- INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institutes of Health, Eunice Kennedy Shriver National Institute of Child Health and Human Development (NICHD), Office of Acquisitions (OA) on behalf of the on behalf of the National Institute of Digestive, Diabetes & Kidney Diseases intends to award a purchase order without providing for full and open competition (Including brand-name) to PHILIPS MEDICAL SYSTEMS NORTH AMERICA INC for a service agreement for the maintenance of the NIDDK MRI machine. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811219 with a Size Standard of $22.0. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular 2022-01 Effective December 6, 2021. This acquisition is conducted under the procedures as prescribed in FAR subpart 13�Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($250,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of 41 U.S.C. 253(c) under provisions of the statutory authority of FAR Subpart 6.302- FAR 6.302-1�Only one responsible source and no other supplies or services will satisfy agency requirements 41 U.S.C. 253(c)(1). PERIOD OF PERFORMANCE 01/04/2022 to 01/03/2023 Place of Performance National Institutes of Health� National Institute of Digestive, Diabetes & Kidney Diseases� 10 Center Drive Bethesda, MD 20892 � ? DESCRIPTION OF REQUIREMENT The NIDDK Biomedical and Metabolic Imaging Branch�s research is focused on improving and developing new medical imaging methods that would give more information about the health of the heart, liver and other organs in people who might have problems with their metabolism such as obesity. The branch aims to develop noninvasive imaging approaches with high spatial (micro-millimeter) and temporal (milliseconds) resolution that allow multi-organ evaluation and analysis to better understand the interplay between atherogenesis and metabolic syndrome in humans. This is being achieved through new chemical spectroscopic techniques of involved organs (e.g. liver, heart and muscles) and improved imaging methodologies such as the development of free breathing methods (important for kids and adolescents) and high contrast techniques without the use of contrast agents.� As part of the NIH obesity initiative, Dr. Gharib and his team have integrated the use of a large bore high magnetic field MR scanner with the use of a metabolic unit to characterize metabolic activity in subjects with a wide range of body mass indexes. An improvement and technical advancement in MR spectroscopy, developed by the lab, has also been applied to measure the fat in the heart, liver, pancreas, and muscles, and to correlate measurements with metabolic activity. The capability to measure more than just fat (glycogen and choline) in the liver is unprecedented using proton spectroscopy. The opportunity to look at metabolites such as liver glycogen and choline opens the door for better understanding of lipid and glucose metabolism under a more controlled environment of a metabolic unit. Additionally, the introduction of new techniques for liver fibrosis assessment in these subjects using a high magnetic field and internal cardiac pulsation allow for more comprehensive and early detection. Finally, these various novel MR techniques are modified and applied in a wide range of age groups using free breathing (vs. conventional breath-hold methods) which is more comfortable and sustainable for patients enabling longitudinal studies in human subjects.� The current NIDDK 3T MRI scanner is an integral resource that provides multiple, valuable, non-routine services via the BMIB to the NIDDK community. These services, including magnetic resonance spectroscopy to measure tissue triglyceride or glycogen content, liver elastography for fibrosis and inflammation, coronary atherosclerosis imaging surrogates, brown adipose tissue quantification, and others, are not otherwise available. These techniques generate clinical research measurements that are key primary and secondary endpoints of numerous clinical studies both ongoing and planned in the NIDDK and other NIH institutes. Furthermore, many of these techniques have become standard measures in our respective fields and performing studies without them significantly limits the impact and ability to publish these studies. If the scanner is not working properly, these non-routine research services may not be available. Specifically, if investigators can no longer access these techniques at NIH, approximately 30 studies (from various ICs; NIDDK, NIAID, NICHD, NHLBI) would fail to reach completion and publication. Should this occur, our investment in their success, including financial and investigator resources, as well as the altruism and risk sustained by research subjects, would be wasted. Additionally, loss of our current capabilities will drastically reduce our ability to develop new state-of-the-art imaging techniques. Maintaining the 3T MRI scanner will allow our current robust program to remain