- DESCRIPTION Pursuant to FAR Subpart 5.2�Synopses of Proposed Contract Actions, THIS IS A NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL AND OPEN COMPETITION.� The Leica Stellaris 8 Spectral White Light Laser Confocal system is utilized routinely by the NIMH Systems Neuroscience Imaging Resource users and requires routine preventative maintenance. This purchase order is required in order to maintain this research equipment in operable condition.� The Leica Stellaris 8 Spectral White Light Laser Confocal system provides state of the art imaging capabilities that are relevant to the research projects of our IRP investigators. The system was purchased in 2020 and is utilized routinely in the NIMH Systems Neuroscience Imaging Resource and requires routine preventative maintenance. Service shall include examination of all functioning parts, replacement, or repair of worn or unserviceable parts, adjustment and calibration made with the expressed intent of maintaining the instrument to the manufacturer�s original specifications. The proposed �purchase order for service maintenance will ensure minimal downtime due to hardware and software malfunction. Additionally, the purchase order willensure this research equipment in operable condition and prevent costly repairs. All preventive maintenance, parts repair and replacement, and software updates shall be performed by a Leica Microsystems Inc. certified, trained service provider, using only original equipment manufacturer (OEM)-certified parts. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures, and the procedures prescribed in FAR Subpart 13.106-1(b)(1), Soliciting from a single source. The resultant contract will include all applicable provisions and clauses of the FAR in effect through the Federal Acquisition Circular (FAC) 2021-07, dated September 10, 2021. ANTICIPATED SOURCE Leica Microsystems, Inc. 1700 Leider Lane Buffalo Grove, IL 60089 DUNS: 115978041 PERIOD OF PERFORMANCE The anticipated period of performance including options is as follows: Base Year: ���� �November 26, 2021 through November 25, 2022 Option Year 1: November 26, 2022 through November 25, 2023 Option Year 2: November 26, 2023 through November 25, 2024 Option Year 3: November 26, 2024 through November 25, 2025 PLACE OF PERFORMANCE NIH Site 49 Convent Drive, Bldg. 49, Room 3A07 Bethesda MD 20892 REASON FOR NON-COMPETITIVE ACTION This action is restricted to Leica Microsystems, Inc. because it is the only source of original equipment manufacturer parts for the Leica Stellaris 8 Spectral White Light Laser Confocal System. Leica Microsystems has not authorized any third party to provide replacement parts or software for the Leica Stellaris 8 Spectral White Light Laser Confocal System. Because Leica Microsystems, Inc. is the only provider of original equipment manufacturer parts for the Leica Stellaris 8 Spectral White Light Laser Confocal System, it is the only source capable of fulfilling this requirement. CLOSING STATEMENT This synopsis is not a request for competitive proposals.� All responsible sources may submit a capability statement, however, which shall be considered by the agency. �Responses to this notice must include clear and convincing evidence of the offeror�s capability of fulfilling the requirement.� In addition, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response. �All offerors must have an active registration in the System for Award Management (SAM). A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.� The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.�� All responses must be received by 4:00 PM Eastern Time on November 5, 2021.
