- Identification of the agency and the contracting activity:� The Department of State Office of Acquisition Management proposes to award a delivery order with exception to fair opportunity for the renewal of one year subscription for Avamar Licensing and Maintenance on�behalf�of the Bureau of Information Resource�Management, Foreign Operations Directorate, Information Technology and Infrastructure Office, Global IT Modernization Division (IRM/FO/ITI/GITM).� The total estimated cost is $XXX. Nature and/or description of the action being approved. This is a renewal for a one-year subscription of Avamar Software and Data Protection Services, as well as one Dell/EMC SME resident engineer, and is a firm fixed price quote directly from the OEM and not a contract. �This will provide continued, uninterrupted support for the GITM Avamar Data-Offshoring project. �The period of performance will be September 29, 2021 through September 28, 2022.� . ����������� 3.� ������ A description of the supplies or services required to meet the Department�s needs. ����������� The requirement is to provide annual Avamar Software licensing and warranty support, Data Protection Services for offshored data, and onsite Dell/EMC resident engineering support for GITM at a total cost of $XXX. �These services are required for continued support of the GITM Avamar Data-Offshoring project, protecting the mission critical data for all overseas posts. �This continued service is only available from Dell/EMC, as the proprietary vendor of the Avamar hardware and software.� 4.� ������ Authority permitting a Fair Opportunity Exception and the supporting rationale. This acquisition is conducted pursuant to 41 U.S.C. 4103 and 4106 as implemented by FAR 16.505(b)(2) and substantiated by the following:� ����������� ? FAR 16.505(b)(2)(i)(B) � Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.� Avamar is a service only offered through Dell/EMC and no other OEM can offer this service. 5.� ������ A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. �Provide a statement that the proposed order/modification represents a reasonable cost and is in the best value for the Department. ����������� The Contracting Office determined that the anticipated price is fair and reasonable based on pricing given by Dell/EMC.� By signing the justification the Contracting Officer makes a determination that the cost/price to the Government are expected to be fair and reasonable. 6. ������� �Any other facts supporting the justification. ��� ����������� �Other data back-up solutions exist in the marketplace.� However, the DOS has invested millions of dollars into the Avamar data back-up solution, which not only includes software, but hardware as well.� It would be very imprudent and cost prohibitive to suddenly shift from one data back-up solution to another without first performing in-depth research and very thorough testing of a new solution. �Providing reliable data back-up at the DOS is extremely critical and a key operational function that cannot be treated lightly.� The Avamar product has performed in an exceptional fashion on multiple occasions � during sudden post evacuations, draw downs, and catatrophic data losses.� The DOS has been satisfied with the performance provided by the Avamar data back-up solution.� Avamar is a proprietary product of Dell/EMC.� Dell/EMC is the only provider �that offers support for this product. � 7.� ������ Actions the agency May Take to Remove or Overcome Any Barriers to Increase Fair Opportunity before any subsequent acquisitions for the supplies or services is made. Until the Department of State GITM Program Office finds and vets a new solution, the Avamar Software and Data Protection Service will be renewed each year. �There are no other OEMs, resellers, or vendors that can offer this service other than Dell/EMC.
