- Notice of Intent to Sole Source - Thermo Electron North America LLC The U.S Environmental Protection Agency (EPA) intends to negotiate on a sole source basis with Thermo Electron North America, LLC., for a liquid chromatography system. The procurement for this system is recommended to be processed without full and open competition. Thermo Electron North America, LLC., is the only known commercial source for this proprietary item. The Liquid Chromatography System is a series of LC modules including an autosampler, thermostated column compartment, additional detector flow cells, PC, and monitor along with the license for a new version of Chromeleon, which is the data acquisition/analysis software. The system is fully compatible with the Division�s current Thermo Scientific Ultimate 3000 UHPLC binary pump, diode array detector, fluorescent detector, and fraction collector. The specific characteristics of the Liquid Chromatography system that limit the availability to a sole source are the needs to natively work with existing Thermo Scientific U3000 modules (UltiMate 3000 UPLC binary pump, diode array detector, fluorescent detector, and fraction collector) that are currently in-house to create one functioning LC system. The system must run natively using Chromeleon software, which is being purchased here as well. By using the U3000 modules already in house, we are leveraging existing resources to assemble a new, fully functioning LC system capable of analysis of organics and fractionation of sample analytes. Only this suggested source can furnish the requirements, to the exclusion of other sources, because native control and compatibility of other manufacturers equipment cannot be assured through Chromeleon as the data acquisition software. EPA believes Thermo Electron North America, LLC., is the only vendor capable of providing the above referenced items. The circumstance permitting is FAR 6.302-1 ""Only one responsible source and no other supplies or services will satisfy agency requirements"". All interested parties who believe they can provide the required item/services should fully explain their capabilities and qualifications in writing within 10 days from the date of this announcement and provide itemized pricing that is sufficient to make a determination that competition is feasible. The intent of this notice is to determine if any other source(s) exist, and therefore, no solicitation is available. Consequently, anyone failing to provide the aforementioned and instead chooses to merely submit a routine letter requesting a copy of the statement of work or more information about the project will be ignored. The information received to this notice will be considered solely for the purpose of determining whether or not to conduct a competitive procurement.
