INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME)The National Institute on Drug Abuse (NIDA), Office of Acquisition (OA) intends to negotiate on behalf of the National Center for Advancing Translational Sciences (NCATS) on a sole source basis with Leica Microsystems Inc., �for an annual maintenance service agreement for a SP8 Liachroic IR confocal microscope. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 811219 Other Electronic and Precision Equipment Repair and Maintenance with a Size Standard of $22.0M. � REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures. Contracts awarded using FAR Part 13�Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6�Competition Requirements. FAR Subpart 13.106-1(b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2021-07 dated September 10, 2021. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION Leica Microsystems, as the authorized partner of Leica SP8 Liachroic IR confocal microscope equipment and software, is the only contractor authorized and capable of providing the necessary maintenance support service to the Leica SP8 Liachroic IR confocal microscope because the equipment and software are proprietary. Leica Microsystems is the only source for factory trained and certified technicians to maintain and service the equipment and the software. The equipment requiring maintenance is continually used for research purposes. Non-functional equipment, inappropriately calibrated equipment, or equipment with incorrect parts, software updates, or other unsupported service provided by a non-authorized vendor, would void data standardization and cause irreparably damage to NIH research data. Furthermore, use of any other contractor for maintenance would void equipment warranties and jeopardize system integrity and functionality. Only an OEM-authorized service provider has access to the latest services and support information. Replacement parts or accessories must be compatible with the existing equipment and software, and only Leica Microsystems can certify compatibility. An OEM-authorized service provider is the only source with direct access to these parts and labor. Leica Microsystems is the only source authorized by the OEM to provide maintenance services for this equipment and software. Because of the significant investment by NCATS in the purchase of this equipment and software, using an OEM-Authorized Service Provider is essential for maintaining the integrity of the system. In accordance with FAR part 10, extensive market research was conducted to reach this determination. Specifically, contact with knowledgeable individuals both in industry and Government, as well as reviews of available product literature, revealed no other sources. A review of the GSA Advantage, Dynamic Small Business Search, and previous Government acquisitions returned no results that meet all requirements. A letter from the OEM confirmed that Leica Microsystems is the only OEM-authorized service provider for this equipment. Therefore, only Leica Microsystems, is found to be capable of meeting the needs of this requirement. DESCRIPTION OF REQUIREMENT PURPOSE AND OBJECTIVES: The National Center for Advancing Translational Sciences (NCATS) requires a service agreement (maintenance/repairs) for a SP8 Liachroic IR confocal microscope. The NCATS Chemical Genomics Center (NCGC) is tasked with identifying and developing novel small molecule leads against a wide spectrum of human disease targets, which it accomplishes by screening thousands of small molecules in collaboration with both intra-and extramural researchers. In pursuit of this goal, the Center has a strong internal transdisciplinary team of scientists who continually discover novel small molecules and develop novel disease models for application against a wide range of human diseases.� As such, discovering probe molecules and developing human disease models that could serve as starting points for therapeutics is of great interest within NCATS. NCATS started several projects developing tissues of human disease models using 3D bioprinting technology. As a tool for validation of 3D microstructure, a Leica confocal/two photon system (S/N 8100001594) has been installed at 9800 medical center Dr. Rockville, MD 20850. The Leica system has provided high quality of images for optimization of bioprinting process, validation, and quality controls. The services requested here are fee for service testing that will provide insight on efficacy across many types of engineered tissues and will help progress and provide critical scientific guidance on projects that NCATS has been working on for many years. SPECIFIC REQUIREMENTS: Independently and not as an agent of the Government, the Contractor shall furnish all the necessary services, qualified personnel, material, equipment, and facilities, not otherwise provided by the Government as needed to perform the Statement of Work include hardware and software preventative maintenance and operations and hardware support.� DELIVERY OR DELIVERABLES: The Contractor shall perform preventative maintenance service and necessary repair service and suggest further maintenance as needed and as described under the specific requirements in this Statement of Work. Detailed reports of service performed will be provided. PERIOD OF PERFORMANCE: The expected period of performance shall include one 12-month base period and four 12-month option periods. The anticipated period of performance is: Base Period: 12/30/2021 � 12/29/2022 (12-months) Option Period One (1): 12/30/2022 � 12/29/2023 (12-months) Option Period Two (2): 12/30/2023 � 12/29/2024 (12-months) Option Period Three (3): 12/30/2024 � 12/29/2025 (12-months) Option Period Four (4): 12/30/2025 � 12/29/2026 (12-months) CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, Leica Microsystems is the only vendor in the marketplace that can provide the services required by the NCATS. The intended source is: Leica Microsystems Inc. 1700 Leider Lane Buffalo Grove, IL 60089 CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. All responses must be received by the closing date and time of this announcement and must reference the solicitation number, 75N95022Q00046.
