- FBO ANNOUNCEMENT: PRESOLICITATION NOTICE, NOTICE OF INTENT ACTION CODE: SPECIAL NOTICE SUBJECT: Sole source upgrades to a Resonant Soft X-ray Scattering (RSoXS) vessel. SOLICITATION NUMBER: NB643060-22-00385 RESPONSE DATE: 03/15/2022 DESCRIPTION: The National Institute of Standards and technology (NIST) Materials Research Laboratory (MML) owns and operates the soft branch of the Spectroscopy Soft and Tender beamline (SST-1) located at the National Synchrotron Light Source II (NSLS-II) at Brookhaven National Lab, which requires an upgrade to operations on the existing Resonant Soft X-ray Scattering (RSoXS) vessel. This upgrade involves the procurement, installation, verification and testing of replacement high resolution stage including absolute encoders for the Sample X, Y, Z, theta motion. These upgrades will allow more resilient and consistent automated control and operation of the RSoXS sample manipulator. All elements of this work must be compatible with and not compromise any part of an existing design envelope developed in NIST previous procurement SB134117CN0044. The required products/ upgrades manufactured by FMB Oxford in the United Kingdom has been identified as meeting NIST�s requirements. Sole Source justification is based on the following: The existing instrument and this upgrade of the absolute encoders and upgraded high resolution stages on the RSoXS vessel are originally designed by FMB Oxford for NIST and no other vendor has the required parts and knowledge to perform this upgrade requirement. Failure to meet this designed upgrade in full would put the previous procurement at risk of catastrophic failure along with equipment damage or destruction. NAICS code for this requirement will be 334516 � Analytical Laboratory Instrument Manufacturing with a small business size of 1000 employees. This Notice is being issued with reference to FAR 6.302-1(2),(ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in- ������������������� �(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 03/15/2022 will be considered by the Government.
