- Proposal Requirements� The Federal Emergency Management Agency requests that you submit Technical and Price Proposals in response to this solicitation. Each of the parts shall be separate and complete so that evaluation of each may be accomplished independently. The products sought from this solicitation include Weather Radios, Strobe Lights, Bed Shaker, Dual Connectors, Roll-in-Showers, and Accessory Packages to be delivered in accordance with the Statement of Work and the CLIN table provided. � The period of performance (POP) is 90 days from date of award.� FEMA reserves the right to fully award the contract to one or more Offerors based on the decision of the Source Selection Authority. The award of this contract will be made on the Best Value basis, using the procedures prescribed in the evaluation criteria. � All questions in reference to this solicitation shall be submitted no later than 3:00pm EST on Friday, October 22, 2021. Proposals are due no later than Tuesday, October 26, 2021 at�12:00pm EST.� Proposal Requirements� The Contractor�s response must be submitted in two parts: A Technical and Price proposals. Each of the parts shall be separate and complete so that evaluation of each may be accomplished independently.� Past Performance forms do not need to be submitted. FEMA will, in accordance with FAR Sub-Part 15.305(a)(2)(i), consider available sources of Past Performance. � Offeror may submit proposals to partially fill this order.� Requirements for the Written Technical Proposal� The Offeror shall identify access and functional needs items that meet the requirements in this solicitation. The Offeror shall provide the description, number of items, and delivery schedule for the items being proposed. The Offeror shall provide the following materials:� 1.�� �Manufacturer specification sheets to accompany the proposed item. 2.�� �Delivery schedule adhering to FEMA requirements. Sample Technical Proposal Delivery Schedule (Attached) Requirements for Price Proposal� The Offeror shall provide a price proposal using the attached CLIN Table Pricing Template for each accessory equipment item proposed in the Offeror�s technical proposal for this solicitation. The Offeror shall provide the number of units being supplied, unit price, and total price for each item. � All documents shall be submitted electronically in .doc, .pdf, and .xls/.xlsx format.� Proposal Organization:� Factors (Attached) Factor 1 � Technical Proposal� � � � � � � �Manufacturer Specification Sheet per equipment item in PDF format � Factor 2 � Delivery Schedule Table� � � �No Page Limit in MS Word, PDF and MS Excel format �� Factor 3 � Price Proposal Table� � � � � � �No Page Limit in MS Excel format and PDF ��See attached Table� Proposal Evaluation� Award will be made to the responsive, responsible contractor who provides the Best Value solution to the Government. Each proposal will be evaluated according to the below following criteria.�Each Offeror�s proposal will be rated on an individual basis.� Offerors shall be evaluated on the three factors listed below:� Factor 1 � Manufacturer specification sheets (Non-price) Factor 2 � Delivery schedule (Non-price)� Factor 3 � Price Proposal Table (Price)� In determining which proposal provides the best value to the Government, factors 1 and 2 combined are weighted higher than factor 3. In addition, the non-price factors combined are more important than price. � Based upon the results of the integrated assessment of the non-price and price proposals, FEMA may make awards to the lowest-priced Offeror or the Offeror with the highest non-price score if the source selection official determines that to do so would result in the best value to the Government. � Factor 1 � Manufacturer Specification Sheets� FEMA will evaluate the technical specifications for compliance with the requirements for each item. The government will use the table below for its rankings.� If the Offeror fails to materially follow the solicitation proposal requirements, the Offeror may be declared ineligibe for further consideration for an award and for evaluation for the entire proposal. The proposal of individual accessory equipment items provided must meet FEMAs requirements based on analysis of specification sheets provided. Items rated unsatisfactory for Factor 1 may be eliminated from further consideration for delivery order award or those individual items may be removed for consideration from the proposal without disqualifying the entire proposal.� The government will use the table below for its rankings.� Factor 1 Technical Evaluation Criteria Table (Attached) Technical Evaluation Criteria� 1.�Has the Offeror met the requirements for the NOAA Weather Radio?� 2. Has the Offeror met the requirements for the Strobe Light compatible with NOAA weather radio?� 3.�Has the Offeror met the requirements for Dual Connector for the Weather Alert System compatible with NOAA weather radio?� 4.�Has the Offeror met the requirements for the Multi-Piece Barrier Free�36�X 36� X 80 1?8� Shower with Beveled Threshold and a 5/8� Curb Height?� 5.�Has the Offeror met the requirements for the Multi-Piece Barrier Free 60�X 30�X 80 �� Shower with Beveled Threshold and a �� Curb Height?� 6.�Has the Offeror met the requirements for the Accessory package for 60� Wide Barrier Free Shower with Valve Package?� 7.�Has the Offeror met the requirements for the Accessory package for 36� Wide Barrier Free Shower with Valve Package?� Factor 2 � Delivery Schedule� FEMA will consider the delivery date for items and use the delivery schedule included in this solicitation to determine if the Offeror can meet FEMA�s delivery requirements. The government will use the table below for its rankings.� Factor 2 Technical Evaluation Criteria Table� 1.�Has the Offeror provided a delivery schedule?� 2.�Has the Offeror provided the quantity of units being delivered that equal the number of items being requested?� 3. Has the Offeror provided a delivery date for the NOAA Weather Radio?�� 4. Has the Offeror provided a delivery date for the Strobe Light compatible with NOAA weather radio?� 5.�Has the Offeror provided a delivery date for the Dual Connector for the Weather Alert System compatible with NOAA weather radio?� 6.�Has the Offeror provided a delivery date for the Multi-Piece Barrier Free�36�X 36� X 80 1?8� Shower with Beveled Threshold and a 5/8� Curb Height?� 7.�Has the Offeror provided a delivery date for the Multi-Piece Barrier Free 60�X 30�X 80 �� Shower with Beveled Threshold and a �� Curb Height?� 8.�Has the Offeror provided a delivery date for the Accessory package for 60� Wide Barrier Free Shower with Valve Package?� 9.�Has the Offeror provided a delivery date for the Accessory package for 36� Wide Barrier Free Shower with Valve Package?� Factor 3 � Price� FEMA will use the Price Proposal Spreadsheet to be provided by FEMA for price evaluation. The Offeror�s price shall be inclusive of all cost associated with the item and all delivery cost associated with the item. Offeror submitting partial pricing information may be ineligible for award. The Offeror�s proposed pricing shall be evaluated for fairness and reasonableness for each proposed item.