Description
***NOAA's Acquisition & Grants Office, Western Acquisition Division-Boulder, Great Lakes Environmental Research Laboratory (GLERL), intends to negotiation, on a sole source basis, under authority of FAR 13.106-1(b)(1), with ASL Environmental Sciences Inc, to purchase a spare/replacement Acoustic Zooplankton Fish Profiler for their AUV platform. To be delivered to Ann Arbor, MI. ***The sole source determination is based on the National Oceanic and Atmospheric Administration (NOAA) requirement that ASL currently has exclusive rights to manufacture the fish profiler. This specific piece of scientific equipment is required due to similar technology already utilized on a different platform. This piece of scientific equipment is a very similar fish profiler that was purchased last year (1305M321PNRMA0239). It is from the same manufacturer and has the same technology. This profiler is needed for spare/replacement parts for our current scientific technology on our AUV platform. Any other unit will not perform in alignment with specifications needed for scientific research because of the technology currently being utilized at the lab. They do not have any resellers or US subsidiaries of this proprietary supply. Per FAR 25.104 Nonavailable articles this falls under- Spare and replacement parts for equipment of foreign manufacture, and for which domestic parts are not available. So the Made in America Laws (Executive Order 14005) waiver process is not required for an individual determination. Delivery is required by June 1st, 2022. ***THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS AND NO SOLICITATION PACKAGE IS AVAILABLE. HOWEVER, FIRMS THAT BELIEVE THEY CAN FULLY MEET THE GOVERNMENT'S REQUIREMENTS MAY SUBMIT SUBSTANTIATING DOCUMENTATION IN WRITING TO THE IDENTIFIED POINT OF CONTACT WITHIN 15 DAYS AFTER PUBLICATION OF THIS SYNOPSIS. SUCH DOCUMENTATION WILL BE EVALUATED SOLELY FOR THE PURPOSE OF DETERMINING WHETHER OR NOT TO CONDUCT THIS PROCUREMENT ON A COMPETITIVE BASIS. A DETERMINATION BY THE GOVERNMENT NOT TO CONDUCT A COMPETITIVE PROCUREMENT, BASED UPON RESPONSES TO THIS NOTICE, IS SOLELY WITHIN THE DISCRETION OF THE GOVERNMENT. ORAL COMMUNICATIONS ARE NOT ACCEPTABLE IN RESPONSE TO THIS NOTICE.
