- This notice is being published in accordance with Federal Acquisition Regulation (FAR) Part 5.101(a)(2) requiring the dissemination of information on proposed contract actions expected to exceed $15,000, but not expected to exceed $25,000. This is a notice of intent to award a sole source contract to Nikon�and is not a request for competitive proposals.� This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold.� Contracts awarded using FAR Part 13�Simplified Acquisition Procedures and at a dollar value less than the simplified acquisition threshold are exempt from the requirements of FAR Part 6�Competition Requirements. Single-sole Source Determination: The determination by the Government to make a single-sole source�is based upon the market research conducted as prescribed in FAR Part 10�Market Research, specifically the results of the market research concluded that this order is for maintenance of an A1R MP microscope system offered by Nikon.�Since the microscope is manufactured by Nikon Instruments it is essential that maintenance and service be performed by certified and trained Nikon Biosystems Service Specialists and technicians. All technicians working on the microscope must have previous in-field experience working on our exact microscope configuration. This requirement includes extensive and direct experience with multiphoton microscopes and laser systems. Due to the modularity of the system, the specific hardware configurations, intricate optical alignment and complete software integration that are unique to our system, Nikon is the only acceptable provider of the service contract. Additionally, all service performed on the microscope must be done by Nikon to preserve our ability to later upgrade the system with Nikon components and have those additional components and capabilities appropriately integrated into our existing system and maintained under warranty. Contractor requirements: 1. Scope: Contractor will provide labor, materials and equipment to provide maintenance for the listed Nikon A1R MP microscope. All maintenance will be performed in accordance with the manufacturer�s standard maintenance policies. A1R MP Scanner Module S/N:�30601 LUN4 Laser Fixture S/N:�40230 LU Controller S/N: 455195 Detector Unit S/N:�59163 NIS Software updates 2. Response time: Upon receiving a maintenance request contractor will provide an emergency response time between 9:00 am and 4:30pm EST, excluding Federal holidays, weekends, acts of nature and other conditions beyond the contractor�s control. Contractor will respond to maintenance requests within 24 hours to schedule an on site service call. �Contractor will provide factory-trained service representatives to inspect equipment and perform all necessary repairs to restore functionality to normal operating conditions. 3. Replacement parts: The contractor shall provide all necessary replacement parts at no additional cost to the Government, with the exception of items deemed to be consumables. Parts shall be new or remanufactured to the original equipment specifications. 4. Personnel qualifications: Any service representative performing maintenance under this contract shall be factory trained and have previous, direct and in-field, experience in servicing the aforementioned instrumentation.� 5. Service exclusions: The contractor shall not be responsible for any repairs necessitated by abuse, neglect, vandalism, Acts of God, fire or water.� These repairs shall be the subject of a separate purchase order and shall not be performed under this contract.� 6. Period of performance: � � � �12/23/2021 � 12/22/2022 Closing Statement: This notice is not a request for competitive proposals.� However, interested parties may identify their interest and capability to respond to this notice.� Responses to this notice shall contain sufficient information to establish the interested parties� bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size.