� FEMA reserves the right to fully award the contract to one or more Offerors based on the decision of the Source Selection Authority.� FEMA intends to issue awards without holding discussions with Offerors. Therefore, Offerors are highly encouraged to provide their best proposal with initial submissions. FEMA reserves the right to review proposals with any or all Offerors submitting a proposal if it is determined advantageous to the Government. This statement is not to be construed to mean that the FEMA is obligated to conduct such conversations with any Offerors. An Offeror may be eliminated from consideration without further dialogue or explanation prior to an award if its proposal is found not to be among those Offerors considered most advantageous to the Government, based on a best value determination.� - End of Solicitation Instructions and Evaluation Factors - 52.204-24 -- Representation Regarding Certain Telecommunications and Video Surveillance �Services or Equipment.� The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror �has represented that it �does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument� in the provision at 52.204-26, Covered Telecommunications Equipment or Services�Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.� (a) Definitions. As used in this provision� Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.� (b) Prohibition. (1)�� �Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to� (i)�� �Prohibit the head of an executive agency from procuring with an entity to provide�a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or� (ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.� (2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a� substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to�� (i) Prohibit the head of an executive agency from procuring with an entity to provide�a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or� (ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.� (c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for �covered telecommunications equipment or services�.� (d)�� �Representation. The Offeror represents that� (1)�� �It ? will, ? will not provide covered telecommunications equipment or services to�the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds �will� in paragraph (d)(1) of this section; and� (2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that�� It ? does, ? does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds �does� in paragraph (d)(2) of this section.� (e) Disclosures. (1)�� �Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded �will� in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer: (i)�� �For covered equipment� (A)�� �The entity that produced the covered telecommunications equipment�(include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);� (B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and� (C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.� (ii) For covered services� (A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or� (B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.� (2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded �does� in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:� (i)�� �For covered equipment� (A)�� �The entity that produced the covered telecommunications equipment�(include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);� (B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and� (C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.� (ii)�� �For covered services� (A)�� �If the service is related to item maintenance: A description of all covered�telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or� (B) If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.� (End of provision)� 52.204-26 Covered Telecommunications Equipment or Services-Representation.� As prescribed in 4.2105(c), insert the following provision:� Covered Telecommunications Equipment or Services-Representation (Oct 2020)� (a)�� �Definitions. As used in this provision, ""covered telecommunications equipment or services"" and ""reasonable inquiry"" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment. (b)�� �Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for ""covered telecommunications equipment or services"". (End of provision) 52.223-1 Biobased Product Certification.� As prescribed in 23.406(a), insert the following provision:� Biobased Product Certification (May 2012)� As required by the Farm Security and Rural Investment Act of 2002 and the Energy Policy Act of 2005 ( 7 U.S.C. 8102(c)(3)), the offeror certifies, by signing this offer, that biobased products (within categories of products listed by the United States Department of Agriculture in 7 CFR part 3201, subpart B) to be used or delivered in the performance of the contract, other than biobased products that are not purchased by the offeror as a direct result of this contract, will comply with the applicable specifications or other contractual requirements. (End of provision)� 52.223-4 Recovered Material Certification.� As prescribed in 23.406(c), insert the following provision: Recovered Material Certification (May 2008)� As required by the Resource Conservation and Recovery Act of 1976 (42� U.S.C.6962(c)(3)(A)(i)), the offeror certifies, by signing this offer, that the percentage of recovered materials content for EPA-designated items to be delivered or used in the performance of the contract will be at least the amount required by the applicable contract specifications or other contractual requirements. (End of provision)� �52.223-15 Energy Efficiency in Energy-Consuming Products.� As prescribed in 23.206 , insert the following clause:� Energy Efficiency in Energy-Consuming Products (May 2020)� (a) Definition. As used in this clause���� � � Energy-efficient product� (1)�� �Means a product that� (i)�� �Meets Department of Energy and Environmental Protection Agency criteria for�use of the Energy Star trademark label; or� (ii) Is in the upper 25 percent of efficiency for all similar products as designated by the Department of Energy�s Federal Energy Management Program.� (2) The term ""product"" does not include any energy-consuming product or system designed or procured for combat or combat-related missions (42 U.S.C. 8259b).� (b) The Contractor shall ensure that energy-consuming products are energy efficient products (i.e., ENERGY STAR� products or FEMP-designated products) at the time of contract award, for products that are�� (1)�� �Delivered; (2)�� �Acquired by the Contractor for use in performing services at a Federally-controlled facility (3)�� �Furnished by the Contractor for use by the Government; or (4)�� �Specified in the design of a building or work, or incorporated during its�construction, renovation, or maintenance.� (c) The requirements of paragraph (b) apply to the Contractor (including any subcontractor) unless�� (1) The energy-consuming product is not listed in the ENERGY STAR� Program or FEMP; or� (2) Otherwise approved in writing by the Contracting Officer.
