Attachment 1: Request for SDVOSB/VOSB Sole Source Justification Format >SAT VHAPM Part 819.7007/7008 Page 1 of 6 Original Date: 08/30/2017 Revision 03 Eff Date: 04/03/2020 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID: 36C260-22-AP-0302 Contracting Activity: Department of Veterans Affairs, Veterans Healthcare Administration, Regional Procurement Office West, Network Contracting Office 20 on behalf of the Boise VA Medical Center, Laboratory (113), 531-22-1-030-0010. Nature and/or Description of the Action Being Approved: The Boise VA Medical Center has a request for an emergent bridge contract to provide courier services to transport laboratory specimens, medical and other supplies and pharmaceuticals from the Mountain Home, Twin Falls and Caldwell Community Based Outpatient Clinics (CBOCs) to the Boise VA Medical Center Lab, Radiology and Pharmacy services. The courier service is also required to transport supplies, specimens, non-controlled pharmaceuticals, and diagnostic medical information to and from local community medical facilities, and to patient homes within a 250-mile radius of BVAMC at 500 W. Fort St., Boise, Idaho 83702. The estimated cost of this is $138,434.04 for the base period, and $276,876.08 for the life of the proposed contract. Description Period of Performance Cost Base Period 12/01/2021 05/31/2022 $138,434.04 Option Period (52.217-8) 06/01/2022 11/30/2022 $138,434.04 Total $276,876.08 Description of Supplies/Services Required to Meet the Agency s Needs: BVAMC requires a courier service to transport medical specimens, pharmaceuticals, medical diagnostic images and medical supplies to and from Community Based Outpatient Clinics (CBOCs). Courier service is also required to transport supplies, specimens, non-controlled pharmaceuticals, and diagnostic medical information to and from local community medical facilities, and to patient homes within a 250-mile radius of BVAMC at 500 W. Fort St., Boise, Idaho 83702 as well as round trip service to the following locations: Caldwell CBOC Idaho Neurological Institute Twin Falls CBOC Idaho Pulmonary Associates Mountain Home CBOC Imaging Center of Idaho Salmon CBOC Intermountain Medical Imaging Burns CBOC Mountain States Tumor Institute St. Alphonsus Regional Medical Center Mercy Medical Nampa (includes St. Al s Eagle Neuroscience Associates) St Luke s Healthcare Facilities Shoulder Clinic of Idaho (includes St Luke s West Spine Institute of Idaho) Advanced Open Imaging Boise Valley Asthma West Idaho Orthopedics & Sports Medicine Cancer Center of Idaho West Valley Medical Center Digestive Health Clinic Health Quest Chiropractic Elks Rehabilitation Vibra Hospital Genesis Health Care Digestive Health Clinic Other facilities within a 250-mile radius of BVAMC Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below: (X ) 819.7007 Sole source awards to a verified service-disabled veteran-owned small business; or ( ) 819.7008 Sole source awards to a verified veteran-owned small business Demonstration that the Contractor s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): BVAMC has a current contract, VA260-17-D-0030, with all options exhausted that ends November 30, 2021. This contract was awarded to FG Management Group, LLC, a Service-Disabled Veteran Owned Business (SDVOSB). Any break in service will result in serious injury, financial and other, to the Department of Veteran Affairs. A bridge contract will be awarded to FG Management Group, LLC until a permanent solution can be worked. IAW FAR 6.302-2 the Contracting Officer has determined that the circumstances of the contract deem that there is an unusual and compelling urgency that precludes full and open competition; and, any delay in the award of the contract would result in serious injury, financial or other, to the Government. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies: None. Notice is not required IAW 5.202(2). Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost to the Government is consistent with past prices paid on existing contract VA260-17-D-0030. Trip rates quoted for 12/01/2021 05/31/2022 stay the same as the prices quoted for the time period of 06/01/2021 11/30/2021. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A search of VIP and SBA indicated that there are 34 VIP results and 231 SBA results. The prior contract was competed as an SDVOSB set aside. Additionally, courier contracts for other VAMC s indicate that courier services have been provided by SDVOSBs. the current contract ends 11/30/2021. While market research indicated that there are small business concerns available, any delay in the award of the contract would result in serious injury, financial or other, to the Government. Therefore, it is in the best interest of the Government to award a bridge contract to the current SDVOSB vendor, FG Management Group, LLC. Any Other Facts Supporting the Use of Other than Full and Open Competition: IAW VAAR 819.7007, the contracting officer may award contracts to SDVOSB concerns on a sole source basis provided; (1) The anticipated award price of the contract (including options) will not exceed $5 million; (2) The requirement is synopsized in accordance with FAR part 5; (3) The SDVOSB concern has been determined to be a responsible contractor with respect to performance; and (4) Award can be made at a fair and reasonable price. The estimated cost of this is $138,434.04 for the base period, and $276,876.08 for the life of the proposed contract. FG Management Group, LLC, a Service-Disabled Veteran Owned Business (SDVOSB), has been determined to be a responsible source with respect to this contract opportunity based on past performance evaluations on contract VA260-17-D-0030. Additionally, the contracting officer has determined that this award will be made at a fair and reasonable price that offers the best value to the Government. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: FG Management Group, LLC, a Service-Disabled Veteran Owned Business (SDVOSB), is currently providing this service to BVAMC and provided a quote for services. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: This contract is a six-month bridge contract with the possibility to extend up to an additional six-months should 52.217-8, Option to Extend Services be exercised. The Network Contracting Office (NCO) 20 Ancillary Patient Care (APC) team is currently working with BVAMC to find a more permanent solution. This bridge contract will allow sufficient time to promote competition and remove barriers to competition before making a subsequent acquisition for the service required.
