- This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Subpart 12.6, using Simplified Acquisition Procedures under FAR part 13 as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation SHALL be posted on SAM at sam.gov. The solicitation number for this is N0018921Q0508 and will be issued as an RFQ. This solicitation document incorporates provisions and clauses in effect through FAC 2021-06 (effective 07-12-2021) and DFARS Publication Notice (Effective 08-30-2021). It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The NAICS code is 519120 and the Small Business Standard is 16.5 (millions of dollars). The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate a Firm Fixed Price contract with only one source, Copyright Clearance Center, Inc., under the authority of FAR 13.106-1(b). Interested persons may identify their interest and capability to respond to the requirement or submit quotes. This notice of intent is not a request for competitive quotes. However, all quotations received by the closing response date will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The Small Business Office concurs with this determination - please see attachments for a redacted Sole Source Justification. Responsibility and inspection: unless otherwise specified in the order, the supplier is responsible for the performance of all inspection requirements and quality control. Navy Leadership and Ethics Center (NLEC) requires an annual comprehensive license that will allow faculty, researchers, staff, and students to reuse/share copyrighted content in multiple courses for educational purposes, while respecting intellectual property rights of the original developers of the material to ensure DON copyright compliance per SECNAVINST 5870.9 (Use of copyrighted works in DON). Performance Location: Navy Leadership and Ethics Center (NLEC) 440 Meyerkord Ave. Newport, Rhode Island 02841-1207 Required Period of Performance: Base: 30 September 2021 to 29 September 2022 Option 1: 30 September 2022 to 29 September 2023 Option 2: 30 September 2023 to 29 September 2024 Option 3: 30 September 2024 to 29 September 2025 Option 4: 30 September 2025 to 29 September 2026 6 month extension: 30 September 2026 - 29 March 2027 Method of Payment: Wide Area Work Flow (WAWF). Provision 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. Provision 52.212-2, Evaluation-Commercial Items, applies to this acquisition. The Government will issue a sole-source award with prices proven fair and reasonable in accordance with the procedures at FAR 13.106-3(a)(2).
