This is a combined synopsis/solicitation for commercial items prepared in accordance with the format FAR 12.603 � Streamlined Solicitation for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotes are being requested and a written solicitation will not be issued. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2021-07, dated August 11, 2021. This solicitation is issued as an UNRESTRICTED request for quotation (RFQ). All interested vendors are encouraged to submit a quote. The assigned NAICS code is 811219, Other Electronic and Precision Equipment Repair and Maintenance. The size standard for this NAICS code is $22,000,000. The Product Service Code is J036 Maintenance/Repair/Rebuild of Equipment � Special Industry Machinery. � Description: �The 249th Engineer Battalion (Prime Power) requires calibration services for their Megger US Army Test, Measurement, and Diagnostic Equipment (TMDE) electrical test equipment. The TMDE equipment is located in Fort Belvoir, VA; Fort Bragg, NC; and Schofield Barracks, HI. The resultant award will contain one base year and one option period. Contract Line Items:� This requirement and associated contract line item numbers (CLINs) is provided in the attached Excel Spreadsheet. General Information. The 249th Engineer Battalion (Prime Power) requires calibration services for electrical test equipment that is not supported by the US Army Test, Measurement, and Diagnostic Equipment (TMDE) Activity. Henceforth, within this document, the terms �TMDE� and �Equipment� are synonymous and interchangeable.� The TMDE items are dispersed between Fort Belvoir, Virginia; Fort Bragg, North Carolina; and Schofield Barracks, Hawaii. 2.1. Background. The 249th EN BN (PP) installs, operates, and maintains power production and distribution systems worldwide. In order to support the operation, and maintenance of these systems, electrical test equipment that is not held within the US Army�s inventory is required and must be supported outside of the existing system. 2.2. Definition: Proper terminology is important to understand our requirement. Henceforth, �mobile calibration� or �onsite calibration� is defined as the act of the contractor driving from their location to our location, where they perform calibration and repair services onsite at our location. �Mobile pickup and delivery� is defined as the act of the contractor driving from their location to our location, where they retrieve our items requiring calibration and/or repair, then transport our equipment to their location for calibration and/or repair, then transport our completed equipment back its respective location. 3. Scope. The contractor will also make necessary repairs to equipment as needed.� Repair costs will be charged to the original contract from a separate CLIN specifically meant for repair quotes and costs. 3.2. Calibration Standards: All equipment will be calibrated in accordance with the manufacturer�s specifications, using reference standards whose accuracies are traceable to ISO/IEC 17025 and ANSI/NCSLI Z540-1. 3.3. Documentation: A signed certificate of calibration will be provided for each piece of equipment calibrated, showing the nomenclature, manufacturer, model number, equipment serial number, date calibrated, and date of next calibration. Calibration data will also be provided along with the certificate for each calibrated item, detailing all test readings recorded. 3.3.1. Geographic Flexibility, Onsite Calibration: The contractor must be able to provide onsite calibration service for Fort Belvoir, VA, and Fort Bragg, NC. Onsite calibration service is not required for Schofield Barracks, Hawaii. 3.3.2. Geographic Flexibility, Mobile Pickup and Delivery: As an alternative to Section 3.71.1, or in conjunction with Section 3.71.1, the contractor must be able to drive to our area of operations (Fort Belvoir, VA; Fort Bragg, NC; Schofield Barracks, HI), pick up the equipment to be calibrated and/or repaired, transport the equipment to the contractor�s calibration facility, calibrate and/or repair the equipment, then transport the equipment back to its respective location (in a fully calibrated and/or repaired status). The government is not responsible for supplying additional funding following the award of this contract, concerning internal contractor shipping costs while contractor is in possession of government property. 3.4. Timeline for Calibration: Upon receipt of equipment, the contractor will have 14 calendar days to inspect, inventory, calibrate, and then return equipment to its original owner in their respective geographic location. The 14 calendar day window begins when the contractor signs to for the equipment. The window closes on the date the contractor signs over the calibrated equipment to the original owner. 3.5. No later than 1700 hours EST every Thursday, the contractor provides a status report for all 249th EN BN equipment in the contractor�s possession. This status report will include, per serialized item: date of receipt, current calibration status, expected return date, and pertinent issues. Exact status report format will be discussed during the post-award kick off meeting described in Section 6.2. 3.6. Out of Scope Repairs. If the equipment sent for calibration needs repair beyond calibration standards outlined by the manufacturer and this contract, a cost estimate for the repair will be provided to the 249th Engineer Battalion POC (within the Battalion S4 Office). This cost estimate will include at a minimum: the individual deficiencies, itemized quote for repair costs, and estimated time needed to conduct such repairs if requiring more than the 14 calendar days as outlined in Section 3.72. The contractor may not begin such repairs until given written permission by the POC. The POC will determine, on a case by case basis, whether or not to fund the repair. If the POC decides against funding the repair, the contractor will ship the equipment back to its appropriate location. If the POC decides to fund the repair, the POC will communicate this to the KO who will amend the contract as needed. Subsequently, additional funds will be issued to the contractor in order to execute repair(s), and the contractor will be notified by the POC to begin work. The government is not responsible for any out of scope repairs conducted by the contractor without prior written approval. 