DEPARTMENT OF DEFENSE WASHINGTON HEADQUARTERS SERVICES ACQUISITION DIRECTORATE SOURCES SOUGHT NOTICE SY100520210319 General Information Document Type: Sources Sought Notice Title: Analytical, Administrative, and Litigation Support Services Sources Sought Post Date: October 13, 2021 Sources Sought Response Date: October 27, 2021 NAICS Code: 541199 - All Other Legal Services Product Service Code: R499 - Support Professional - Other Washington Headquarters Services, Acquisition Directorate (WHS/AD) on behalf of the Department of Defense Office of General Counsel (DoD OGC) is conducting market research to locate qualified, experienced and interested businesses from �all� sources including Other than Small Businesses, Small Businesses, 8(a) Small Businesses, HUBZone Small Businesses, Service-Disabled Veteran- Owned Small Businesses, Women-Owned Small Businesses and Economically Disadvantaged Women-owned Small Businesses to provide Administrative, and Litigation Support Services. Background DoD OGC, the Washington Headquarters Service (WHS) Executive Services Directorate (ESD) and Freedom of Information Division (FOID) are required to identify, process, and produce a large volume of government records pursuant to statutory, administrative, and litigation obligations in relation to the Freedom of Information Act (FOIA). These obligations have increased exponentially every year and exceed the capacity of current government staff and Contractor support is necessary to satisfy legal obligations and deadlines. Sources Sought Notice This Sources Sought Notices is for informational purposes only. It is not to be construed as an obligation on the part of WHS/AD. In order to proactively plan for future requirements, WHS/AD is conducting market research to locate qualified, experienced, and interested parties who have the capability to provide Administrative, and Litigation Support Services. This Sources Sought Notice is not a request for proposal (RFP) nor does it restrict the Government as to the final acquisition strategy. No contract will be awarded from this announcement. No reimbursement will be made for any cost associated with providing information in response to this announcement. At this time no solicitation exists. Therefore, please do not request a copy of the solicitation. Responses in any form are not offers. The Government will not reimburse respondents for any costs incurred in preparation of a response to this notice. The applicable North American Industry Classification System (NAICS) code assigned is NAICS: 541199 - All Other Legal Services, Small Business size standard of $12 million. The acquisition has an estimated dollar value range of $18,000,000.00 to $22,500,000.00. The estimated period of performance is for a 12-month Base Period with four (4) 12-month Option Periods. Contracting Office Address Washington Headquarters Services, Acquisition Directorate, 4800 Mark Center Drive, Suite 09F09, Alexandria, VA 22350-3400 Location Service Requirement Critical Task/Elements Interested parties submitting a response to this notice shall address performance of the following Service Requirement Critical Tasks/Elements in their capabilities statement. Interested parties are requested NOT to submit marketing materials; but rather, speak directly and specifically to the required capabilities and service requirement critical tasks/elements outlined below: Special Requirements The contractor shall possess and maintain a building pass badge for each contractor. The contractor shall possess Secret or Top Secret/SCI Eligible security clearances for each contractor dependent on position. OSD/JS & FOID - FOIA and Non-DoD Litigation Referrals and Consultations Coordinate with the Office of the Secretary of Defense (OSD), and the Joint Staff (JS) and DoD components for review of responsive records and delivery of cases to and from component offices. Assist in the identification of classified information, Restricted or Formerly Restricted Data, and militarily critical technology and report to Program Manager or COR. Assist in the identification and handling of NATO classified and unclassified information. Assist in the identification and handling of non-OSD/JS component equities (including DoD and intelligence community equities). Assist in the identification of information exempted from release in accordance with the applicable statutes and regulations described in Part 6 and application of the appropriate exemptions to the information. Conduct appropriate coordination, as needed, and document accordingly. Provide reproduction of documents required for case records. Coordinate follow-up of agency coordination to determine review status. Provide registration of casework, to include Classified Document Registries and other office administrative functions. Maintain database/records management for each case using the standard FOID records management and case processing system. Provide review of OSD/JS and DoD component release recommendations and assist in reconciling difference in release recommendations. Process electronic redaction of exempt information for case records. Prepare detailed Vaughn indices, to include entries that: (1) identify each document withheld; (2) state the statutory exemption claimed; and (3) explain how disclosure would damage the interests protected by the claimed exemption. Prepare internal and external correspondence for approval by Chief, FOID for coordination and document releases. Perform escort duties within workspaces as necessary. OGC - FOIA, Litigation, E-Discovery, and Records Processing, and Congressional Inquiries and Investigations Coordinate with OSD/JS and DoD components for review of responsive records and delivery of cases to and from component offices. Assist in the identification of classified information, Restricted or Formerly Restricted Data, and militarily critical technology and report to Program Manager or COR. Assist in the identification and handling of NATO classified and unclassified information. Assist in the identification of non-OSD/JS component equities (including DoD, intelligence community and other entity equities). Assist in the identification of information exempt from release in accordance with the applicable statutes and regulations described in Part 6 and application of the appropriate exemptions to the information. Conduct appropriate coordination, as needed, and document accordingly. Provide reproduction