- Special Notice Special Notice Page 3 of 3 Page 1 of 2 Special Notice *= Required Field Special Notice Page 4 of 4 Page 4 of 4 Veterans Affairs Network Contracting Office 5 (NCO 5) intends to negotiate on a sole source basis with Arthex (DUNS: 131747628) for a Firm Fixed-Price (FFP) contract. The purpose for this FFP contract is to provide an efficient procurement vehicle to for the Washington DC VA Medical Center. The FFP contract will be a base and no options. The purchase shall include orthopedic shoulder surgery instruments. The NAICS code for this contract action is 339112, Surgical and Medical Instrument Manufacturing (SBA Size Standard: 1,000 employees). The Product Service Code for this action is 6515, Medical and Surgical Instruments, Equipment, and Supplies. The required orthopedic shoulder surgery instruments must be interoperable and interchangeable with the facilities existing surgery instruments and surgical procedures. The orthopedic shoulder surgery instruments can only be provided by Arthrex Inc. due to existing shoulder surgery instruments and procedures at the facility. Arthrex Inc. is the sole provider of these specific orthopedic shoulder surgery instruments. The Department of Veterans Affairs believes that awarding the proposed contract to another source would require replacing all the current interoperable surgical instruments and procedures which would result in unacceptable delays in meeting this legal obligation, as well as substantial additional costs to the government. This notice of intent is not a request for quotations; Interested parties may express their interest by providing a capabilities statement NLT March 1, 2022 at 10:00 AM EST. The capabilities statement must provide clear and unambiguous evidence to substantiate the capability of the party to provide the required services. A determination not to compete this proposed contract upon responses to this notice is solely within the discretion of the Government. Verbal responses are not acceptable and will not be considered. When responding to this announcement, respondents should refer to Announcement 36C24522Q0284 Notice of Intent to Sole Source. If after March 1, 2022, no viable responses have been received in response to this announcement, Dept of VA shall negotiate solely with Arthrex. Any prospective contractor must be registered in the System for Award Management (SAM) in order to be eligible for award. Interested parties are encouraged to furnish information. All documents submitted will not be returned. All interested parties shall submit clear and convincing documentation demonstrating their capabilities to satisfy the requirements listed above to Contract Specialist, Jin Kim by email at jins.kim@va.gov. The capability documentation should include general information and specific technical background describing in detail the prospective contractor's capabilities and experience that will demonstrate the ability to support these requirements, including proof of training and certification for performing service support for the Arthrex Inc. orthopedic shoulder surgery instruments, as well as an authorized distributor letter from Arthrex Inc. should be submitted if you are not the manufacturer.