4. Period of Performance. The period of performance for this contract begins on the effective date of award and lasts for one year, not to include potential option years. If the Period of Performance expires while the contractor is still in possession of 249th EN BN TMDE, then the contractor will calibrate the items in their possession and return these items back to the 249th EN BN, at no additional cost to the Government. 5. Options. 5.1. The government reserves the right to extend the terms of this contract at the prices set forth, in accordance with the terms and conditions contained in clause 52.217-9 entitled �Option to extend the terms of the contact,� for two additional year-long periods. 5.2. The Government reserves the right to add or delete certain TMDE items detailed in Section 3 of this contract. If items are to be added or deleted to the contractual scope, both the contractor and requiring activity will agree to new pricing and terms per item. 6. Contractor Responsibilities. 6.1. The Contractor will furnish all equipment and personnel to meet the specifications of this contract. 6.2. The contractor agrees to attend, telephonically, a post-award kick off meeting convened by the 249th EN BN to discuss reporting requirements and project documentation. The Contracting Officer, and other government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the KO will apprise the contractor of how the government views the contractor's performance, and the contractor will apprise the government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government. 6.3. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person, and an alternate, shall be designated in writing. The contract manager, or alternate, shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. 7. Delivery Schedule. 7.1. The Government will notify the Contractor, in writing, prior to the transfer of equipment to the calibration site, and coordinate a pick-up date. The written notification will outline the return location of the equipment, model number(s), serial number(s), appropriate POC(s), and an itemized report on the condition of the equipment. 7.2 Within three working days of receiving the equipment, the contractor will provide, in writing, any discrepancies to the itemized equipment conditions report. If the contractor receives the equipment in conditions other than described in such report, the contractor must refute the report, citing specific reasons, e.g. a cracked screen not previously annotated by the report. 8. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. The Contractor, as a general rule, shall not have access to classified information; however, should classified documents fall into the possession of the Contractor, the Contractor shall immediately contact the COR for disposition instructions. (End of Clause) 52.245-1 ALT I � Government Property (SEP 2021 (a)�Definitions.�As used in this clause� Cannibalizemeans to remove parts from Government property for use or for installation on other Government property. ������Contractor-acquired property�means property acquired, fabricated, or otherwise provided by the Contractor for performing a contract, and to which the Government has title. ������Contractor inventory�means- �����������(1)�Any property acquired by and in the possession of a Contractor or subcontractor under a contract for which title is vested in the Government and which exceeds the amounts needed to complete full performance under the entire contract; �����������(2)�Any property that the Government is obligated or has the option to take over under any type of contract, e.g., as a result either of any changes in the specifications or plans thereunder or of the termination of the contract (or subcontract thereunder), before completion of the work, for the convenience or at the option of the Government; and �����������(3)�Government-furnished property that exceeds the amounts needed to complete full performance under the entire contract. ������Contractor�s managerial personnel�means the Contractor�s directors, officers, managers, superintendents, or equivalent representativeswho have supervision or direction of- �����������(1)�All or substantially all of the Contractor�s business; �����������(2)�All or substantially all of the Contractor�s operation at any one plant or separate location; or �����������(3)�A separate and complete major industrial operation. ������Demilitarization�means rendering a product unusable for, and not restorable to, the purpose for which it was designed or is customarily used. ������Discrepancies incident to shipment�means any differences (e.g., count or condition) between the items documented to have been shipped and items actually received. ������Equipment�means a tangible item that is functionally complete for its intended purpose, durable, nonexpendable, and needed for the performance of a contract. Equipment is not intended for sale, and does not ordinarily lose its identity or become a component part of another article when put into use. Equipment does not include material, real property, special test equipment or special tooling. ������Government-furnished property�means property in the possession of, or directly acquired by, the Government and subsequently furnished to the Contractor for performance of a contract. Government-furnished property includes, but is not limited to, spares and property furnished for repair, maintenance, overhaul, or modification. Government-furnished property also includes contractor-acquired property if the contractor-acquired property is a deliverable under a cost contract when accepted by the Government for continued use under the contract. ������Government property�means all property owned or leased by the Government. Government property includes both Government- furnished and Contractor-acquired property. Government property includes material, equipment, special tooling, special test equipment, and real property. Government property does not include intellectual property and software. ������Loss of Government property�means unintended, unforeseen or accidental loss, damage or destruction to Government property that reduces the Government�s expected economic benefits of the property. Loss of Government property does not include purposeful destructive testing, obsolescence, normal wear and tear or manufacturing defects. Loss of Government property includes, but is not limited to- �����������(1)�Items that cannot be found after a reasonable search; �����������(2)�Theft; �����������(3)�Damage resulting in unexpected harm to property requiring repair to