Description

This special notice is in accordance with FAR 5.2, Synopses of Proposed Contract Action.�This Notice of Intent is not a request for competitive quotes. This is not a solicitation or request for quote. The USDA-ARS National Animal Disease Center (NADC) in Ames, IA has a need of preventative maintenance, on demand emergency support/repair, and telephone support service contract for an Orbitrap Exploris 240 Basic System w/ IC (SN: MM10042C). USDA-ARS MWA Office in Peoria, IL intends to make a sole source award to Thermo Electron North America LLC (part of Thermo Fisher Scientific). Thermo Fisher Scientific has provided a letter in which they have stated they are the sole source manufacture and service provider for the piece of equipment as well as LCMS, proprietary parts, training, technical support, field service support, and software. The vendor goes on to state that they have proprietary rights to the equipment which includes performance verified component parts, spare parts, software, technical support, upgrades and engineering resources to maintain the original operating specifications for the equipment that requires service coverage. In addition, the vendor also states that their Service Engineers (FSE�s) are the only company certified and factory trained engineers available to service the piece of equipment and are part of an organization that is ISO certified. Because of the information outlined above it is firmly believed that no other vendors are available that can provide the service coverage required for the piece of equipment and were a solicitation issued requesting the submission of quotes that only a single quote would be received from the aforementioned vendor: Thermo Electron North America LLC (part of Thermo Fisher Scientific). This purchase will be made utilizing Simplified Acquisition Procedures in accordance with: Federal Acquisition Regulation 13.106-1(b)(1) For purchases not exceeding the simplified acquisition threshold. (i) Contracting Officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deems only one source reasonably available. NAICS code for this requirement will be 811219, Other Electronic and Precision Equipment Repair and Maintenance, with a small business size standard of $22.0 million. The PSC code for this requirement will be J066. No solicitation or solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested vendors that are capable of providing the specified services are invited to submit responses to the Government for consideration. Interested parties may identify their interests and capability to respond to this requirement by no later than Monday, November 8, 2021 (11/08/2021) at 5:00PM (CST). Any submission in response to this notice must show clear and convincing evidence as well as be in sufficient enough detail to show that they can provide the specified product and that competition would be advantageous to the Government. Information received will be considered solely for the purpose of determining whether or not to conduct a competitive procurement. This notice is for informational purposes only. Responses received shall be considered by the agency; however, determination by the Government whether or not to compete this proposed award upon response to this notice is solely within the discretion of the Government. No reimbursement for any cost connected with providing capability information will be provided.
