- THIS IS A SPECIAL NOTICE PREPARED IN ACCORDANCE WITH FEDERAL ACQUISITION REGULATION (FAR) SUBPART 5.2 �SYNOPSES OF PROPOSED CONTRACT ACTIONS� NAICS: 334220 Estimated Delivery Period:� February 2022 Response Deadline:� 10:00 a.m. Pacific Time on October 21, 2021 The U.S. Army Corps of Engineers (USACE), Portland District (NWP) intends to negotiate/award a sole-source contract with Lotek Wireless Inc, to provide NTFD-2-1 coded nano radio transmitters (radio tags) for a fish passage and survival study at USACE Foster Dam, Sweet Home, OR.� The fish passage and survival study will be conducted by researchers under a separate contract. Lotek Wireless Inc will provide 3,575 each Model NTFD-2-1 coded nano radio telemetry transmitters.� The Government has determined this contract to be of critical importance to the operations of Foster Dam for fish passage and survival in the Willamette Basin, and that feasible substitutes are not available. REASON FOR SOLE SOURCE ACQUISITION: Pursuant to 10 U.S.C. � 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1 and DFARS 206.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. The proposed sole source contractor is Lotek Wireless Inc. Compatibility with existing equipment is the characteristic that makes this firm the only one capable of supplying the required item. The radio tags will be used for the Foster Dam fish passage and survival study and the required Model NTFD-2-1 coded nano radio fish tags are built to the specifications and compatibility with existing equipment owned by USACE. Lotek Wireless, Inc. is the only vendor manufacturing these tags to specification. Lotek Wireless is the manufacturer and the only vendor for the coded radio telemetry transmitters required for these fish passage and survival studies.� Lotek receivers and transmitters use a proprietary set of frequencies assigned to Lotek by the Federal Communications Commission for their coded radio-telemetry transmitters.� USACE own the receivers and associated equipment that will detect these Lotek proprietary tags.� Frequencies other than the one assigned to Lotek are not feasible because the use of other frequencies will likely result in detection of fish tagged by other agencies resulting in invalid data. At this time, a solicitation does not exist.� All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. *NO PHONE INQUIRIES, PLEASE.
