Description
This is a combined synopsis/solicitation for commercial supplies prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation for this action. Quotes are being requested, and a written solicitation will not be issued. This solicitation is issued as a Request for Quote (RFQ). Submit written quotes referencing RFQ 36C24622Q0403. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular- 2022-04 dated 01/30/2022. Any amendments issued to this solicitation will ONLY be available on the FBO website (www.fbo.gov). The Network Contracting Office (NCO) 6 Regional Procurement Office (RPO) EAST intends to award a firm-fixed price contract for the Brand Name MANOSCAN ESO Z CATHETER to the Hampton VA Medical Center in Hampton VA 23667 The North American Industrial Classification System (NAICS) code for this procurement is 339112 with a business size standard of 1000 employees. This procurement is SDVOSB set-aside to and for all eligible offerors may submit quotes. If your firm is a Service-Disabled Veteran Owned or Veteran Owned Small Business, you must be CERTIFIED in VetBiz (see internet site: http://vip.vetbiz.gov). All offerors must be registered in System for Award Management (SAM) at http://www.sam.gov to be considered for an award of a federal contract. The record must be complete and not missing elements such as representations and certifications. All questions pertaining to this RFQ, are due by 11:00 AM EST on Wednesday, March 16, 2022; and must be submitted via emailed to ruth.morris@va.gov. The Government will award a contract resulting from this RFQ to the responsible offeror whose quote represents the lowest price technically acceptable for the government. This procurement is for new OEM medical equipment only for VA Medical Centers. No remanufactures or gray market items will be acceptable.   (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.  (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract.  Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the government. DEPARTMENT OF VETERANS AFFAIRS Justification for Brand Name IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C246-22-AP-2863 Contracting Activity: Department of Veterans Affairs, VISN 06, Hampton VA Medical Center, 100 Emancipation Drive Hampton VA 23667 Purchase Request Number: 590-22-2-073-2676 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The Manoscan ESO Z Catheter is a high-resolution manometry system enables full evaluation of the motor functions of the esophagus. The system allows for enhanced sensitivity that provides useful information to support diagnosis of conditions like dysphagia, achalasia, and hiatal hernia. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Hampton VAMC has a brand-name requirement to procure the Manoscan ESO Z Catheter for the Endoscopy Suite Department. The Manoscan ESO Z Catheter requirement is to replace the old outdated existing Manoscan Catheter. This catheter is used in conjunction with the existing A200 module that includes an electronic control box and host computer. The required Manoscan ESO Z Catheter model is the only catheter compatible with the existing A200 module and the only devices that could be used with the current inventory supplies. The updated equipment will allow the Hampton VAMC to continue to provide seamless uninterrupted care for the veteran population and perform constant routine examines. Procuring other manufacturer items would undermine current standardization efforts and increase costs. Based on facility need and existing conditions, like or similar items will not suffice. Description of market research conducted and results or statement why it was not conducted: Market research was conducted by querying the VIP search conducted on 03/09/2022 utilizing NAICS 339112 and Key Words Manoscan ESO Z Catheter revealed 77 vendors: 74 SDVOSB and 03 VOSBs. NAC searched using keyword Manoscan revealed no potential contracts. SAC searched using keyword Manoscan under department of veteran affairs revealed no contracts. FPDS searched using keyword Manoscan ESO under department of Veteran Affairs revealed 22 purchase orders was used for information purposes only. GSA eLibrary search using keyword Manoscan yield no potential contractors. GSA Advantage: searched using keyword Manoscan and Manoscan ESO revealed no items. SBA Dynamic Small Business Search (SBDS) search using NAICS 339112 and Keywords Manoscan yield 1 potential contractor; additional search using NAICS 339112 and Keywords Manoscan ESO revealed no contractors. SBA.gov was used to verify 339112 size standards as 1000 employees. NCO 19 previously purchased Manoscan ESO Z Catheter under award 36C25921P0965 on 08/30/2021 to COVIDIEN SALES, LLC (Large Business DUNS: 078672022); 1 offer received. NCO 06 previously purchased Manoscan under award 36C24620P0730 on 03/03/2020 to Veterans Healthcare Supply Solutions (DUNS: 964899483; 1 offer received. The Brand Name Market Research specific items Manoscan ESO Z Catheter in need for this procurement are proprietary to MEDTRONIC dba Covidien Sales (Large Business: DUN: 078672022). The OEM have verified two (2) SDVOSB as authorized resellers distributors to sell their products and services: Veterans Healthcare Supply Solutions, Inc. (DUNS: 964899483) and Marathon Medical Corporation (DUNS: 122658151). The VA Rule of Two can be met for this requirement. The Contracting Officer does have a reasonable expectation of receiving 2 or more quotes from SDVOSB if we were to set this requirement aside as 100% SDVOSB. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
