Description
Notice of Intent for Sole Source Contract - NIBS MCC�s Department of Compact Operations (DCO) Infrastructure, Environment, and Private Sector (IEPS), intends to make a sole-source award to the National Institute of Building Sciences (NIBS) under the authorities of FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements and FAR 6.302-5 Authorized or required by statute (Public Law 93-383). MCC requests the National Institute of Building Sciences (NIBS) to provide technical advisory services to the MCC Transport and Vertical Structures (TVS) Practice Group. a)�� �Pursuant to 41 U.S.C. 253(c)(1), FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements, the TVS Practice Group has an immediate and long-term requirement for at least the following five (5) capabilities that are unique to NIBS: 1.�� �The Consultative Council assembles expert representatives to make recommendations on behalf of the building community to the executive and legislative branches of the U.S. Government that will improve our nation�s buildings and infrastructure. Direct access to this resource will enable MCC to leverage this national-level resource in the development and implementation of compacts and enhance TVS�s emerging practice guidelines for vertical structures. 2.�� �The National Council on Building Codes and Standards brings together representatives from state, local and regional government bodies to develop, advance and improve the administration of building codes and standards. Direct access to this resource will enable MCC to leverage this national-level resource in the development and implementation of compacts and enhance TVS�s emerging practice guidelines for vertical structures. 3.�� �The National Clearinghouse for Educational Facilities provides the world�s preeminent online source for research and resources on the planning, design, funding, construction, and maintenance of educational facilities. Direct access to this resource unique to NIBS will support TVS work in at least three (3) compacts (Georgia II, Morocco II, and Cote d�Ivoire). 4.�� �The Facility Maintenance and Operations Committee works within the industry to improve the performance and longevity of buildings and building systems through consistent, effective and proper facility maintenance and operations. Direct access to this resource unique to NIBS will support TVS work in at least three (3) compacts (Georgia II, Morocco II, and Cote d�Ivoire). 5.�� �The Multihazard Mitigation Council works to reduce the total losses associated with buildings and other structures as a result of natural disasters and other hazards. This council is an internationally recognized expert body that produced the widely-cited report, �Natural Hazard Mitigation Saves: An Independent Study to Assess the Future Savings from Mitigation Activities.� Direct access to this resource will enable MCC to leverage this national-level resource in the development and implementation of compacts and enhance TVS�s emerging practice guidelines for vertical structures. b)�� �The proposed contract is for technical advisory services to MCC�s Transport and Vertical Structures (TVS) Practice Group for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-5 Authorized or required by statute. The legislation that established NIBS (PL 93-383, August 22, 1974), which is also cited as �Housing and Community Development Act of 1974ii� stated in section National Institute of Building Sciences Sec. 809 g(3) the following with emphasis added, �(3) Every department, agency, and establishment of the Federal Government having responsibility for building or construction, or for building or construction-related programs, is authorized and encouraged to request authorization and appropriations for grants to the Institute for its general support and is authorized to contract with and accept contracts from the Institute for specific services where deemed appropriate by the responsible Federal official involved.� Furthermore, the White House Office of Management and Budget (OMB) issued guidance in 1990 that encouraged federal agencies to contract with NIBS because of its unique role as an authoritative source of innovative solutions for the built environment. The guidance states: A. Agencies and departments should utilize the unique services provided by NIBS when such services are required; B. Section 809(g)(3) of P.L. 93-383 expressly authorizes agencies and departments to contract with NIBS. Accordingly, the exception to full and open competition provided by FAR Subpart 6.302-5 may be used, as appropriate, to award such contracts. As noted above, NIBS is based on a legislative mandate that provides an authoritative source of innovative solutions for the built environment in service to the nation. c)�� �The NAICS code is 541990 All Other Professional, Scientific, and Technical Services. The anticipated period of performance is for one-year base period and two one-year option period with the total estimated cost exceeding SAT but not exceeding $25 million. This notice is NOT a request for proposals or quotes. Interested parties may submit their capability statement, quote, questions, and/or comments to the points-of-contact noted below by 5:00 PM ET November 25, 2021. The Government shall consider all responses. The determination to compete this requirement is solely within the discretion of the government.
