- VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020 DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: Contracting Activity: Department of Veterans Affairs, VISN 02, New York Harbor Healthcare System, 423 East 23rd Street, New York, NY 10010. Services are for Brooklyn Campus and St. Albans Campus. Requisition Number: Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The services required to meet the Agency s needs are for environmental cleanup of hazardous and nonhazardous waste disposal associated with a necessary response to recent flood damage from Hurricane Aida. The basement flooding damage cleanup are for Brooklyn VAMC Pharmacy Service emergency cache, elevator hydraulic room and radiation oncology and St. Albans Laundry facility for cleanup of waste laundry chemicals. The cleanup is urgently needed to allow for facility repairs and to ensure that Facilities are in regulatory compliance. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This is a request for a statutory Authority Permitting Other Than Full and Open Competition to a verified Serviced-Disabled Veteran Owned Small Business for the procurement of this urgent and one-time of hazardous and nonhazardous clean up, pick up and disposal services. The recommended source is a SDVOSB which currently has a contract with the facility for routine disposal of hazardous/nonhazardous regulated waste streams. The recommended vendor has a thorough understanding of the facility and has already successfully developed Environmental Protection Agency (EPA) hazardous waste profiles (necessary by law in order to accept the waste for disposal) unique to the facility. Vendor is currently performing similar services as the incumbent for Regulated Non-Medical Wasted Pick Up, disposal and recycling services under contract XXXXX and Sharps and Regulated Medical Waste pick up and disposal under contract XXXXX for the requesting VA Medical Center which includes all three campus. Set The Standard, LLC, a SDVOSB concern has been determined to be a responsible source with respect to performance. The anticipated award price of the one-time service will not exceed $79,440.00 and in the estimation of the contracting officer, this one-time service can be made at fair and reasonable price that offers best value to the Government. Set The Standard, LLC meets the eligibility requirement prescribed in VAAR 819-7007. Vendor is 1) Registered as a SDVOSB in VIP Database 2) A Small Business concern under the NAICS Code 562112 3) Vendor s offered price is fair and reasonable. A search in FPDS for contracts awarded in FY 2021 to Set The Standard, LLC for Hazardous Waste ranged from $128,424.00 to $311,400.00. Vendor s offered price of $79,440.00 for this requirement is fair and reasonable. Description of market research conducted and results or statement why it was not conducted: Market search was previously conducted for Acquisition Plan 36C242-21-AP-1714. The procurement strategy ended as full and open competition which resulted in the award of contract 36C24222P008 to Set The Standard LLC. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
