- The following is a Sources Sought/Request for Information notice. This posted notice is not a Pre- Solicitation or Solicitation document. The government is not currently soliciting bids, quotes or proposals at this time; however, reserves the right to do so at a later date. The Wilkes-Barre VA Medical Center, 1111 East End Blvd, Wilkes-Barre, PA 18711-0030 is seeking sources for a potential Brand Name Only requirement for the following: Statement of Need for: BRAND NAME Echocardiogram X Beds Introduction The Department of Veteran Affairs Medical Center, 1111 East End BLVD, Wilkes-Barre, PA 18711 Medical Service, Cardiology has a BRAND NAME requirement to purchase two ECHOCARDIGRAM X BEDS. Justification: The Wilkes-Barre VA Medical Center has been approved to expand cardiology services including echocardiogram exams into the Allentown AOPC. For this reason, we are requesting the acquisition of two EchoBed X echocardiogram beds, one additional for Wilkes-Barre and one for AOPC service expansion. In order to maintain consistency, we are requesting to acquire the model of echocardiogram beds that are currently in use in the cardiology department (EchoBed X), we have found these beds to have the best features and provide improved ergonomics foe our sonographers. Gray Market Prevention Language (a) Gray market items are Original Equipment Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable. (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.
