COMPETITIVE COMBINED SYNOPSIS / SOLICITATION Title: BioTek MultiFlo FX, Automated Multi-Mode Reagent Dispenser or Equal (COVID-19 action) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is 75N95021Q00151 and the solicitation is issued as a request for quotation (RFQ). This acquisition is for a commercial item or service and is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures and FAR Part 12�Acquisition of Commercial Items and is not expected to exceed the simplified acquisition threshold. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-06 dated July 12, 2021 The associated NAICS code is 334516 Analytical Laboratory Instrument Manufacturing and the small business size standard is 1,000 employees. The solicitation is unrestricted and open to all offerors. Background and Requirement: This effort is in response to the Covid-19 pandemic and the effort to continue research on this virus. The National Institutes of Health (NIH) is the nation�s leading medical research agency and the primary Federal agency whose mission is to seek fundamental knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life, and reduce illness and disability, conducting, supporting and making medical discoveries that improve people�s health and save lives. The National Center for Advancing Translational Sciences (NCATS) is a part of the National Institutes of Health (NIH), whose mission it is to catalyze the generation of innovative methods and technologies that will enhance the development, testing and implementation of diagnostics and therapeutics across a wide range of human diseases and conditions. The Therapeutic Development Branch (TBD) within the National Center for Advancing Translational Sciences (NCATS) Division of Preclinical Innovation (DPI) requires an automated incubator and reagent dispenser along with a microplate stacker for integration of equipment in order to meet the needs of the Antiviral Program for Pandemics Project. A critical aspect of this project is developing assays for predicative toxicity of antisense oligonucleotides (ASOs), which will be used as the next generation of antivirals as well as treatments for rare diseases.� Predictive neurotoxicity will be assessed using neuronal spheroid assays that has been integrated with automated equipment to streamline the process for high throughput screening. Calcium imaging assays using neuronal spheroids, measure cellular activity and resulting changes due to compound treatment can be used as readout of neurotoxicity. While these assays can be performed in high content microplates, significantly increasing the number of compounds able to be screened at once, manual requirements of maintaining these plates are time consuming and restricts the size of the experiment. In order to overcome these limitations and increase the throughput of this assay, the BioTek BioSpa 8 automated incubator and MultiFlo FX reagent dispenser, along with the BioStack 4 microplate stacker, will streamline cell culture maintenance requirements of the spheroid, allowing TBD scientists to use more plates at once, increasing the workflow to allow high throughput screening of ASOs. The BioTek MultiFlo FX uses peristaltic pumps to gently add and remove media from the wells of microplates, eliminating the need for scientist to manually change the media every one to two days. The MultiFlo FX�s use of a peristaltic pumps is of critical importance as it prevents the disruption of the spheroids, a common problem when using 3D cellular models. To further decrease the manual requirements of cell culture maintenance, integration with the BioSpa 8 automated incubator will automate this process. The automated incubator also permits electronic monitoring and documentation of temperature, gas (CO2/O2), and humidity levels throughout the experiment. Addition of the BioStack 4 microplate stacker will permit complete integration between this equipment. An important feature of the BioStack 4 is the ability to de-lidding and re-lidding the microplates when transferring between the MultiFlo and automated incubator. As the scientist will no longer be required to manually transfer plates to the MultiFlo, this automated setup and workflow will significantly decrease the time required fto maintain the spheroids, allowing for a complete walk-away workflow. Increasing the work capacity of this assay will allow for high throughput screening of ASOs required for this project.� See Attachment 1 � Purchase Description for complete details and specifications of the requirement including the salient physical, functional, or performance characteristics that �equal� products must meet to that of the BioTek MultiFlo FX system. It is the Government�s intent to issue a Firm Fixed Price Purchase Order. The Contractor shall delivery the instruments to the following NCATS facility between of hours of 9:00 AM and 4:00 PM Eastern Standard Time, Monday through Friday (except federal holidays): National Center for Advancing Translational Sciences (NCATS) 9800 Medical Center Drive Bldg. B/Rm. [To be specified at time of award] Rockville, MD 20850 Delivery is 30 days after receipt of order (ARO). Delivery must be Freight on Board (FOB) Destination, including inside delivery to the room number specified. All required items shall be packaged, marked and shipped in accordance with Government specifications and shall include the purchase order number and Contractor name. An Original Equipment Manufacturer (OEM) certified service technician must setup and install all equipment within two (2) weeks of installation. All required items shall be packaged, marked and shipped in accordance with Government specifications. At a minimum, they shall be marked with the contract number and Contractor name. (vii) ���� The provision at FAR clause 52.212-1, Instructions to Offerors � Commercial Items, applies to this acquisition. (viii)���� The provision at FAR clause 52.212-2, Evaluation � Commercial Items, applies to this acquisition.