Description
NOTICE OF INTENT TO SOLE SOURCE This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart 5.101(a)(1) requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source contract, and is not a request for competitive quotes/proposals. The statutory authority for this sole source procurement is prescribed by FAR 13.106-1(b)(1). The Department of the Air Force intends to issue a one-year, firm fixed priced sole source award contract to Tel-Star Technologies. However, all responsible sources may submit a capability statement demonstrating the ability to provide the requested services, which shall be considered by the agency before the intended award date. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. The Government shall not reimburse interested sources for any information provided. No requests for capability briefings will be honored. A draft Justification and Approval has been attached to this notice for public consideration. A final determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Interested vendors must respond to this notice on or before 14 January 2022 at 12:00pm Central Standard Time by sending an email to Nichole.Ray.1@us.af.mil. This is a Sole Source Synopsis published for informational purposes only. A Sources Sought was posted to sam.gov.� This proposed action is for the procurement of preventative maintenance on all the audio/visual equipment to include computers in the biz hub and cybrary located in the Medical Education and Training Campus (METC) Student Activity Center on JBSA FSH, TX. Please see Attachment 1, Performance Work Statement and Attachment 2, draft Justification and Approval (J&A). The Government intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b)(1). This proposed procurement will be a Sole Source under North American Industry Classification System Code (NAICS) 811211, Consumer Electronics Repair and Maintenance. Business size standard for NAICS 811211 is $8M. PSC/FSC code: DA10: IT and Telecom - Business Application/application Development Software as a Service. The proposed source is Tel-Star Technologies, located at 297 Vesper Rd, Canyon Lake, TX 78133. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. This notice of intent is not a request for competitive quotations. However, all responsible sources may submit a capability statement, proposal, quotation or exception to the intent to purchase on a sole source basis, which shall be considered by the Government, if received by Friday, 14 January 2022, 12:00 P.M. CST. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. In order to comply with FAR 5.207(c)(15), the reason for lack of competition is as follows: The in-place system is an amalgamation of various subsystems which communicate with one-another through meticulously designed and implemented code/programming. Tel-Star Technologies originally designed and installed the system during the Construction phase of the METC SAC facility under the guidance of the Army Corp of Engineers. The system uses proprietary programming and code that Tel-Star Technologies considers to be intellectual property. The government does not own the rights to the code nor does it own the system designs. Since this acquisition requires the contractor to replace, update, and/or maintain the system as a whole, only a firm with access to the system designs and proprietary code may sufficiently maintain the system successfully. �� Period of Performance: 7 February 2022 � 6 February 2023 Delivery Destination: METC Student Activity Center, JBSA FSH.
