- Description
- This contract action is for the acquisition of supplies for which the Government intends to solicit and negotiate with only one source under the authority of Federal Acquisition Regulation (FAR) Subpart 13.106-1(b)(1). The National Institute of Environmental Health Science (NIEHS), Office of Acquisitions (OA) intends to award a single source purchase order to FEI Company, 5350 N.E. Dawson Creek Drive, Hillsboro, OR 97124-5793, for the acquisition of a maintenance contract for a FEI-Tecnai 12 BT. The FEI-Tecnai 12BT, Serial #D331, is needed to view the ultrastructure of biological tissue samples for pathology support. The maintenance contract for this instrument is needed in the event of unexpected breakdowns of the instrument. Without the proper functioning of the FEI Tecnai 12 BT, the Comparative & Molecular Pathogenesis Branch (CMPB), will be unable to carry out the Pathology support that the Electron Microscopy (EM) laboratory provides for the research of the investigators at NIEHS. This maintenance contract will provide 4-hour targeted telephone support, 48-hour targeted onsite labor response, unlimited labor hours (including travel time and expenses), all necessary spare parts (including all accessories listed on the contract), replacement FEG tip (for applicable products), one preventive maintenance visit (per year) and software updates. FEI Company is the manufacturer and sole distributor for this instrument and parts, thereby not allowing third party entities to service their equipment. The applicable North American industry Classification System (NAICS) code for this procurement is 811219 �Other Electronic and Precision Equipment Repair and Maintenance.� Its associated Business Size Standard is $22.0. (This requirement is for the Base +4 Option Years) Base Period: January 17, 2022-January 16, 2023 Option Period 1: January 17, 2023-January 16, 2024 Option Period 2: January 17, 2024-January 16, 2025 Option Period 3: January 17, 2025-Janaury 16, 2026 Option Period 4: January 17, 2026-January 16, 2027 NIEHS will solicit and negotiate directly with FEI Company, and no solicitation will be issued. This notice of intent is not a request for competitive proposals or quotations; however, all responsible sources may submit a capability statement which shall be considered by the agency. Offerors must have an active registration in the System for Award Management (SAM.GOV) www.sam.gov. A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government.
