- DIA - Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors� Reference: Under Secretary of Defense Memorandum, �Notice of DoD Class Deviation 2021-O0009, �Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors,� dated October 1, 2021. Date: 1 December 2021 The purpose of this notification is to direct your attention to the referenced memorandum, which establishes clause 252.223-7999, �Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors (Deviation 2021-O0009)�. A copy of the memorandum is attached. Vaccination Requirement:� The required date for DIA covered contract personnel to be fully vaccinated no later than January 18, 2022, in compliance with the Safer Federal Workforce Taskforce guidance. Certification of Vaccination form:� All contractor personnel performing at a federal workplace must have on their person a completed and signed DD Form 3150, Certification of Vaccination form effective immediately.� This form shall be provided to any guard or Government Official at their request. COVID Testing:� Beginning December 6, 2021, contractor personnel who are unvaccinated or decline to attest to their vaccination status must provide proof of a negative COVID-19 test administered within the last 72-hours. DIA will insert the subject deviation clause as prescribed in the memorandum. Additionally, and in accordance with Executive Order 14042, the Safer Federal Workforce Task Force Guidance, and the referenced memorandum, DIA intends to incorporate this deviation clause via bilateral modification into all existing service contracts, task orders, and delivery orders performed in whole or in part within the United States or its outlying areas, except for those below the Simplified Acquisition Threshold. DIA is issuing this mass modification to meet the 18 January 2022 goal for contractor employee vaccinations, as specified in EO 14042 and the Taskforce guidance, and pursuant to FAR 43.103(a)(3) or FAR 52.212-4(c), as applicable. Signing this modification does not supersede any rights provided for under other contract terms and conditions. Instructions for these bilateral modifications are outlined in the following paragraphs. Contract Modification Timeline: By 4 January 2022, DIA intends to bilaterally modify existing contracts, task orders, and delivery orders for services (including construction) with an active period of performance, performed in whole or in part within the United States or its outlying areas to add clause 252.223-7999. Existing contracts, task orders, and delivery orders below the Simplified Acquisition Threshold or for licenses and the manufacturing of products are currently exempt from this modification; however, DIA reserves the right to add the clause at a later time. Contract Modification Instructions: Attached to this announcement is a mass contract modification form (SF30). To expedite this action, it is DIA�s intention to fully execute one modification for each prime contractor by referencing all affected DIA contract numbers in block 10A of the SF30. DIA is requesting each prime contractor to provide a list of affected DIA contracts that will be referenced in block 10A of the SF30. For each applicable modification, contractors shall complete sections 8 and 15A of the SF30 and sign/date sections 15B and 15C. Return a signed copy of the SF30 to va_contracting_activity_actions@dodiis.mil for bilateral execution by a DIA Contracting Officer. A DIA Contracting Officer will apply the modification number in block2 and the applicable contract number in block 10a per the contractors list.� A DIA contracting officer with then sign the modification and a fully executed copy of the modification will be returned to the contractor shortly thereafter. Contractors are reminded to review the Frequently Asked Questions on the Safer Federal Workforce website https://www.saferfederalworkforce.gov/contractors/.� DIA appreciates your continued partnership and assistance as we implement this new guidance.
