- 2 Solicitation number 36C25722Q0086 is issued as a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular. SET-ASIDE: This requirement is a Service Disable Veteran Owned Small Business and Veteran Owned Small Business Set-Aside, the NAICS is 561612 and the small business size standard is $22.0M. In order to be eligible an offeror must be small for the applicable NAICS code at the time of the quote submission and at the time of award. Only qualified offerors may submit bids. Description of Services: The Contractor shall provide all personnel, supervision, transportation, equipment as outlined in the Statement of Work. See the Statement of Work for full details. Place of Performance: Department of Veterans Affairs Medical, Amarillo Health Care System, 6010 Amarillo Blvd, Amarillo TX 79106 Type of Contract: A Firm Fixed Price Base Period of Performance: Base: January 1, 2022 thru December 31, 2022 Option Year 1: January 1, 2023 thru December 31, 2023 Option Year 2: January 1, 2024 thru December 31, 2024 Option Year 3: January 1, 2025 thru December 31, 2025 Option Year 4: January 1, 2026 thru December 31, 2026 VHA Procurement Policy Lightning Bolt 22-01: VHA Supplemental Guidance for Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors Purpose: The purpose of this Lightning Bolt 22-01 dated October 11, 2021 is to inform VHA Contracting Officers (COs) of the additional requirements necessary to implement Adequate COVID-19 Safety Protocols for VHA Contractors. Background: Executive Order (E.O.) 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors, issued on September 09, 2021, requires agencies to include a clause in applicable contracts requiring contractors and subcontractors at any tier to comply with all guidance for contractor workplace locations as published by the Safer Federal Workforce Task Force (Task Force Guidance). The clause applies to applicable solicitations and contracts. E.O.14042 also directed the Federal Acquisition Regulatory Council (FAR Council) to develop a contract clause requiring contractors and subcontractors at any tier to comply with all guidance for contractor or subcontractor workplace locations published by the Task Force. As a result of that direction, Class Deviation From the Federal Acquisition Regulation Regarding Implementation of Executive Order 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors was issued on September 30, 2021 with the new FAR Clause 52.223-99 Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors. VA then promptly issued Class Deviation from the Federal Acquisition Regulation Regarding Implementation of Executive Order 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors (VIEWS 06042621) on October 1, 2021 to implement E.O. 14042. Applicability: This guidance applies to all existing and new solicitations and contracts over the micro-purchase threshold for services, construction, real estate leases, and other contracts that aren t solely for providing products regardless of when the contract was awarded or the option exercised/extended. This guidance does not apply to contracts for products (i.e., office supplies). Required Action: Effective immediately, VHA Contracting Officers (COs) are required to take additional steps to ensure VHA Contractors comply with the Safer Federal Workforce Task Force (Task Force Guidance): In addition to the criteria outlined in the VA s Class Deviation, VHA COs are required to do the following: Modify existing contracts and amend solicitations to add FAR Clause 52.223-99 which requires Federal Contractors to comply with Safer Federal Workforce Task Force (Task Force Guidance). The clause is located on pages 3-4 of the VA s Class Deviation. In addition to adding the clause, COs must also update applicable Statements of Work/Performance Work Statements, etc., to add the contract language below. The scope of the modification is solely to add the clause and contract language. VHA Supplemental Contract Requirements for Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors Contractor employees who work in or travel to VHA locations must comply with the following: Documentation requirements: If fully vaccinated, shall show proof of vaccination NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination If unvaccinated and granted a medical or religious exception, shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor s order or an FDA approved over-the-counter test. Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel. Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols.
