- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with addtional information included in this notice.� This announcement consititues the only solicitation; quotes (offers) are being requested and a written solicitatation will not be issued.� Solicitation number 6923G521QRamp is issued as a request for quotation.� The applicable NAICS code is 237990 and the size standard is $39.5 million dollars.� This a total small business set-aside procurement.�� The Great Lakes St. Lawrence Seaway Development Corporation (GLS or Corporation) plans to improve the existing boat launch facility at its 251 Fregoe Road, Massena, New York Maintenance Facility/Marine Base by installing a concrete boat launch ramp.� This work consists of furnishing all plant, labor, equipment and materials and performing all work to install a concrete boat launch ramp in the water. The project requires US Army Corps of Engineers (USACE) and New York State Department of Environmental Conservation (NYSDEC) permits, which will be provided by the Corporation.� The work shall be performed in accordance with this work statement, contract drawings, all applicable Federal, State, and local regulations, and the requirements of the project permits.� *WORK STATEMENT AND REFERENCE DRAWINGS Work Statement and Drawings are furnished as attachments. *CONTRACT AWARD (1) The GLS��intends to award a firm-fixed-price contract resulting from this solicitation to the responsible offeror(s) whose quote(s) represents the best value after evaluation in accordance with the factors in the solicitation. (2) The GLS may reject any or all proposals if such action is in the GLS'� interest. (3) The GLS may waive informalities and minor irregularities in proposals received. (4) The GLS�intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror�s initial quote should contain the offeror�s best terms from a cost or price and technical standpoint. The GLS�reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. (5) Exchanges with offerors after receipt of a quote do not constitute a rejection or counteroffer by the GLS. (6) The GLS�may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the GLS. (7) A written �award or acceptance of proposal mailed or otherwise furnished to the successful offeror within the time specified in the proposal shall result in a binding contract without further action by either party. A contract will be awarded only if the price is within available funding appropriations and relates to the GLS��concept of the project. *SITE VISIT Site visits will be held on August 18, 2021�at 1:00 PM local time. It is strongly recommended that those interested in submitting a quote arrange for a site visit to become familiar with the GLS facilities. Arrangements must be made through the Offices of Engineering and Maintenance at (315) 764-3253�at least three business days in advance in order to make preparations for access to GLS�property. �Any expenses involved in a site visit shall be borne by the attendees *CLAUSES AND PROVISIONS This procurement is subject to Davis Bacon wage rates.� The Wage Determination are provided as an attachment.�� This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The Contractor indemnifies and holds harmless the Corporation, its agents, servants, employees or officers against all suits, actions, claims, costs or demands, (including, without limitation, suits, actions, claims, costs or demands resulting from death, personal injury, and property damage) which the Corporation, its agents, servants, employees or officers may be subject or put by reason of damage or injury (including death) to the property or person of any one other than the Corporation, its agents, servants, employees, or officers arising or resulting in whole or in part from the fault, negligence, wrongful act or wrongful omission of the Contractor, or any subcontractor, his or their servants, agents or employees.� Such indemnity shall include, without limitation, suits, actions, claims, costs or demands of any kind whatsoever, resulting from death, personal injury or property damage occurring during the period of performance and with respect to any such suits, actions, claims, costs, or demands resulting from death, personal injury or property damage occurring after the expiration of such period, the rights and liabilities of the Corporation shall be as determined by other provisions of this Agreement or by law;� Provided, however, that such indemnity shall apply to death occurring after such period which results from any personal injury received during the period covered by Contractor indemnity as provided here.
