- Notice of Intent to Sole Source Requirement The Department of Veterans Affairs, Detroit VA Medical Center, NCO 10 Contracting Activity intends to negotiate a sole source contract under Simplified Acquisition Procedures and the authority of FAR 13.106-1 Only one source reasonably available for the following items listed below. The associated NAICS code for this is 339112. The vendor will be Millar, Inc., 6001A Gulf Frwy, Houston, TX 77023. Description of requirements: MIKRO-CATH AIRWAYS PRESSURE, SINGLE PRESSURE, STERILE DISPOSABLE PRESSURE CATHETER, -3.5F, 120CM LENGTH, STRAIGHT TIP, PACK OF 5. Quantity 20 Pkg. This is a Firm-Fixed Price Procurement. It is the Government's belief that only the proposed candidate possesses the required capabilities to successfully meet this requirement. It is the Government's intention to solicit and negotiate with only this source. This notice of intent is not a request for competitive proposals. It is not a solicitation or request for offers. No solicitation package is available. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. LouAnn Gilliland Contract Specialist louann.gilliland@va.gov DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: Contracting Activity: Department of Veterans Affairs, VISN 10, Network Contracting Office (NCO) 10 is seeking Millar Sleep Research Lab Catheters, for the John D. Dingell VA Medical Center in Detroit, Michigan Research Lab. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The OEM, Millar, Inc., provides the only approved catheter that will meet the needs/requirements of the research project that involves spinal cord injured patients with sleep apnea. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Millar is the only company that manufactures a compatible catheter with our equipment and is the most trusted and verified source for airway pressure measurements in our field. This catheter is backed by many studies and gold standard in airway resistance and pressure research. Description of market research conducted and results or statement why it was not conducted: Market Research was thoroughly conducted beginning with the VIP search for SDVOSB/VOSB vendors. NAICS Code 339112 was entered into the VIP search tool, and that did provide 436 potential SDVOSB/VOSB vendors. Additionally, the key word catheter was added to the search engine using the same NAICS Code, which only provided 1 potential SDVOSB vendor. However, after contacting the OEM, Millar, Inc., it was found that these are proprietary items that are being requested and not available through any other vendor. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
