- Special Notice - Sole Source NOTIFICATION ONLY, DO NOT PROVIDE QUOTE BUREAU OF INDIAN AFFAIRS, EASTERN REGIONAL OFFICE, CHEROKEE AGENCY PR NUMBER: 0040547890 POSING DATE: 9/7/2021 SUBJECT: Sole Source Notification for Fire Fighting Equipment This announcement is the only notice of award for 140A1521P0011. This is not a request for quotations. A determination not to compete is solely within the discretion of the Government. Under simplified acquisition procedures, Bureau of Indian Affairs, Eastern Regional Office, issued a sole source, firm fixed-price purchase order to: Company: Chemical Containers, Inc. 413 ABC Rd. Lake Wales, FL 33859-6849 Amount: $22,328.00 Date: 9/7/2021 NAICS: 333318 Authority: Federal Acquisition Regulation (FAR) 13.106-1(b)(i) unusual and compelling urgency Determination for sole source is based on the following: � Pursuant to 48 CFR Part 1480.401, Indian Affairs must use the negotiation authority of the Buy-Indian Act, 25 U.S.C. 47, to give preference to Indian Economic Enterprises (IEE) whenever the use of that authority is authorized and practicable. � Background market research: o Over fiscal year 2021 Bureau of Indian Affairs, Eastern Regional Office has solicited twice for similar skid pump units. The first solicitation event (140A1521Q0001) produced no Indian Economic Enterprise or Indian Small Business Economic Enterprise (IEE/ISBEE) responses that met specifications required at a reasonable price. Under the second solicitation event (140A1521Q0005) only two quotes were received from IEE/ISBEE sources where only one met the requirements at a reasonable price. Unfortunately, due to logistics, at seventy days a performance date has not been obtainable. � The program needs to have the subject equipment to support the emergency wildland fires in California and other parts of the west coast. � The National Interagency Fire Center is holding at preparedness level 5. This level has been held for an extended period and as noted by the Congressional Research Service in their report from 8/6/21that the National Interagency Coordination Center is under a �significant commitment of shared resources� (CSRS document IF10244). � Contractor along with Bureau Fire personnel specifically designed this product to meet NFPA standards and to ensure vehicle factory GVWR requirements were met. � Due to the specific nature of this design and the adherence to NFPA standards and Vehicle Factory requirements this product can be safely be utilized during fuels and emergency Fire operations in a manner that meets or exceeds Agency standards. � Previous items built and installed by this vendor have met stringent operational requirements and have performed at exceptional levels. The vendor has provided necessary upgrades to operational equipment that meet the needs of our emergency first responders. The Fire Department cannot afford any additional time in procuring this equipment from another vendor. � No other vendor exists in the local area that can install (ensuring an engineered fit that meets or exceeds industry, DOT, and Agency standards) and service this type of equipment. � Should this unit(s) not be provided in a timely manner it will greatly reduce the local unit�s response to emergency wildland fire operations and pose a threat to firefighter and public safety. � Selected vendor has the equipment in stock, a proven track record of timely work completion for the Bureau, will provide immediate service, and is a registered small business which is noted in FAR 13.003(b)(1). � As noted for the items listed above this acquisition is considered to fall under FAR 13.106-1(b)(i) due to the urgency of the need and availability of the source.