productive and will allow for significant metabolic imaging advances and improvements. These include techniques not currently available, such MRS for phosphorus, sodium imaging, temperature mapping, inflammation imaging, functional neuroimaging and new software for online image analysis. � The availability of the Philips 3T scanner is mission critical. To satisfy our need of constant availability, a company is needed with the necessary technical knowledge, engineers, and available parts to keep the instruments functioning and to execute any necessary adjustments or repairs. The company must also perform annual Preventative Maintenance, including proactive monitoring. All MRI machines comes with a protection service plan for only the first year. After that year, such service plan is purchased yearly by all customers. The current warranty on this MIR machine will expire on January 3, 2022. Thus, the purchase of a service agreement for the maintenance and repairs of the NIDDK MRI machine is needed to protect the integrity and usability of the MRI without interruption. _________________________ PURPOSE AND OBJECTIVES The National Institutes of Health (NIH)�s National Institute of Diabetes and Digestive and Kidney Diseases (NIDDK) has a requirement for a service agreement for the maintenance of the NIDDK MRI machine. � To protect the integrity and usability of the MRI without interruption, we require support to be provided within 4 hours after initial contact. This service contract also provides proactive monitoring and one Preventative Maintenance Service visit, which is crucial for the long-term, successful use of this highly used instrument. � SALIENT / REQUIRED FEATURES AND SPECIFICATIONS Specifically, the NIDDK requires the following: The service agreement must include the following: 1.�� �Vendor�s response expected within one hour of initial contact 2.�� �On-site support expected within four hours of initial contact 3.�� �Unlimited Technical Services (24x7) & Clinical Applications Telephone Support (Mon?Fri 8am ? 9pm) 4.�� �Operating system software enhancements� 5.�� �Remote service support and proactive monitoring 6.�� �Annual preventative maintenance visit (includes travel, expenses, labor, replacement parts, and on-site repair) 7.�� �The vendor must have a demonstrated track record of maintaining and repairing the Philips Ingenia Elition 3T scanner. If an engineer needs to visit the site, this is expected to occur within 2 working days from identification of the issue(s). 8.�� �For preventative maintenance and repair calls, the vendor must provide engineers with demonstrated track records of maintaining and repairing the Philips Ingenia Elition 3T scanner. 9.�� �Genuine Philips Ingenia Elition replacement parts. TASKS AREAS Independently, and not as an agent of the Government, the contractor shall perform all of the detailed Task Areas listed below: Task Area 1 � This is a maintenance service plan and relies on the vendor for constant maintenance and repairs as needed, as well as a support service line for remote technical assistance. Task Area 2 � Vendor will provide their initial response within one hour after contact and on-site support within 4 hours. The vendor will perform one scheduled Preventative Maintenance at the request of the government. This work will be provided during regular business hours on regular business days. The instrument will be serviced where it is located in the NIH Clinical Center Radiology and Imaging Sciences (RADIS) Department. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10�Market Research. �Only one source is available: Per FAR 13.106-1(b)(1) the Contracting Officer has determined PHILIPS MEDICAL SYSTEMS NORTH AMERICA INC to be the only reasonable available source to provide a service agreement for the maintenance of the NIDDK MRI machine. �� This acquisition was pursued on a sole source basis centered on the fact that Philips Healthcare is the manufacturer and provider of maintenance service for the Philips Ingenia Elition 3T X MRI scanner. Philips Healthcare does not certify third party organizations to perform service on its instrumentation in the United States, and as the original manufacturer, they can ensure the supply of spare or replacement parts, which are unique to the MRI scanner. When an instrument is covered by a Philips Healthcare service agreement, Philips Healthcare is the only provider that can supply instrument software revisions along with preventative maintenance inspections, technical telephone consultations, and unlimited on-site service visits. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties� bona-fide capabilities for fulfilling the requirement and include: descriptive literature, delivery timeframe, warranties and/or other information that demonstrates that the offer meets all the foregoing requirements, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.� A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
