Description
Pursuant to Federal Acquisition Regulation (FAR) subpart 13.106-1(b), Soliciting from a single source the U.S. Nuclear Regulatory Commission (NRC), Office of the Inspector General (OIG), intends to issue a sole source purchase order to Kator, Parks, Weisser, and Harris, LLC 1200 18th St. NW, Suite 1000, Washington, DC 20036 under the authority of Federal Acquisition Regulation subpart 13.106-1(b)(1)(i).� The NRC proposes to enter into a sole source arrangement with Kator, Parks, Weisser, and Harris, LLC for expert, high level legal services, to include counsel, advice and representation for the evaluation, assessment, negotiation, and litigation of filed and potential discrimination/misconduct/fitness for duty cases within the NRC OIG. �Since FY2012, Kator, Parks, Weisser, and Harris, LLC has been successfully providing the NRC with the expert legal services required for nearly a decade under the current contract NRC� HQ-30-17-C-0001 and the previous contract. �As such, the firm and its personnel have extensive experience and qualifications to meet NRC�s needs for expert legal advice required by the NRC, which �is time sensitive in nature, with strict deadlines generally set by outside adjudicatory bodies. �The firm has the prerequisite knowledge, experience and understanding of general background related information to the requirements and functioning of the NRC OIG, and has the requisite background and specifics of all ongoing (emphasis) legal matters, which ensures the NRC meets timeliness and quality requirements. �The incumbent contractor�s long-standing experience both with the NRC OIG and with relevant current legal topics will drastically reduce if not obviate the need for specific and background information, including education and knowledge transfer, leading to further time and cost efficiencies. The Period of Performance shall be a Base Period from December 1, 2021 through November 30, 2022 and four one-year Option Periods. �The total estimated value of this purchase order is approximately $100,000 - $125,000, inclusive of the Base and all Option Periods.� The applicable North American Industry Classification System (NAICS) code for this acquisition is 541110 �Office of Lawyers� and size standard is $12 million. The Government intends to solicit and negotiate directly with the Kator, Parks, Weisser, and Harris, LLC, and no solicitation will be issued. �This notice of intent is not a request for competitive proposals or quotations; however, if any interested party believes they can meet the above requirements, it may submit a statement of capabilities. �The statement of capabilities must be submitted in writing and must contain material in sufficient detail to allow the government to determine if the party can perform the requirements. �Additionally, in order to perform work for the NRC, potential sources must be free of conflict of interest (COI). � For information on the NRC COI regulations, visit NRC Acquisition Regulation Subpart 2009.5 (http://www.nrc.gov/about-nrc/contracting/48cfr-ch20.html). �A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government. �All interested parties must express their interest and capabilities in writing via email to �Heriberto.Colon@nrc.gov with a copy to Jerry.Purcell@nrc.gov. �No faxed documents will be accepted. �Statement of capabilities are due by 08/16/2021 at 8:00 AM ED.� �
