- Sources Sought Synopsis The Department of Housing and Urban Development (HUD) is issuing this sources sought synopsis as a means of conducting market research to identify parties having an interest in and the resources to support this requirement for Multifamily Loan Underwriting and Closing Support Services. The result of this market research will contribute to determining the method of procurement. The applicable North American Industry Classification System (NAICS) code assigned to this procurement is 524126 � Direct Property and Casualty Insurance Carriers There is no solicitation at this time. This request for capability information does not constitute a request for proposals; submission of any information in response to this market survey is purely voluntary; the government assumes no financial responsibility for any costs incurred.� If your organization has the potential capacity to perform these contract services, please provide the following information: 1) organization name, address, email address, website address, telephone number, and size and type of ownership for the organization; and 2) tailored capability statements addressing the particulars of this effort, with appropriate documentation supporting claims of organizational and staff capability. If significant subcontracting or teaming is anticipated in order to deliver technical capability, organizations should address the administrative and management structure of such arrangements. The government will evaluate market information to ascertain potential market capacity to 1) provide services consistent in scope and scale with those described in this notice and otherwise anticipated; 2) secure and apply the full range of corporate financial, human capital, and technical resources required to successfully perform similar requirements; 3) implement a successful project management plan that includes: compliance with program schedules; cost containment; meeting and tracking performance; hiring and retention of personnel and risk mitigation; and 4) provide services under a performance based service acquisition contract. Based on the responses to this sources sought notice/market research, this requirement may be set-aside for small businesses or procured through full and open competition, and multiple awards may be made. Background: HUD�s Office of Multifamily Production provides FHA mortgage insurance on loans for refinancing of existing multifamily rental housing in the FHA-insured portfolio (Section 223(a)(7)), purchase or refinancing of existing multifamily rental housing (Section 223(f)), and new construction or substantial rehabilitation of rental housing (Section 221(d)(4)).� Applications for FHA multifamily mortgage insurance are submitted by approved Multifamily Accelerated Processing (MAP) Lenders and processed in five HUD Multifamily Regions.� FHA Multifamily staff underwrite the mortgage insurance and close the loans (endorse the mortgage insurance). FHA Multifamily has experienced a significant increase in mortgage insurance application volume as a result of record-low interest rates and a freeze on other capital sources during the COVID-19 pandemic.� This has resulted in a large backlog of applications that the program office cannot process internally, which has led to delays for FHA�s customers its lenders and borrowers.� To help the program office meet current and anticipated near-term market demand for its successful programs with desirable loan terms, FHA Multifamily seeks Contractor support to assist with loan underwriting and closing. General Description of Work: The objective is for the Contractor to provide loan underwriting and closing support services to assist the program office in reducing/eliminating its current application backlog and better manage its application pipeline moving forward. Loans shall be underwritten and closed in accordance with the Multifamily Accelerated Processing (MAP) Guide and all applicable Housing Notices/Mortgagee Letters, administrative memoranda, and other guidance. �The MAP Guide can be accessed at the following webpage: https://www.hud.gov/program_offices/administration/hudclips/guidebooks/hsg-GB4430. �Additional relevant information and resources can be found on the program offices MAP webpage (https://www.hud.gov/program_offices/housing/mfh/map/maphome) and Multifamily Housing homepage (https://www.hud.gov/program_offices/housing/mfh). �A full set of operating procedures for the contract, defining roles and responsibilities, providing guidance for working with HUD and multifamily lenders, and providing all pertinent information, resources, and details will be provided to the Contractor. �The Contractor will access and use two HUD systems to perform portions of the work: the Capital Needs Assessment (CNA) e-Tool, and FHA Catalyst (web-based lender application portal). The program office will have the ability to request loan underwriting services and/or loan closing services for each loan assigned to the Contractor. �Deliverables for loan underwriting services (see Sections 5.1-5.3) shall be delivered to HUD within the following timeframes after application assignment, by program type: twenty (20) calendar days for 223(a)(7); thirty-five (35) calendar days for 223(f); and forty-five (45) calendar days for 221(d)(4). �For loan closing services (see Sections 5.4-5.6), the target is to close the loan within one hundred-twenty (120) calendar days after firm commitment issuance. The SCOR or COR will approve weekly loan assignments, if any, to the Contractor for loan underwriting and/or loan closing support services. �There shall not be a limit on the number of weekly assignments that can be made to the Contractor, but the goal is to maintain a relatively steady flow of weekly applications over the contract period of performance. �All weekly requests for services will be made by a Regional Coordinator identified in each Multifamily Region. �A HUD Point-of-Contact (POC) from the Region will be assigned to each loan, to assist the Contractor and perform various tasks for each application. �The Contractor�s underwriter and/or closer shall communicate directly with HUD�s POC and the Lender regarding the assigned loan application. Applications for FHA multifamily mortgage insurance are submitted by approved MAP Lenders to the HUD Multifamily Region with geographical jurisdiction over the project. �HUD Multifamily has a five-Region field structure: Midwest, Northeast, Southeast, Southwest, and West. �Each Region has one Regional Center and one or two Satellite Offices: Southwest Region: Fort Worth (Regional Center) and Kansas City (Satellite Office) Midwest Region: Chicago (Regional Center), Detroit and Minneapolis (Satellite Offices) Southeast Region: Atlanta (Regional Center) and Jacksonville (Satellite Office) Northeast Region: New York (Regional Center), Boston and Baltimore (Satellite Offices) West Region: San Francisco (Regional Center) and Denver (Satellite Office) Below are the characteristics of the (insert short description) requirements: 5.1 Loan Underwriting for Section 223(f) The Contractor shall follow all applicable guidance in the MAP Guide for processing and underwriting a Section 223(f) Firm Commitment Application for mortgage insurance. The Contractor�s review includes but is not limited to the review of the Lenders Underwriting Narrative, all HUD Underwriting Forms, the Capital Needs Assessment (CNA) e-Tool, Critical and Non-Critical Repairs, Reserve for Replacement Schedule, Appraisal/Valuation Review, Mortgage Credit Review of Principals, any additional Third-Party Reports, any Waiver Requests, and more. This review shall be completed by the Contractor�s underwriter and any professional technical consultants (i.e., architect, engineer, appraiser) engaged by the Contractor. The Contractor�s underwriter shall perform the following loan underwriting tasks when processing a loan application for FHA multifamily mortgage insurance. This closing is also referred to as the Initial/Final Endorsement of the mortgage insurance. Shortly after Firm Commitment issuance, the HUD POC will identify the HUD Closing Attorney from HUD�s Office of General Counsel (OGC) that the Contractor will work with for the document review and loan closing.� The Contractor�s responsibilities include but are not limited to: reviewing all draft closing documents and providing comments to the HUD Closing Attorney, Lender, and Lender�s Counsel; reviewing any firm commitment amendment requests and preparing/submitting amendments to the HUD office for review/signature; providing clearance to close and drafting the required administrative memorandum; ensuring that all firm commitment special conditions are satisfied and any outstanding issues are resolved prior to closing; assisting the HUD Closing Attorney and HUD POC/Closing Coordinator as needed, including on the day of closing; and notifying the HUD POC/Closing Coordinator when the loan has successfully closed. The Contractor�s closer shall perform the following loan closing tasks when processing a loan application for FHA multifamily mortgage insurance: a) Send an introductory email to the Lender, providing Contractor�s closer�s name and contact information and instructions for submitting draft closing documents within two (2) business days after closing assignment and identification of HUD Closing Attorney b) Schedule and host a Kick-Off Call with the Lender, Lender�s Counsel, HUD Closing Attorney (and invite HUD POC) to discuss closing timelines and any issues/obstacles within five (5) business days after receipt of draft closing documents c) Review any amendment requests and prepare/submit amendments to HUD POC for review/signature within five (5) business days after receipt d) Review all draft closing documents for completeness and accuracy, and provide comments to Lender, Lender�s Counsel, and HUD Closing Attorney within ten (10) business days after receipt of draft closing documents e) Draft and submit clearance to close administrative memorandum to HUD office within two (2) business days after all major issues have been addressed f) Ensur...
