NOTICE OF INTENT to Sole Source SOLICITATION NUMBER:�NIMH-22-002895-NOI TITLE: �Neurology Journal Article Submission CLASSIFICATION CODE: T - Photo, Map, Print, Publication NAICS CODE: 513120 � Periodical Publishers RESPONSE DATE:�3/10/22 PRIMARY POINT OF CONTACT: Kyle Miller Kyle.miller2@nih.gov Phone: (301) 480-3603 DESCRIPTION: INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute of Neurological Disorders and Stroke(NINDS) intends to negotiate on a sole source basis with WOLTERS KLUWER HEALTH for publication of an online supplement authored by a Working Group of National Advisory Neurological Disorders and Stroke (NANDS) Council and NINDS staff. � NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 513120 � Periodical Publishers with a Size Standard of 1,000 employees. � REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures. Contracts awarded using FAR Part 13�Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6�Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2022-04 dated January 26, 2021. DESCRIPTION OF REQUIREMENT The NINDS is an institute within the National Institutes of Health (NIH) that conducts research into the causes, treatment, and prevention of neurological disorders and stroke. The NINDS mission is to seek fundamental knowledge about the brain and nervous system and to use that knowledge to reduce the burden of neurological disease. In support of this mission, the NINDS periodically publishes research information in peer-reviewed, scientific journals to reach the broader scientific community. This project will publish research information through articles written by a Working Group of National Advisory Neurological Disorders and Stroke (NANDS) Council and staff at the National Institute of Neurological Disorders and Stroke (NINDS) to reach the broader scientific community. The overall objective of this project is to publish a series of related articles written by NINDS staff in a reputable, peer-reviewed scientific journal. This project will last 8 months from contract award and have 12 options for additional articles. � CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION During market research, it was found that market standards for this type of publication is to give exclusive rights to publishers to both review and publish before any consideration of other journals. To be published in a peer-reviewed journal, submittors (in this case, NINDS), must agree not to have the articles under review by any other journal or to have them published by other journals. Only if an article is rejected can another journal be pursued. Therefore, the journal for submission must be chosen in advance and allowed to fully review each article to decide whether to publish the article. These articles are being submitted together as a package as they represent a related set of information that will be most useful to the scientific community if published together. With that in mind, it was found that Wolters Kluwer Health would be the best online publisher to reach the target audiences of the supplements. The intended source is: Wolters Kluwer Health 2001 Market ST STE 5 Philadelphia, PA 19103-7044 � CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. All responses must be received by the closing date and time of this announcement and must reference the solicitation number, NIMH-22-002895-NOI.
