- The Administrative Office of the U.S. Courts (AOUSC) and the Federal Public Defenders (FPD) intend to issue two (2) sole source modifications to AT&T Corp. Both modifications shall be issued under the authority of FAR 16.505(b)(2)(i)(B)/The Judiciary Guide Vol. 14 � 410.30.70(b) to add an Internet Data Center (IDC) relocation requirement to the current sole source fixed priced Enterprise Infrastructure Solutions (EIS) IDC task orders for the AOUSC (USCA21F4041) and FPD (USCA21F4042). The IDC relocation is required by NLT May 2024 due to IDC consolidation efforts being completed by the current IDC owner. The basis of the sole source is as follows: AOUSC and FPD utilize public facing IP addresses as a part of its current IDC infrastructure to allow the entire Judiciary (i.e., AOUSC, FPD, and court offices), as well as the public, access to a variety of critical national information technology (IT) systems housed at the IDC locations. For example, the Case Management/Electronic Case Filing (CM/ECF) system is housed at the IDC locations and is the Federal Judiciary�s comprehensive case management system for all bankruptcy, district, appellate courts, and 592 other federal court locations. CM/ECF also allows courts to accept filings and provides public access to filed documents online. CM/ECF leverages the current public facing IP addresses to ensure end-users have 24/7 access and redundancy is present between both IDC locations so that no lapse in service occurs if one of the IDC locations experiences an outage. The AOUSC and FPD require continued usage of the current public facing IP addresses to ensure critical national IT systems housed at the IDC locations remain operational throughout the IDC relocation and beyond. The public facing IP addresses utilized by the current IDC infrastructure are owned by AT&T Corp, and market research revealed they are not for purchase or transfer. Therefore, AT&T Corp is the only EIS vendor capable of fulfilling the AOUSC�s and FPD�s IDC relocation requirement by the May 2024 deadline without making changes to the current IDC infrastructure (i.e., public facing IP addresses). The determination not to compete the proposed procurement actions on a full and open competition basis is solely within the discretion of the Government. Any party interested in submitting questions or concerns regarding this notice or the Government's intent to sole source may contact the Contract Specialist, Candace Browne, at Candace_Browne@ao.uscourts.gov and the Contracting Officer, Kimeerly Fleming, at Kimeerly_Fleming@ao.uscourts.gov, by no later than 5:00 PM EST on March 11, 2022. This is not a request for quotes or proposals. The Government will not be responsible for any cost incurred by responding to this notice. Oral communications are not acceptable in response to this notice. FOR INFORMATIONAL PURPOSES ONLY: The award notice and Sole Source Justification for the AOUSC�s and FPD�s EIS IDC task orders was posted to SAM.gov on July 13, 2021. An RFI for the IDC relocation requirement was posted for all EIS vendors on November 18, 2021 via GSA eBuy. The RFI requested information from industry to help the AOUSC and FPD formulate an acquisition approach for the procurement of IDC relocation services.