� The Government will award a purchase order resulting from this solicitation on the basis of lowest price technically acceptable. Technical acceptability will be evaluated based upon the following: The Offeror must include all brand name or equal equipment detailed in the project requirements in its quotation. Or Equal equipment must meet or exceed each salient characteristic in the table below. (See attachment) Salient characteristics: The salient physical, functional, or performance characteristics that �equal� products must meet are as follows (See Attahcment): In addition to completing the table above, the respondents must provide brochures and/or published technical specifications that provide evidence of or equal equipment�s ability to meet the specifications in the table above.� (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer�s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to� ��������������� (i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or ��������������� (ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles. ���������� (2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to� ��������������� (i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or ��������������� (ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles. ����� (c) Procedures. (End of provision) FAR 52.225-20 Prohibition on Conducting Restricted Business Operations in Sudan-Certification (Aug 2009) ����� (a) Definitions. As used in this provision- ����� Business operations means engaging in commerce in any form, including by acquiring, developing, maintaining, owning, selling, possessing, leasing, or operating equipment, facilities, personnel, products, services, personal property, real property, or any other apparatus of business or commerce. ����� Marginalized populations of Sudan means- ���������� (1) Adversely affected groups in regions authorized to receive assistance under section 8(c) of the Darfur Peace and Accountability Act (Pub. L. 109-344) ( 50 U.S.C. 1701 note); and ���������� (2) Marginalized areas in Northern Sudan described in section 4(9) of such Act. ���������� Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate- ��������������� (1) Are conducted under contract directly and exclusively with the regional government of southern Sudan; ��������������� (2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization; ��������������� (3) Consist of providing goods or services to marginalized populations of Sudan; ��������������� (4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization; ��� ������������(5) Consist of providing goods or services that are used only to promote health or education; or ��������������� (6) Have been voluntarily suspended. ����� (b) Certification. By submission of its offer, the offeror certifies that the offeror does not conduct any restricted business operations in Sudan. (End of provision) HHSAR 352.239-73 Electronic and Information Technology Accessibility Notice (December 18, 2015) (a) Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d), as amended by the Workforce Investment Act of 1998 and the Architectural and Transportation Barriers Compliance Board Electronic and Information (EIT) Accessibility Standards (36 CFR part 1194), require that when Federal agencies develop, procure, maintain, or use electronic and information technology, Federal employees with disabilities have access to and use of information and data that is comparable to the access and use by Federal employees who are not individuals with disabilities, unless an undue burden would be imposed on the agency. In order to facilitate the Government�s determination whether proposed EIT supplies meet applicable Section 508 accessibility standards, offerors must submit an HHS Section 508 Product Assessment Template, in accordance with its completion instructions. The purpose of the template is to assist HHS acquisition and program officials in determining whether proposed EIT supplies conform to applicable Section 508 accessibility standards. The template allows offerors or developers to self-evaluate their supplies and document�in detail�whether they conform to a specific Section 508 accessibility standard, and any underway remediation efforts addressing conformance issues. Instructions for preparing the HHS Section 508 Evaluation Template are available under Section 508 policy on the HHS website http://www.hhs.gov/web/508. In order to facilitate the Government�s determination whether proposed EIT services meet applicable Section 508 accessibility standards, offerors must provide enough information to assist the Government in determining that the EIT services conform to Section 508 accessibility standards, including any underway remediation efforts addressing conformance issues. (d) Respondents to this solicitation must identify any exception to Section 508 requirements. If a offeror claims its supplies or services meet applicable Section 508 accessibility standards, and it is later determined by the Government, i.e., after award of a contract or order, that supplies or services delivered do not conform to the described accessibility standards, remediation of the supplies or services to the level of conformance specified in the contract will be the responsibility of the Contractor at its expense.
