Description
In June 2020, NASA posted a Request for Information (RFI) on NASA�s Private Astronaut Mission (PAM) Liability Framework and later held a PAM Liability Forum.� Based in part on the feedback provided in response to the RFI, NASA has further refined its proposed commercial spaceflight liability framework and seeks additional feedback from industry on the updated approach as well as insight into insurance and liability challenges for future commercial activities in Low Earth Orbit (LEO).� At this point, NASA respectfully requests information or other feedback regarding NASA�s commercial spaceflight liability requirements and the clauses drafted to implement them for current and future activities.� More specifically, NASA seeks information regarding the following topics: availability of insurance for future commercial spaceflight activities (e.g., PAM and Commercial LEO Destination (CLD) activities), coverage amounts available on the market, likely premiums (ranges are acceptable), other coverage types available on the market, e.g. possibility of a standard policy to cover all aspect of a PAM alternative means of covering similar risks, and any other information or feedback you think would be useful to NASA. In particular, NASA seeks responses to the enclosed list of questions (Attachment 1). To enable you to provide meaningful feedback, please also find the following information that NASA is currently relying on: proposed liability clauses and cross-waiver language for commercial spaceflight liability (Attachment 2), a summary of key responsibilities of NASA and PAM Providers (Attachment 3); private astronaut mission overview, including provider responsibilities, approved activities, precluded activities, etc. (Attachment 4); and Draft Space Act Agreement (SAA) language for Phase 1 CLDs (Attachment 5). When providing your response, please keep in mind NASA�s goal of facilitating the development of a commercial marketplace in LEO while also protecting the safety of Government property and personnel. This is a request for information only. It is not a procurement, commitment to procure items or services, or request for proposals. NASA will not reimburse any costs incurred for preparation or submission of information in response to this RFI. NASA reserves the right to share all information received in response to this RFI throughout NASA and to use all information submitted in response to this RFI in NASA's formulation of the liability framework for Private Astronaut Missions. NASA does not wish to receive any competition sensitive data that requires protection. However, if it is necessary to submit competition sensitive data to answer any of the questions in this RFI that data should be clearly segregated and marked as sensitive. Although information contained herein represents current program content and acquisition planning, it is subject to change. The Government may choose to modify the clauses or requirements, either wholesale or through individual contract negotiations.� Further, NASA does not have authority to regulate and intends to impose liability, insurance, and other requirements solely through contract or agreement.
