- This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) subpart 5.2 - Synopses of Proposed Contract Actions. The U.S. Army Corps of Engineers (USACE), Portland District intends to award a sole source, Firm Fixed Price contract for John Day Cultural/Tribal Monitoring as noted below.��� The U.S. Army Corps of Engineers, Portland District (Corps) and the Bonneville Power Administration (BPA) (the Agencies) are jointly responsible for compliance with Section 106 of the National Historic Preservation Act (NHPA) under the terms of the 2009 System-wide Programmatic Agreement (SWPA) for management of historic properties affected by operation and maintenance of the Federal Columbia River Power System (FCRPS).� Bonneville, The Dalles and The John Day Projects are within the FCRPS. The FCRPS Cultural Resource Program works closely with interested and affected tribes, State Historic Preservation Offices, and other agencies for cultural resource management in compliance with Section 106 of the NHPA. The John Day River Fence construction is a Section 106 of NHPA mitigation project developed in the Wana Pa Koot Koot working group. Work outlined in this contract with the Confederated Tribes of the Warm Springs Reservation of Oregon (CTWSRO) is for the monitoring a construction project in the John Day Project. A tribal monitor will be present for the construction of a fence along the John Day River, near a geological feature known as the Narrows. The construction is anticipated to take five (5) weeks. An optional task for one additional week of construction is included in this performance work statement. The statutory authority for this non-competitive acquisition pursuant to 10 U.S.C. � 2304(c)(1 ), as implemented by Federal Acquisition Regulation (FAR) 6.302-1 and DFARS 206.302-1, only one responsible source and no other type of services will satisfy agency requirements. The NAICS code is 541690 � Other Scientific and Technical Consulting Services.� The size standard as defined by the U.S. Small Business Administration is $16.5M. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOALS OR QUOTATIONS. Interested vendors must show clear and convincing evidence that competition of this requirement would be advantageous to the Government by submitting a capability statement demonstrating ability to provide support, maintenance and training listed above. If no affirmative written response is received by 2:00pm PST on 03 September 2021, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