restore the item to usable condition; or �����������(4)�Destruction resulting from incidents that render the item useless for its intended purpose or beyond economical repair. ������Material�means property that may be consumed or expended during the performance of a contract, component parts of a higher assembly, or items that lose their individual identity through incorporation into an end item. Material does not include equipment, special tooling, special test equipment or real property. ������Nonseverable�means property that cannot be removed after construction or installation without substantial loss of value or damage to the installed property or to the premises where installed. ������Precious metals�means silver, gold, platinum, palladium, iridium, osmium, rhodium, and ruthenium. ������Production scrap�means unusable material resulting from production, engineering, operations and maintenance, repair, and research and development contract activities. Production scrap may have value when re-melted or reprocessed, e.g., textile and metal clippings, borings, and faulty castings and forgings. ������Property�means all tangible property, both real and personal. ������Property Administrator�means an authorized representative of the Contracting Officer appointed in accordance with agency procedures, responsible for administering the contract requirements and obligations relating to Government property in the possession of a Contractor. ������Property records�means the records created and maintained by the contractor in support of its stewardship responsibilities for the management of Government property. ������Provide�means to furnish, as in Government-furnished property, or to acquire, as in contractor-acquired property. ������Real property�See Federal Management Regulation 102-71.20 (41 CFR 102-71.20). ������Sensitive property�means property potentially dangerous to the public safety or security if stolen, lost, or misplaced, or that shall be subject to exceptional physical security, protection, control, and accountability. Examples include weapons, ammunition, explosives, controlled substances, radioactive materials, hazardous materials or wastes, or precious metals. ������Unit acquisition cost�means- �����������(1)�For Government-furnished property, the dollar value assigned by the Government and identified in the contract; and �����������(2)�For contractor-acquired property, the cost derived from the Contractor�s records that reflect consistently applied generally accepted accounting principles. ������(b)�Property management.� (1)�The Contractor shall have a system of internal controls to manage (control, use, preserve, protect, repair, and maintain) Government property in its possession. The system shall be adequate to satisfy the requirements of this clause. In doing so, the Contractor shall initiate and maintain the processes, systems, procedures, records, and methodologies necessary for effective and efficient control of Government property. The Contractor shall disclose any significant changes to its property management system to the Property Administrator prior to implementation of the changes. The Contractor may employ customary commercial practices, voluntary consensus standards, or industry-leading practices and standards that provide effective and efficient Government property management that are necessary and appropriate for the performance of this contract (except where inconsistent with law or regulation). �����������(2)�The Contractor�s responsibility extends from the initial acquisition and receipt of property, through stewardship, custody, and use until formally relieved of responsibility by authorized means, including delivery, consumption, expending, sale (as surplus property), or other disposition, or via a completed investigation, evaluation, and final determination for lost property. This requirement applies to all Government property under the Contractor�s accountability, stewardship, possession or control, including its vendors or subcontractors (see paragraph (f)(1)(v) of this clause). �����������(3)�The Contractor shall include the requirements of this clause in all subcontracts under which Government property is acquired or furnished for subcontract performance. �����������(4)�The Contractor shall establish and maintain procedures necessary to assess its property management system effectiveness and shall perform periodic internal reviews, surveillances, self assessments, or audits. Significant findings or results of such reviews and audits pertaining to Government property shall be made available to the Property Administrator. ������(c)�Use of Government property.� (1)�The Contractor shall use Government property, either furnished or acquired under this contract, only for performing this contract, unless otherwise provided for in this contract or approved by the Contracting Officer. �����������(2)�Modifications or alterations of Government property are prohibited, unless they are- ����������������(i)�Reasonable and necessary due to the scope of work under this contract or its terms and conditions; ����������������(ii)�Required for normal maintenance; or ����������������(iii)�Otherwise authorized by the Contracting Officer. �����������(3)�The Contractor shall not cannibalize Government property unless otherwise provided for in this contract or approved by the Contracting Officer. ������(d)�Government-furnished property.� (1)�The Government shall deliver to the Contractor the Government-furnished property described in this contract. The Government shall furnish related data and information needed for the intended use of the property. The warranties of suitability of use and timely delivery of Government-furnished property do not apply to property acquired or fabricated by the Contractor as contractor-acquired property and subsequently transferred to another contract with this Contractor. �����������(2)�The delivery and/or performance dates specified in this contract are based upon the expectation that the Government-furnished property will be suitable for contract performance and will be delivered to the Contractor by the dates stated in the contract. ����������������(i)�If the property is not delivered to the Contractor by the dates stated in the contract, the Contracting Officer shall, upon the Contractor�s timely written request, consider an equitable adjustment to the contract. ����������������(ii)�In the event property is received by the Contractor, or for Government-...
