Description
Combined Synopsis/Solicitation This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number FA252121QB097 shall be used to reference any written quote provided under this request for quote. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2021-07; Effective 10 September 2021 This is 100% set-aside for Small Business. The North American Industry Classification System (NAICS) code for this project is 611620 with a size standard of $8.0 Million. Brief description: The purpose of this Solicitation is for the purchase of Sports Officials services at Patrick SFB. Sports to include softball, basketball, flag football, volleyball, soccer, cross-country running. The vendor shall provide and or perform in accordance with the attached Statement of Work (SOW). The Contractor shall furnish services as described in general terms below and listed on an approved price list which states the effective period of the prices and expiration period. 1. SERVICES TO BE RENDERED: Non-Personal Services: Contractor shall provide Sports Officials at Patrick SFB, Sports to include softball, basketball, flag football, volleyball, soccer, cross-country running. The vendor shall provide and or perform in accordance with the attached Statement of Work (SOW). 2. EXTENT OF OBLIGATION: The Government is only obligated to the extent of calls actually placed against this BPA (Blanket Purchase Agreement) by authorized personnel. 3. PRICING: Prices quoted to the Government must be as low as or lower than those charged your most favored customer for comparable quantities under similar terms and conditions, in addition to any trade discounts or prompt payment discount. 4. PURCHASE LIMITATION: No individual call shall be placed by the Government or accepted by the Contractor that exceeds $25,000 without the approval of the Contracting Officer. Calls shall generally be made verbally, except in that informal correspondence may be used where determined by the Contracting Officer to be more convenient. 5. NOTICE OF AUTHORIZED CALLERS AND DOLLAR LIMITATIONS: The Contracting Officer will give the Contractor a listing indicating the name, organization, and dollar limitation for those positions that are authorized to place calls. 6. DELIVERY TICKETS: The contractor agrees to furnish one delivery ticket/sales ticket containing the following information for each call made against this agreement to the address shown in paragraph 10: Name of Contractor BPA Number Date of Call Call Number Itemized list of services furnished Quantity, Unit Price, and Extended Price of each item, less applicable discounts Date service was performed 7. PAYMENT: Payment will be made by the Government Commercial Purchase Card under authority FAR 52.232-36 Payment by Third Party 8. CANCELLATION: BPA may be discontinued upon thirty (30) days written notice by the vendor or the government. 9. PERIOD OF PERFORMANCE: 1 Oct 2021-30 Sep 2026 (5 year period) 10. A BPA is a charge account type instrument which will permit selected activities to place orders directly with your firm or representative, using your agency�s established price list. This agreement will establish a procedure for the fulfillment of our anticipated repetitive requirements from your firm. In order for this organization to establish a BPA, we request that you furnish us with a price list. Your price list must have an effective date and an ending date. The Contracting Officer will approve the price list and a copy will be furnished to the using activity. This shows the approved amounts that can be paid to you for services rendered. A list of authorized callers, by position, will be furnished to you from time to time and only those positions listed are authorized to place calls. It is your responsibility to ensure only calls from authorized individuals are accepted. If a BPA is awarded to your firm it will be prepared in accordance with the provisions of the Federal Acquisition Regulation and standard procedures contained therein will apply. *52.209-11 � Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law (Feb 16) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that-- Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government. (End of provision) Pursuant to FAR 12.602 contract award will be made using Simplified Acquisition Procedures in accordance with FAR 13.106. Offeror�s submissions will be evaluated based upon the following: (1) Technical: quote must be rated as technically acceptable to be eligible for award. In order to be deemed technically acceptable, products must conform to the above salient characteristics listed and attached Performance Work Statement (2) Price: Award will be made to the Best Value to the government. Technical acceptability is more important than cost or price. An offeror must be determined to be responsible by the Contracting Officer in order to be eligible for award. Responsibility is described in Federal Acquisition Regulation (FAR) Subpart 9.1, �Responsible Prospective Contractors.� Part of the determination addresses financial capability. Please provide the names, addresses and points of contact for all financial institution organizations utilized to determine if contractor has adequate financial resources to perform the contract or the ability to obtain them to include written authority to contact the provided financial institution. Discussions: The government intends to award a purchase order without discussions with respective vendors/quoters.� The government however, reserves the right to conduct discussions if deemed in its best interest. FAR Clauses Incorporated by Fill Text: 52.219-28 Post-Award Small Business Program Representation (Nov 20) (a) Definitions. As used in this clause� ���� �Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority. ����� Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is �not dominant in its field of operation� when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity. ����� (b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following: ���������� (1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract. ���������� (2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract. ���������� (3) For long-term contracts- ��������������� (i) Within 60 to 120 days prior to the end of the fifth year of the contract; and ��������������� (ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter. ����� (c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract. ����� (d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table-size-standards. ����� (e) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees. ����� (f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraph (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update. ����� (g) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (f) or (h) of this clause. ����� (h) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed: ���������� (1) The Contractor represents that it ? is, ? is not a small business concern under NAICS Code _____ assigned to contract number _____.
