- SOURCES SOUGHT SYNOPSIS The Department of Veterans Affairs, Network Contracting Office 8 (NCO 8) is issuing this sources sought synopsis as a means of conducting market research to identify parties having an interest in and the resources to provide Supervisory Human Resource Training to improve the skill-sets for Title 5, Hybrid Title 38, and Title 38 supervisors. Our requirement involves training of 20 participants per session to accommodate 100 Human Resources employees during FY 21. Due to the rules and regulations that apply to the Federal Government, and even more unique regulations that apply specifically to the Department of Veterans Affairs, it is critical these services be provided by a contractor with prior VHA experience presenting Human Resources training. Scope: The contractor shall be responsible for providing the following: 1. A program focusing on the new and experienced Supervisor by providing Department of Veterans Affairs (VA) specific competencies. The program will be repeated over two consecutive weeks to allow for five (5) sessions, each for a new audience. The programs must include professionally printed workbooks for each participant that include VA-specific case studies, references to the Code of Regulations (CFR) for various actions, a section for power point slides, and sample letters for counseling, and progressively addressing misconduct. In presenting case studies and key topics, the Contractor must also review landmark Merit Systems Protection Board (MSPB) and Federal Circuit Court rulings, as well as the Office of Special Counsel s coverage of Prohibited Personnel Practices. At the close of each session participants will evaluate the program through an assessment tool provided by the Contractor. The overall assessments will be summarized and provided to Leadership for tracking the Return on Investment. 2. Key objectives for this this training: Obtain knowledge of essential VA human resources management rules, regulations and techniques vital to a supervisor s successful job performance. Describe the difference between Performance and Conduct, and identify the regulatory processes for improvement as they apply to VA. Effectively manage challenging VA employee behavior by acting promptly and documenting all issues of poor performance and inappropriate conduct. Fully understand VA Labor/Management Relations role that will reduce the number of employment-related disputes and improve working conditions between labor and management. 3. At a minimum the following issues will be addressed in the training: Merit System Principles Prohibited Personnel Actions Appointment Procedures Privacy and Mission Impact Probation Distinguishing Conduct from Performance Counseling Leave Administration Absenteeism On and Off the Job Injuries Reasonable Accommodation Light Duty Management Medical Disqualification Addressing Bad Attitudes Fact-finding Investigations Documenting Discipline VA s Accountability and Whistleblower Protection Act Performance Improvement under VA Handbook 5013 Correcting Employee Misconduct under VA Handbook 5021 VA Table of Offenses and Penalties Preponderance versus Substantial Evidence Examples of Defensible Documentation Ethical Conduct for Supervisors Management Rights with Labor Organizations Unfair Labor Practices Weingarten and Investigative Meetings Off Duty Misconduct Intoxication in the Workplace Appropriate Use of Last Chance Agreements Handling Threatening Behavior The Crime Provision and Indefinite Suspensions The results of this market research will contribute to determining the method of procurement. The applicable North American Industry Classification System (NAICS) code assigned to this requirement is 61170 Educational Support Services. The size standard is $16,500,000.00.
