should include certifications such as: Basic sUAS Pilot Certification (Part 107 equivalent for Costa Rica), Multi-Copter Basic Police Operations/Tactical Training (following Part 107/Visual Line of Sight (VLOS) rules), Fixed Wing Basic Police Operations/Tactical Training, Intermediate Tactical Training (Beyond VLOS, Extended VLOS, Night Operations, Operations over Congested Areas, other operations that would require Certificate of Authority (COA)/Part 107 waiver), Domain Specific Advanced Tactical Training (Land Patrol, Riverine, Maritime, Urban), Instructor Pilot, and Imagery Management/Chain of Custody., 1, RFI SERVICE; LI 008: b. SOW#2 � Standard Operating Procedures (SOP) Development. Develop a comprehensive sUAS SOP for the Costa Rican MSP based on best practices identified in �Community Policing and Unmanned Aircraft Systems� report by National Police Foundation (See SOW Appendix A). The SOP shall particularly address a Safety Management System (SMS). All deliverables should maximize the use of pre-existing or commercial off the shelf (COTS) material to minimize development costs. Customize the SOP to meet Costa Rica MSP requirements. Provide a subject matter expert (SME) to travel to Costa Rica to assess partner nation SOP requirements through interviews with officials from INL, MSP, SVA, Border Police, Coast Guard, and the National Police Academy., 1, RFI SERVICE; LI 009: c. SOW#3 � Local Part 107 Equivalent Course Development SME. Provide a Subject Matter Expert to assist the MSP in development of a Part 107-equivalent training course and certification process. Course development should maximize the use of commercial off the shelf (COTS) material to minimize development costs. The course should consist of classroom learning and practical application. The course will culminate in an operational evaluation, which will result in the award of a certificate. Deliver Spanish-language course materials such as multi-media presentations, student handouts/study-guides, reference documents, and student examinations. These materials will become property of the USG and may be turned over to the MSP for use in developing their organic course. All materials will be delivered in electronic format. The Costa Rica DGAC has other requirements such as a doctor�s examination before awarding a Part 107-equivalent sUAS operator�s license. The SME will assist in developing written procedures to meet any additional requirements beyond the classroom instruction. The SME will also assist the sUAS COE in coordinating with the DGAC in developing the course and certification process., 1, RFI SERVICE; LI 010: d. SOW#4 � Basic Police Operations Training. Develop a Multi-Copter Basic Police Operations/Tactical Training course that covers the full spectrum of police and border patrol tactics, which can be accomplished under Part 107 Visual Line of Sight (VLOS) rules (course should NOT include any tactics that would require a Part 107 Certificate of Authority). Course development should maximize the use of commercial off the shelf (COTS) material to minimize development costs., 1, RFI SERVICE; LI 011: e. SOW#5 � Intermediate (BLOS) Police Operations Training. Develop a Multi-Copter Basic Police Operations/Tactical Training course that covers the full spectrum of police and border patrol tactics, beyond those normally accomplished under Part 107 Visual Line of Sight (VLOS) rules. Tactics should include, but not be limited to: Target Area Surveillance. Provide sUAS surveillance of identified areas, building, developing pattern of life for location, identification and classification of people and associated buildings or structures; Route reconnaissance. Route planning to include identifying hazards, a pattern of life, and threats to force by employing skills taught to do route analysis and mission route selection for force ingress to a designated location, force pre-staging to a designated location, and force egress from a designated location; Force Protection. UAS operators will be provided skills to monitor buildings, people, and vehicles to minimize risk to force at the operation's designated location; Mobile Target Tracking & Surveillance. Provide skills to acquire and follow persons or vehicles limited to speeds of sUAS provided; Other common police/border partrol sUAS tactics defined by best practices in US local, state, and national law enforcement organizations. Course development shall maximize the use of commercial off the shelf (COTS) material to minimize development costs., 1, RFI SERVICE; LI 012: f. SOW#6 � Fleet and Operator Management System. Provide a sUAS Fleet and Operator Management System to support the Costa Rica MSP�s sUAS program. Maximize the use of pre-existing or commercial off the shelf (COTS) material to minimize development costs. Provide capabilities to manage pilot/operator data such as: training, certification, qualification, currency, and experience (flight hours). Provide capabilities to track equipment data such as: usage, location, maintenance/mission readiness status, parts inventory, reliability statistics, and component mean time between failure. Provide capability to support all reporting requirements found in 2 FAM 817 (See Appendix A). If required, provide a subject matter expert (SME) to travel to Costa Rica to assess partner nation requirements through interviews with officials from INL, MSP, SVA, Border Police, Coast Guard, and the National Police Academy. Provide minor customization for MSP usage at minimal cost. g. All references are annotated in the appendix to each SOW., 1, RFI SERVICE; LI 013: 4. Responding to this MR&RFI: a. Suppliers able to satisfy the requirements in paragraph 3 are invited to submit information