Description
The U.S. Army, 409th Contracting Support Brigade (409th CSB), Theater Contracting Center (TCC), Unit 23163, APO AE 09227-3163, intends to award a sole source action for the continuation of contract services for facility operations and maintenance services, minor constructions and repair projects, grounds maintenance services and snow and ice removal services in support of the U.S. Army Garrison Rheinland-Pfalz (USAG-RP) installations of Germersheim Army Depot, AAFES Gruenstadt Depot, and Coleman Worksite. �Contract services are currently performed under contract W564KV-16-D-0008.� Estimated value of this sole source action is $8M and the period of performance is a base period of three (3) months with three (3) one-month option periods.� This sole source action allows the Government sufficient time to complete the pending source selection and to make the award for the follow-on TMC contract. �It also allows for a 90-day phase-in period to transition to the new contract. Gotay & Celeste Harper Email: roberto.j.gotaygarcia.civ@army.mil & celeste.v.harper.civ@army.mil The incumbent contract, W564KV-16-D-0008, expires on 28 February 2022. �The new TMC contract that will be awarded off of solicitation W564KV-20-R-2000 will encompass the work currently being performed under W564KV-16-D-0008. The U.S. Army is currently conducting the source selection for the follow-on contract. The solicitation for the follow-on contract, W564KV-20-R-2000, was issued on 9 March 2020 using competitive procedures promoting full and open competition and all responsible sources were permitted to compete. �Award date for the follow-on contract was previously postponed due to the impact of the COVID-19 pandemic.� The closing date of the solicitation was originally scheduled for 14 April 2020.� Due to the COVID-19 pandemic, Offerors requested an extension of the solicitation period and the date to submit questions.� The Government accommodated the Offerors� requests and issued three (3) amendments to the solicitation to extend the solicitation closing date, to provide answers to Offerors� questions, and to make the necessary changes.� The unanticipated time to receive and address questions from the Offerors delayed the solicitation closing date to 12 June 2020. �In accordance with Federal Acquisition Regulation (FAR) 15.306(d), the Government opened discussions on 23 December 2020.� On 23 February 2021, one of the Offerors filed a pre-award agency-level bid protest further delaying the source selection process and the projected contract award.� The Army Material Command (AMC) issued its decision on the bid protest on 27 April 2021.� Proposal revisions were received on 3 March 2021 and the Government amended the solicitation three (3) more times to answer Offerors� questions in response to the evaluation notices.� The Government issued Solicitation Amendment 0007 on 24 March 2021 and granted Offerors additional time until 1 April 2021 to submit their revised proposals. On 3 June 2021, the Government reopened discussions and the Offerors in the competitive range submitted their proposal revisions on 7 June 2021. The Government determined that another round of discussions was necessary and discussions letters were issued on 17 December 2021. Additionally, solicitation Amendment 0008 was issued to make changes to the Performance Work Statement (PWS) to incorporate the implementation of Army Maintenance Application (ArMA). ArMA is a web service available for customers to request maintenance services and updates through the use of their computer or mobile devices (smart phone). Final Proposal Revisions (FPRs) were received on 30 November 2021. The evaluation of the proposals revealed issues that prevented the Government from proceeding with the award decision. It was determined that the risk of not re-opening discussions could negatively impact the Government and the integrity of the procurement. Therefore, a fourth round of discussions was opened on 17 December 2021 and closes on 14 January 2022. �The Government intends to award W564KV-20-R-2000 by 28 February 2022. The follow-on contract will include a 90-day phase-in period and full performance will begin by 30 May 2022. �The sole source action is required to prevent a lapse in service from 28 February 2022 until full performance of the follow-on contract begins by 30 May 2022. �The Government contemplates a sole source action with the incumbent as the size and complexity of the requirement necessitate a 90-day phase-in period for the mobilization of equipment and materials, personnel assets, as well as the completion of background checks and other administrative procedures required for installation access purposes. �The incumbent contractor, Elektro Kr�ck GmbH, is the only source capable of beginning performance immediately to meet the Government's needs without a significant and unallowable break in service. The anticipated sole source action will be in accordance with FAR 6.302-1, Only One Responsible Source. �This Request for Information (RFI) is issued to meet the requirements in DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d).� This RFI is not a request for competitive proposals; however, responsible sources who submit a capability statement or proposal by NLT 17 January 2022, will be considered by the Agency. �A determination by the Government to compete this contract requirement based upon responses to this RFI is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
