Description
FORCE: VA-21-00050035 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Procurement Acquisition and Logistics Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed action is for a sole source firm-fixed-price (FFP), contract with a two-month reinstatement fee, 10-month Base Period and four 12-month option periods with Grand Telephone Company to continue voice and data line services for Veterans Health Care Services of the Ozarks (VHSO), Jay OK Community Based Outpatient Clinic (CBOC). The proposed source for this action is Grand Telephone Company, 226 S 4th Street, Jay OK 74346. 3. Description of Supplies or Services: The proposed action is to provide voice and data services for the Veterans Administration CBOC located on 1569 N Main Street, Jay, OK 74346 to include a quantity of one Primary Rate Interface (PRI), quantity of one Direct Inward Dialing (DID) blocks of 20, quantity of one FCC-PRI Multi-line, quantity of one FCC-Business Multi-line, quantity of one Business Line, quantity of one ARC-PRI Multi-line, quantity of one ARC-Business Multi-Line, quantity of one Non-Published number, and Miscellaneous Federal State and E911 Surcharges. The period of performance for this effort shall be a 10-month base, with four 12- month options for continued service, if exercised. The total estimate value of the proposed action is $41,388.00 (inclusive of options). 4. Statutory Authority: The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 13.106-1(b)(1) entitled, Soliciting competition. 5. Rationale Supporting Use of Authority Cited Above: The proposed source for this action is Grand Telephone Company, herein referred to as GTC, 226 S 4th Street, Jay OK 74346. Based on market research, as described in section 8 of this justification, it has been determined that only GTC is capable of providing the aforementioned LEC telecommucation voice and data services at 1569 N Main Street, Jay, Oklahoma. GTC is the sole provider of Legacy Time-Division Multiplexing (TDM) services that include POTS, PRI and DID s at this Service Delivery Point (SDP). GTC is the sole provider of both fiber optic and copper cabling to the SDP and they do not resell their services. Any other vendor would need to migrate the Legacy TDM service to an Internet Protocol (IP) environment and the necessary equipment to provide replacement services. GTC also provides the necessary technical staffing to maintain the level of service required by the Federal Communications Commission. To request these services from any vendor other than GTC would require an investment in upgrading the antiquated equipment and an installation timeline of up to 12 months to replace current services. VA requires continuity of services at the SDP because it is currently a fully functioning clinic and cannot experience any stoppage in LEC services as it would be detrimental to the Telecom Services Grand Telephone Company FORCE: VA-21-00050035 Veterans that are served. No other vendor offers Legacy TDM in place to supply the SDP with the circuits necessary to sustain the LEC telecommunications voice and data services. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section 8 of thisjustification. This effort did not yield any other vendors that can provide the services that can meet the Government s requirements. There is no competition anticipated for this acquisition. Additionally, the proposed action will be synopsized on the Federal Business Opportunities (FBO) Page in accordance with FAR 5.201. Any proposals that are received shall be evaluated. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be completed. 8. Market research was done in March 2021, to ascertain if sources other than Grand Telephone Company, can meet the VA s needs. The Government s technical experts utilized the sources from the NLEC-NG program and contacted CenturyLink, AT&T, Allstream, MetTel, Windstream and Granite. The technical experts found that none of the six NLEC-NG sources; CenturyLink, AT&T, Allstream, MetTel, Windstream and Granite could provide both data and voice services for 1569 N Main Street, Jay OK 74346 and only Grand Telephone Company can meet the Government s requirements. Grand Telephone Company currently provides these services. Based on the market research, it was determined that only Grand Telephone Company can meet all of the Government s requirements. As a result, a Justification for An Exception to Fair Opportunity has been completed for this action. 9. Other Facts: N/A Telecom Services Grand Telephone Company FORCE: VA-21-00050035 10.