describing their training and standardization approach. Suppliers are invited to respond to any or all of the proposed SOWs; however, PLEASE RESPOND TO EACH SOW INDIVIDUALLY. INL also seeks feedback on the proposed SOWs, particularly regarding the scope and period of performance statements. Suppliers should limit their response to a maximum of 10 pages per SOW and include an additional cover page containing the following information: 1) SOW Title 2) Point of Contact (POC) 3) POC Title 4) Company Name 5) Location 6) Mailing address 7) Phone number 8) Email address 9) Website, 1, RFI SERVICE; LI 014: b. All company proprietary information, performance capabilities, and/or future modification(s) should be clearly identified and marked. By submitting per this MR&RFI, the submitter understands and consents to INL, the assessment team, and INL support contractors having access to the submissions. c. Components of the requested equipment, to include memory, must be manufacturer-approved and may not be compatible, remanufactured, or refurbished equipment. All items must be covered by manufacturer�s warranty and procured through a manufacturer approved distribution channel. Sellers must be able to document their ability to provide items through manufacturer approved distribution channels upon request. The Seller confirms to have sourced all products submitted in this Bid from manufacturer-approved channels for Federal sales, in accordance with all applicable laws and manufacturer�s current applicable policies at the time of purchase. Seller must be able to support both the product sale and product pricing, in accordance with applicable manufacturer certification / specialization requirements. If software is provided or included, Seller shall, upon request, provide Buyer with a copy of the End User License Agreement. The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it �does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument� in the provision at 52.204-26, Covered Telecommunications Equipment or Services�Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items. (a) Definitions. As used in this provision� Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment. (b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to� (i)Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or (ii)Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles. (2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to� (i)Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or (ii)Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles. (c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for �covered telecommunications equipment or services�. (d) Representation. The Offeror represents that� (1)It ? will, ? will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds �will� in paragraph (d)(1) of this section; and (2)After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that� It ? does, ? does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds �does� in paragraph (d)(2) of this section. (e) Disclosures. (1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded �will� in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer: (i)For covered equipment� (A)The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known); (B)A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and (C)Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision. (ii)For covered services� (A)If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or (B)If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision. (2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded �does� in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer: (i)For covered equipment� (A)The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known); (B)A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and (C)Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision. (ii)For covered services� (A)If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or (B)If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision. (End of provision) (a) Definitions. As used in this clause� Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet). Covered foreign country means The People�s Republic of China. Covered telecommunications equipment or services means� (1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities); (2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities); (3) Telecommunications or video surveillance services provided by such entities or using such equipment; or (4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country. Critical technology means� (1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations; (2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled- (i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or (ii) For reasons relating to regional stability or surreptitious listening; (3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities); (4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material); (5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or (6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817). Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources. Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit. Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high. Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service. (b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. (2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. c) Exceptions. This clause does not prohibit contractors from providing� (1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or (2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles. (d) Reporting requirement. (1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures ...
