Description
NASA/ Marshall Space Flight Center (MSFC) has a requirement for the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA) program at Marshall Space Flight Center (MSFC). CERCLA provides for liability, compensation, cleanup, and emergency response for hazardous substances released into the environment and the cleanup of inactive hazardous waste disposal sites. NASA/MSFC intends to issue a sole source contract to acquire the CERCLA program services from the Alabama Department of Environmental Management under the statutory authority permitting other than full and open competition 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. On June 29, 2001, the U.S. Environmental Protection Agency (EPA), MSFC, and ADEM entered into a Federal Facilities Agreement (FFA) as required under the CERCLA program. Additionally, MSFC is also subject to a Memorandum of Agreement (MOA) with ADEM which was approved on August 25, 1995. The MOA agreement shall not expire until completion of all obligations of all parties. The Government does not intend to acquire a commercial item using FAR Part 12.��� Interested organizations may submit their capabilities and qualifications to perform the effort electronically via email to Ashley S. Pierce, ashley.s.pierce@nasa.gov not later than 12:00 AM Central Time�on February 4, 2022.� Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this acquisition on a competitive basis.� A determination by the Government not to compete this acquisition on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the Government.
