Description
GENERAL SERVICES ADMINISTRATION REGION 5 Project Name:� Operation and Maintenance and Elevator Services at the Land Port of Entry (LPOE) in Sault Ste. Marie, MI � 6-month Extension under FAR 52.217-8 JUSTIFICATION AND APPROVAL Contracting Agency and Activity. The General Service Administration, Region 5, Building Services Branch plans to contract by means other than full and open competition. Select One option below. ��������������� ?Brand Name Justification (BNJ) x Sole Source Justification (SSJ) ?Other: (Identify LSJ) ���������� ��� If SSJ, Annotate the following: Vendor Name:� CMC & Maintenance Inc.����������������������������� DUNS: 883405797� Cage: 1BKM8 Nature of Action Being Approved & Description of Supplies or Services: Recurring Operation and Maintenance services at the Sault Ste. Marie LPOE are currently being provided by CMC & Maintenance, Inc. In order to allow for the follow-on procurement to take place, the Government needs to extend the current contract by a period of 6 months under FAR 52.217-8. Because this option period was not explicitly evaluated as part of the Total Evaluated Price at the time of the initial award of the contract, a Justification and Approval for Other than Full and Open Competition is required. However, the vendor�s pricing for the 6-month extension period is identical to the fair and reasonable pricing for Option Period 5, with the exception of allowable increases due to increased wages and fringe benefits under FAR 52.222-43. Estimated Dollar Value. An identification of the statutory authority permitting other than full and open competition (FAR 6.303-2(b)(4)). The statutory authority permitting other than full and open competition is 6.302-2 Unusual and compelling urgency. The current contract is due to expire on 11/30/2021, and a 6-month extension is needed in order to ensure the follow-on 10-year recurring services contract can be procured competitively. The current contract provides for a 6-month extension under FAR 52.217-8 for situations such as this one, in order to ensure continuity of service. Operation and Maintenance and Elevator Maintenance services are both necessary for the continued operation of the facility and for the tenant agencies to fulfill their missions. If services do not continue, tenant safety and comfort will be harmed. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority (FAR 6.303-2(b)(5)). CMC & Maintenance, Inc. �is uniquely qualified to provide these services to GSA based upon the following: a. This vendor is already on-site and maintains the proper security clearances and credentials needed in order to operate the equipment and computer systems. A new vendor would likely not be able to ensure the clearance of new employees, leading to a lapse in service. B. The vendor�s contract already allows for a 6-month extension under their contract under FAR clause 52.217-8. While the 52.217-8 pricing was not accounted for in the Total Evaluated Price evaluation, the 52.217-8 pricing is based solely on the Option Year 5 pricing, plus allowable escalations due to increases in wage and fringe benefits under FAR 52.222-43. This pricing was already found to be fair and reasonable at the time of award. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under FAR 5.202 applies (FAR 6.303-2(b)(6)). Exception 5.202(a)(2) applies: ��The proposed contract action is made under the conditions described in�6.302-2�(or, for purchases conducted using simplified acquisition procedures, if unusual and compelling urgency precludes competition to the maximum extent practicable) and the Government would be seriously injured if the agency complies with the time periods specified in�5.203 Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable (FAR 6.303-2(b)(7)). The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on the fact that FAR 52.217-8 pricing is identical to pricing that was previously found to be fair and reasonable. The only changes to pricing are the allowable increases based on wage and fringe benefit increases under FAR 52.222-43. � A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted (FAR 6.303-2(b)(8)). Market research was not conducted due to unusual and compelling urgency. Any other facts supporting the use of other than full and open competition (FAR 6.303-2(b)(9)). This modification is necessary to avoid a break in service for this critical mission requirement. CMC & Maintenance, Inc. possesses the qualifications required to perform this requirement without any lapse in service. An open competition to complete the work would cause intolerable delay and pose a tenant safety risk to the Government. The requirement cannot be modified in any manner to increase competition due to the short time-frames involved and the fact that provision for this extension� is already made under the current contract under FAR clause 52.217-8. A listing of any sources that expressed a written interest in the acquisition (FAR 6.303-2(b)(10)). None A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated (FAR 6.303-2(b)(11)). �The government is conducting thorough market research for the 10 year follow-on solicitation to support competition to the maximum extent practicable. Research to support the facts presented for the justification above.� N/A
