- E.3 52.212-2 EVALUATION�COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021) (a) The Government intends to evaluate quotes and award a contract as follows: Provide your quote to Mariah.Montalvo@va.gov by the due date and time expressed on the first page of the RFQ. Submit questions in writing at least 4 business days prior to the due date for quotes. Verbal questions will not be answered. Please input the following in the subject line of the email: �Quote [Company Name] 36C26122Q0292 Automated Slide Stainer�. Please note the email has a size limitation of 5 GB. Zip files will be removed and therefore not considered. Late quotes will not be considered. The quote must be received by the due date/time shown. Please note delays of more than half an hour have been experienced with email transmission, so I recommend sending at least an hour prior to the time quotes are due. If you email your quote before quotes are due, but the Government receives it after quotes are due, the quote is late and will not be considered. Likewise, any post-closing amendments must be received timely. The following factors shall be used to evaluate quotes: 1. Authorized Distributor: You must either be the manufacturer and/or an authorized distributor. Authorized distributors must provide documentation from the manufacturer on the manufacturer�s letterhead. 2. Meet or Exceed Salient Characteristics: Quotes must thoroughly address the salient characteristic to be considered responsive to this solicitation with the exception of Past Performance, which requires no submission by offeror on this request. If offering an �or equal to� item, it is the offerors responsibility to provide adequate documentation to thoroughly determine and evaluate if the �or equal to� item meets and/or exceeds all salient characteristics. Descriptive Literature will include items such as warranties, special features, characteristics, and all measurement and calibration data to certify the system is performing in accordance with performance specifications. See FAR 52.214-21 Descriptive Literature included in the solicitation. 3. Socio-Economic Status- The Government will review VetBiz (https://www.vip.vetbiz.gov/ ) to confirm Service Disabled Veteran-owned Small Business (SDVOSB) and Veteran-owned Small Business (VOSB) status verification for quotes submitted. 4. Price - Fill in the price schedule and the price worksheet. Remember that all CLINs MUST be priced. Do not leave any CLIN prices blank, partial pricing is not acceptable. EVALUATION CRITERIA AND BASIS OF AWARD This acquisition is being conducted in accordance with Federal Acquisition Regulation (FAR) Part 13 Simplified Acquisition Procedures. The Government will award a contract resulting from this solicitation to the responsible vendor, whose quote, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. In accordance with FAR 13.106-2(b)(3), the quotes will undergo a comparative evaluation to determine which quoter provides the best value to the Government based on the information relative to the nonpriced factors while also providing a competitive price. Moreover, the Government is not assigning weight to the factors or listing them in any particular order. As a Part 13 acquisition, the Government does not intend on engaging in discussions described in FAR Part 15. As a 36C26122Q0292 Page 30 of 47 result, quotes must be complete and conform to the solicitation�s requirements described herein. Prior to conducting the comparative evaluation of quotes, the Government will do a preliminary screening of the quotes to determine if they are complete and conforming to the solicitation. Any errors, omissions, or representations contrary to the terms of the solicitation will be deemed incomplete and/or nonconforming. Any quotes that are incomplete or non-conforming will be eliminated from further consideration as being ineligible for award without engaging in discussions. The Government will not provide a notice of exclusion to vendors whose quotes are incomplete or nonconforming since it is not required under FAR Part 13. The remaining quotes which are deemed to be complete and conforming will then be evaluated. However, the Government reserves the right to change to Part 15 Negotiated Procedures utilizing discussions at the sole discretion of the Contracting Officer when deemed in the best interest of the Government. 1. Description of Automated Slide Stainer and Glass Coverslip: The Government will rate more favorably quotes that meet or exceed the requirements as outlined in the Salient Characteristics. The Government will rate less favorably quotes that do not give enough of a description of the �or equal to� items for the Government to determine if the comparable equipment meets the Government�s requirements outlined in the Salient Characteristics. As stated in ADDENDUM to FAR 52.212-1, preferred items for consideration would be complete manufacturer�s product specifications, product literature, sustainability certifications documents, and warranty information. 2. Socio Economic Status: The Government may rate more favorably quotes from verified Service Disabled Veteran Owned Small-Businesses (SDVOSBs) and/or Veteran Owned SmallBusinesses (VOSBs). 3. Price: The quote should contain the quoter�s best terms from a price standpoint. The Government will evaluate quotes for award purposes by adding the total price for all contract line items, including options, for a total price. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