of documents required for request and/or case records. Coordinate follow-up of agency coordination to determine review status. Provide registration of casework, to include Classified Document Registries and other office administrative functions (e.g. scanning materials, filing records, maintaining tracking materials and tools, among other functions). Maintain database/records management for each case using the OGC records management and case processing system. Provide review of OSD/JS and DoD component release recommendations and assist in reconciling difference in release recommendations. Process electronic redaction of exempt information for case records pursuant to the authorities listed in Part 6. Prepare detailed Vaughn indices, to include entries that: (1) identify each document withheld; (2) state the statutory exemption claimed; and (3) explain how disclosure would damage the interests protected by the claimed exemption. Prepare internal and external correspondence for case attorneys for approval and release. Perform escort duties within workspaces as necessary. Review information that is potentially relevant to ongoing litigation and properly identify responsive information for further processing. Identify all privileged information contained in records responsive to ongoing litigation. Prepare detailed privilege logs, to include entries that: (1) identify each document deemed to contain privileged material; (2) state the privilege or other exemption claimed; and (3) explain how disclosure would damage interests protected by the claimed privilege or exemption. Prepare, process, and submit travel and visit requests for opposing counsel to visit clients detained by the Department of Defense. Perform appropriate open and closure procedures of secure workspaces and areas. The capabilities� statement should address the Task areas identified above and for each Task Area demonstrate how the firm�s recent past performance (last 3 years) is relevant to the enterprise focus areas listed including the dollar value, period of performance, size and scope of the firm�s prior contracts. Firms need to include their business address, point of contact, CAGE code, DUNS number and small business status. The following information is also requested and should be included with your capability information: Please indicate whether your firm will submit a quotation if a Request for Quote (RFQ)/Request for Proposal (RFP) is issued and whether your firm�s interest is for prime contracting or as a subcontractor. Do not include proprietary, classified, confidential, or sensitive information in your response to this Request for Information Notice. The Government reserves the right to use any information provided by respondents for any purpose deemed necessary and legally appropriate, including using technical information provided by respondents in any resultant solicitation. Responses to this Notice will not be returned. Responses must be submitted no later than, Thursday October 28, 2021 at 10:00 AM (Eastern). Capability statements will not be returned. No telephone requests will be honored. Response Format: To facilitate a timely and comprehensive review of all submitted responses, firms should respond using the format requested in this Notice. Any deviation from this format may lead to the rejection of the response. All interested firms having the experience, skills and capabilities necessary to perform the stated requirements are requested to provide a Capability Statement no more than 10 pages maximum. All responses should be in �Times New Roman� 12-inch font on 8.5 x 11 paper. No hard copy or facsimile submissions will be accepted. Cover letters and extraneous materials (brochures, etc.) will not be considered. Capability response must include the following information: A brief three to five page synopsis of similar work performed. DUNS and CAGE Code Number. Company name and address. Company Point of Contact, phone number and email. NAICS codes associated with the company. Socio-economic categories associated with the company (e.g., 8(a), SDB, VOSB, WOSB, etc.). Recommended/suggested contract type for this effort. Identify contracts your company has been awarded under NAICS: 541199 - All Other Legal Services. Additional information on NAICS codes can be found at www.sba.gov. Recommended/suggested NAICS codes for this effort. Identify if your company has any pre-existing contract vehicles and the contract number for similar services, including any GSA contracts and schedules that are currently held. Point of Contact name, phone number, and emails of individuals who can verify the demonstrated capabilities identified in the responses. Please indicate if you have Secret and Top Secret facility security clearance. Respondents are limited to 10 pages.� A minimum font size 12, left justified, and one inch margins all around. Respondents must submit documents in Word or PDF format. Neither zipped files will be accepted nor telephone requests be honored. In addition to the above questions, interested vendors must address the following: Question 1. Please identify what tasks/elements of this requirement where subcontracting opportunities exist. Question 2. Based on the magnitude of this requirement, describe your prior experience in the transition to fully staff a requirement, and how your prior experience will ensure success in this requirement. Question 3. What prior experience does your organization have in providing FOIA and E-Discovery Support Services?� Question 4. Based on the critical elements and tasks of this requirement, what is your recommended labor category mix? Question 5. In each tasks, indicate any subcontracting opportunities as applicable. Question 6. Identify in each tasks listed above the percentage for subcontracting opportunities as applicable. Proprietary information and trade secrets shall NOT be submitted as part of a response. Please be advised that all submissions become Government property and will not be returned. All Government and contractor personal reviewing Sources Sought responses will have signed non-disclosure agreements and understand their responsibility for proper use and protection from unauthorized disclosure of proprietary information as described in 41 USC 423. The Government shall not be held liable for any damages incurred if proprietary information is submitted, as it is clearly stated this type of information shall NOT be submitted.
