- This Exception to Fair Opportunity has been reviewed and approved in accordance with established Transportation Security Administration (TSA) procedures and is hereby published in accordance with Federal Acquisition Regulation (FAR) 16.5. Any and all redactions in this published document (that is, language marked out or deleted) have been identified and confirmed by the Government as contractor proprietary information which the Government must protect from unauthorized disclosure.� The TSA, Security and Administrative Services (SAS) / Property Management Division (PMD) and Contracting and Procurement (C&P) modified Task Order No. 70T01018F3NPRO300 that restricted the number of sources provided a fair opportunity to be considered per FAR Subpart 16.505(b)(2)(1)(B). The task order was modified bilaterally to expand the Contractor�provided Commercial Off the Shelf (COTS) property management system from the TSA Logistics Center in Coppell, TX to the TSA Logistics Centers in Egg Harbor Township, NJ and Springfield, VA. Please see the attached approved exception to fair opportunity for further information. The COTS property management system requirements for all three TSA warehouse facilities was originally included in RFP No. 70T01018R3NPR300. Fair opportunity was provided to all 8(a) small business concerns under GSA OASIS Small Business Pool 1. TSA received and evaluated proposals, but ultimately had to amend the solicitation and de-scope the requirements due to a funding shortfall. The task order would have been awarded with the full requirements had adequate funding been available at the time of award. As such, the Contracting Officer finds fair opportunity was provided and the synopsis requirements prescribed by FAR Subpart 5.301(a)(2)(ii) were satisfied when the solicitation was initially issued. The Government does not intend to respond further concerning this publication.
